Your application states that you are applying for a NWP18 and that you received concurrence from USACE. Can you please provide that to me. The concurrence is for our delineation. We have received a provisional approval of NWP 18. 1 have attached both. 2. The General Certification from the Division of Water Resources that corresponds with NWP18 is GC4249. After reviewingyour application, I'm not sure if I am missing the reason behind needing an Individual401 Water Quality Certification from DWR. Can you please tell me what threshold or circumstances that makes this project ineligible for coverage under this General Certification as I'm not seeing it in the application that was provided to me. After further review, the project does not require notification to the DWR and should have been provided for courtesy review only. Please confirm if you do not plan to issue a GC approval letter so that I can notify the USACE that the permit is non -notifying with DWR, so that they can issue their final approval. Currently their approval is provisional pending issuance of your certification. 3. In the picture below: Is this the only portion of existing culvert that will be replaced? The red outlined area below is the existing culvert. There is also an existing culvert on the downstream end of the pipe that the proposed culvert will tie to. 1 � i � 1 � 1 � 1 1 1 1 1 4. On attachment C300, the permanent impact is listed in another area than what is shown above on attachment PERM IMP. I would like to see the current stream location, the existing culvert location, the new culvert location including any rip rap dissipator, the permanent and temporary impacts, and any existing or proposed features such as paths, roads etc. on one sheet similar to the small inset that was included on C300. Please also include a legend. The attached drawings show the location of the stream, existing culvert, proposed culvert, permanent impacts, temporary impacts, proposed pathway and proposed roadway. It is difficult to show on one drawing. I will try to clarify on the below drawings. Feel free to give me a call and we can discuss more if this doesn't help. Note the existing culvert is the section between the proposed impacts. 1 r fJ f � ! rf� r Temporary impact area is depicted below. Needed for dewatering and installation of the headwall. 5. From the information that I was provided, it seems as the culvert inlet is at a bend. This may cause additional streambank instability and erosion. Explain the placement of this inlet and if it can be moved to a straighter section of the stream. The culvert inlet is in a straight section. The culvert will tie into an existing culvert. The culvert is not expected to create additional velocities or cause additional erosion. 6. It seems that the length of the culvert was reported and not the length of the stream on the impacts. It is required to be measured as the length of stream — "as the thalweg". If this was made in error, please correct. The linear feet of stream was reported along the thalweg. 5 7. Provide details on the headwall that is mentioned in the application. The headwall will be constructed of prefabricated concrete and used deflect flow from the channel into the culvert inlet. The use of the headwall will also act as retaining walls that will reduce the overall length of pipe needed. 8. Many local governments and sediment & control plans will require energy dissipation and this should be shown on the plan and accounted for in the impacts. If the riprap is shown to be "keyed in" to the stream bed and stream banks, and normal stream width is maintained then these impacts can be counted as permanent impacts but not a "loss of stream function" and would not require mitigation. The pipe outlet is tying into an existing pipe that outlets into a concrete lined channel and is not expected to significantly add velocity or cause downstream erosion. Please respond to the items listed above within 30 days of this email.
