There are 164 4-bedroom units and 25 3-bedroom units. The proposed gravity sewer system will discharge to a proposed duplex pump station with a design flow rate of 0.04386 mgpd operating at 238 gpm at 48 TDH. The proposed pump station will be routed directly to the influent headworks at WWTP. Wastewater treatment is provided on-site with an extended aeration facility. Discharge utilizing on-site spray irrigation and wet weather storage permit #WQ0044496-Vickers Village WWTP. A flow reduction has been permitted for the facility to allow a minimum flow 1- and 2-bedroom dwellings at 120 gallons per day and each bedroom above two bedrooms shall increase the volume by 60 gallons per day. We find the plan to be acceptable and hereby issue this Letter of Approval. Erosion and Sedimentation Control Plan: This plan approval shall expire (2) years following the date on this Letter of Approval,unless a Land-Disturbing Permit has been obtained within that initial two-year period and remains in effect as provided in G.S. 164.12 (H). Active sites may have the permit renewed by applying for renewal 30 days prior to expiration. Section 10 (L) of the Chatham County Sedimentation and Erosion Control Ordinance requires that a copy of the approved erosion control plan be on file at the job site. North Carolina's Sedimentation Pollution Control Act is performance-oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, the erosion and sedimentation control plan is inadequate to meet the requirements of the Chatham County Sedimentation and Erosion Control Ordinance,this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with county, state and federal water quality laws, regulations and rules. In addition, local city or county ordinances or rules may also apply to this land-disturbing activity. This approval does not supersede any other permit or approval. Ins-pections: This letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to ensure compliance with the approved plan. Section 164.12 (1) of the Chatham County Sedimentation and Erosion Control Ordinance requires self-inspections and monitoring for all sites receiving a Land Disturbing Permit. These inspections can be done by the Financially Responsible Party, or an agent thereof.These inspections must occur at a minimum of once a week and within 24 hours of any rain event of 0.5 inch or greater. Copies of inspection records and reports must be kept on site and produced to Chatham County upon request. NPDES General Stormwater Permit NCG010000: Please be aware that your project will be covered by the new NPDES General Stormwater Permit NCG010000 (Construction Activities). You must apply and receive the NCG01 Certificate of Coverage electronically at the following website: https://deq.nc.gov/NCG01. The Electronic Notice of Intent, or "e-NOI form", link is used to complete this step. After you submit a complete and correct e-NOI form, a Certificate of Coverage will be emailed to you within three business days. Please direct questions about the e-NOI form to the Stormwater Program Supervisor of the North Carolina Department of Environmental Quality's Division of Energy, Mineral, and Land Resources. Contact information is available on the"Contacts"page of the above-referenced website. This form MUST be submitted prior to the commencement of any land disturbing activity on the above named project. If a construction activity that disturbs 1 acre or more (or is part of a subdivision or other common plan of development) fails to submit an e-NOI after the approval of its erosion and sedimentation control plan, then the permittee is in violation of federal permitting requirements and could be subject to penalty assessment. If you are a homebuilder—you need only obtain (1) Certificate of Coverage per subdivision, which will serve to cover all of your lots for that subdivision.When completing the e-NOI form, enter only the subdivision name,and do not list the lot number. If you are a developer—you will need (1) Certificate of Coverage for each set of approved plans in a subdivision. Please also be aware that you are required to provide updated information, in the event circumstances change regarding your project, to the North Carolina Department of Environmental Quality's Division of Energy,Mineral,and Land Resources by filing a"Modification Form".This can be found at htti2s://deq.nc.gov/NCG01. Land-Disturbing Permit: A Land-Disturbing Permit will be issued by Chatham County only after the above-referenced Certificate of Coverage is provided to Chatham County. Construction activities can begin only after the Land Disturbing Permit is issued. Active sites may have the permit renewed by applying for renewal 30 days prior to expiration. Chatham County's Land-Disturbing Permit must be posted at the job site once received. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. (Aqua), filed an Application for a Certificate of Public Convenience and Necessity and for Approval of Rates (Application) to provide sewer utility service to Vickers Village subdivision in Chatham County, North Carolina, in accordance with N.C. Gen. Stat. § 62-110. On July 25, 2023, the Public Staff filed a letter outlining the deficiencies in the Application and indicating that the Public Staff considers the Application incomplete. On July 31, 2023, the Commission issued an Order Finding Application Incomplete and Request for Additional Information. On May 16, 2024, Aqua filed additional information in response to the Public Staff's letter outlining deficiencies. On May 28, 2024, the Public Staff filed a letter with the Commission indicating that this docket now includes all the information required for a complete application. On May 29, 2024, the Commission issued an Order Finding Application Complete and Requiring the Public Staff to Provide Specific Application Data. On June 3, 2024, the Public Staff filed the information requested by the Commission. On June 4, 2024, the Commission issued an Order Scheduling Hearing and Establishing Discovery Guidelines. On June 19, 2024, Aqua filed a revised page 7 of its Application. On June 26, 2024, Aqua and the Public Staff filed a Joint Motion to Cancel Prefiling of Testimony and Cancel Hearing. On July 8, 2024, the Commission issued its Order canceling the requirement for prefiled testimony and canceling the expert witness hearing. On July 8, 2024, the Public Staff presented this matter at the Commission's Regular Staff Conference. The Public Staff recommends that the Commission issue an order granting the franchise and approving the requested rates. Based upon the verified Application, and the entire record in this matter, the Commission makes the following FINDINGS OF FACT 1. Aqua presently holds water franchises serving approximately 84,000 customers and sewer franchises serving approximately 21,000 customers throughout North Carolina. Aqua's record of service is satisfactory. 2. Aqua expects to eventually serve 204 sewer customers in Vickers Village. The service area is shown on plans filed with the Application. 3. The North Carolina Department of Environmental Quality, Division of Water Resources, issued a permit for Vickers Village with permit No. WQ0044496 dated April 30, 2024. 4. Aqua entered into an Asset Purchase Agreement effective February 21, 2023, with The Vickers Bennett Group, LLC (Developer), under which (1) the Developer is installing the wastewater treatment facility and collection system and (2) Aqua is acquiring the collection system and wastewater treatment facility from the Developer at $5,250 per single-family residential equivalent (SFRE) payable quarterly based upon the number of SFREs connected during the previous quarter. 5. Aqua has filed all exhibits required with the Application. 6. Aqua has the technical, managerial, and financial capacity to provide sewer utility service in this franchise location. 7. Aqua proposes to charge Vickers Village its uniform statewide sewer utility service rates approved for its other franchised service areas. 8. The Public Staff recommends that Aqua be required to post a $25,000 bond for Vickers Village. Aqua currently has $16,125,000 of bonds posted with the Commission. Of this amount, $13,145,000 of bond surety is assigned to specific subdivisions and $2,980,000 of bond surety is unassigned. 2 CONCLUSIONS Based on the foregoing and the recommendations of the Public Staff, the Commission concludes that $25,000 of Aqua's unassigned bond surety should be assigned to Vickers Village, that the sewer utility franchise requested by Aqua in Vickers Village should be granted, and that the requested rates should be approved. IT IS, THEREFORE, ORDERED as follows: 1. That $25,000 of Aqua's unassigned bond surety is assigned to Vickers Village. The remaining unassigned bond surety shall be $2,955,000; 2. That Aqua is granted a certificate of public convenience and necessity to provide sewer utility service in Vickers Village in Chatham County, North Carolina, and Appendix A, attached hereto, constitutes the Certificate of Public Convenience and Necessity; 3. That Aqua's existing Schedule of Rates approved by Commission Order issued on July 31, 2023, in Docket No. W-218, Sub 573, is approved for sewer utility service in Vickers Village; 4. That Aqua shall follow applicable state and federal laws and Commission guidance with respect to income tax gross-up on contributions in aid of construction per orders issued in Docket No. W-100, Sub 57; 5. That, to the extent not previously filed in the docket, Aqua shall file, within 14 days of their availability, all completed exhibits to the Wastewater Utility System Agreement including, but not limited to, deeds, easements, warranties, bills of sale, and written certifications of cost; and 6.
