MacConnell & Associates, PC received the Request for Additional Information/Notice of
Inspection dated March 11,2024 for the Porter Road site in Currie Mill SW Permit SW8 110415.
Attached to this letter is a revised application as requested with a corrected mailing address.
The Notice of Inspection identified both inlets to the stormwater pond needs site corrections to
operate as intended. The owner of the site is currently performing the corrections and those will
be completed within 90 days. A certification letter will be prepared by a Professional Engineer
stating compliance following the completion of the corrections.
The Notice of Inspection also identified impervious area being installed beyond the currently
permitted limits and a gravel road was recently paved. A permit modification is currently being
completed and will revise the permit to include the additional impervious area identified. This
permit modification will be submitted within 30 days.

The Wilmington Regional Office of the Division of Energy,Mineral and Land Resources(DEMLR)received and
accepted a signed Permit Transfer Application Form for the subject project on January 29,2024. The successor-
owner of the property has requested to transfer the permit without consent of the permit holder in accordance with
15A NC.AC 02H.1045(1)(c)and G.S. 143-214.7(c5). A preliminary in-depth review of the documentation
submitted with the transfer request determined that the application is incomplete,and that additional information
is needed.
Since the transfer was submitted under 15A NCAC 02H.1045(1)(c)and G.S. 143-214.7(c5), please provide the
following documentation in a single,hard copy submittal package to complete the application:
1. Mailing Address [15A NCAC 02H.1045(2)(a)(iv)]: The mailing address listed on the application is as
cc'd at the bottom of this letter. Please note that official correspondence must be mailed to the address
listed with the NC Secretary of State as listed at the top of this letter. Please update the application.
Notice of Inspection
On February 22,2024,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources
(DEMLR)inspected the subject project to determine the status of compliance with this permit,most recently
issued on March 20,2015. DEMLR file review and site inspection revealed that the site is not in compliance with
the terms and conditions of this permit. A copy of the completed form entitled"Compliance Inspection Report"
summarizing the findings of the recent inspection is attached to this letter. Please either address the following
items to demonstrate compliance with the permit sign and submit the enclosed drafted Schedule of
Compliance that provides a timeline in which the following compliance issues will be resolved.no later than
within one year of the permit transfer's issuance.
2. Site Inspection:
a. The pond has two forebays. The inlet of one forebay(in red in the attached diagrams)is not
directed to the pond and needs to be corrected. The inlet of the other forebay(in blue)is washed
out and needs to be maintained and stabilized.
b. There is additional impervious area being installed in the vicinity of the area in green which may

If you are in the office on Monday can we chat about the inspection? Your note says you talked to him about being
overbuilt and he plans to submit for a modification? Where is the new BUA? You also have a note about a ditch
not being filled in north of the pond and stormwater is bypassing something? Can you show me where that is? I
also see your note that woody vegetation needs to be removed and the site needs to be stabilized where it is
eroding after the vegetation is removed. I think that is in relation to the ditch rather than the pond? The pond looks
pretty clean.

Any tricks for finding sales history in Pender County? I cannot figure out how to see the sales history as can be
done in other counties. Our permittee sold this property at some point in history. I do not know how many times it
sold before our proposed applicant,TWAg&Timber, LLC,obtained it on 1/18/23 from John Jacob Rowe. I need to
figure out the date our current permittee, Intercontinental Hardwoods, LLC(dba IC Hardwoods, LLC),sold the
property for(c5). This is in Pender County, PIN#2276-78-2161-0000. (Or, Christine if I cannot figure this out,
should I just list the most recent deed in the cover letter showing when our proposed permittee obtained the
land...that is not quite what the rule asks for..)
