Staff of the Winston-Salem Regional Office have confirmed that this Permit is no longer required. Therefore, in accordance with your request, NPDES Permit No. NCO022446 is rescinded, effective immediately. If in the future you wish to again discharge wastewater to the State's surface waters, you must first apply for and receive a new NPDES Permit. Operating a facility without a valid NPDES Permit will subject the responsible party to a civil penalty of up to $10,000 per day. As we mentioned during the meeting, our goal is to provide quality cost efficient service to our customers while complying or exceeding state, federal, and local regulations. As November 24, 1999, AquaSource Inc. acquired ownership of Rayco Utilities, Inc and f. Willowbrook Utilities, Inc. AquaSource Inc. is now the responsible party for all matters pertaining to these facilities, including any Notice of Violations, enforcement actions, environmental concerns, etc. Any enforcement or pending enforcement actions issued prior to November 24, 1999, are the responsibility of the previous owners (Leonard and Rachel Stogner) and will remain their responsibility to resolve any such matters with your department. In order to make this change in responsibility work within the legal requirements of the permit system, the NPDES permit documentation should be revised to reflect the new ownership and responsibility. Therefore, please accept this letter as my formal request, as an officer of AquaSource, Inc., that the records for all facilities listed on Attachment A be updated and revised to reflect ownership by AquaSource, Inc. In addition, that our Regional Manager, Glenn LaBrecque, be designated as the responsible party. Mr. Leonard Stogner who as a former owner of Rayco Utilities, Inc. and Willowbrook Utilities, Inc. also requests this change and further acknowledges that all matters described and discussed herein are accurate also signs this letter. Mr. Stogner now works as an employee of AquaSource in a role where he is closely involved in the day to day operations but no longer serves in a capacity as a responsible party. He now reports directly to our Regional Manager, Glenn LaBrecque. We believe Mr. Stogner will provide valuable assistance in the position of industrial and construction manager. His knowledge of operations will be utilized in coordinating the efforts of our operators. We hope that your staff and particularly the regional staff will understand that it is optional whom they choose to contact. Given as a reason for the lack of operation and maintenance is the fact that there is no road to access the plant. Rayco Utilities has an easement for a road but a road has never been put in. If the notice covers more than one month, the notice shall specify the reasons for the anticipated production level increase. New notice of discharge at alternate levels is required to cover a period or production level not covered by prior notice or, if during two consecutive months otherwise covered by a notice, the production level at the permitted facility does not in fact meet the higher level designated in the notice. (2) The permittee shall comply with the limitations, standards, or prohibi- tions that correspond to the lowest level of production specified in the permit, unless the permittee has noti- fied the Director under paragraph (b)(2)(ii)(13)(1) of this section, in which case the permittee shall comply with the lower of the actual level of Production during each month or the level specified in the notice. (3) The permittee shall submit with the DMR the level of production that actually occurred during each month and the limitations, standards, or pro- hibitions applicable to that level of production. (c) Metals. All permit effluent limita- tions, standards, or prohibitions for a metal shall be expressed in terms of "total recoverable metal" as defined in 40 CFR, Part 136 unless: (1) An applicable effluent standard or limitation has been promulgated under the CWA and specifies I.he Ilrnl- tatlo,0 for the metal in the dissolved or Val 1, or total form; or (271n establishing permit limitations on a case -by -case basis under § 125.3, it is necessary to express the limitation on the metal in the dissolved or valent or total form to carry out the provi- sions of the CWA; or (3) All approved analytical methods for the metal inherently measure only its dissolved form (e.g., hexavalent chromium). (d) Continuous discharges. For con- tinuous discharges all permit effluent limitations, standards, and prohibi- tions, including those necessary to 40 CFR Ch. 1 (7-1-87 Edition) achieve water quality standards, shall unless impracticable be stated as: (1) Maximum daily and average monthly discharge limitations for all dischargers other than publicly owned treatment works; and (2) Average weekly and average monthly discharge limitations for POTWs. (e) Non -continuous discharges. Dis- charges which are not continuous, as defined in § 122.2, shall be particularly described and limited, considering the following factors, as appropriate: (1) Frequency (for example, a batch discharge shall not occur more than once every 3 weeks); (2) Total mass ffor example, not to exceed 100 kilograms of zinc and 200 kilograms of chromium per batch dis- charge); (3) Maximum rate of discharge of pollutants during the discharge (for example, not to exceed 2 kilograms of zinc per minute); and (4) Prohibition or limitation of speci- fied pollutants by mass, concentration, or other appropriate measure (for ex- ample, shall not contain at any time more than 0.1 mg/1 zinc or more than 250 grams (1/4 kilogram) of zinc in any discharge). (f) Mass limitations. (1) All pollut- ants limited in permits shall have limi- tations, standards or prohibitions ex- pressed in terms of mass except: (i) For pH, temperature, radiation, or other pollutants which cannot ap- propriately be expressed by mass; (it) When applicable standards and limitations are expressed in terms of other units of measurement; or (111) If in establishing permit. Ilmita- tions on a case -by -case basis under § 125.3, limitations expressed in terms of mass are infeasible because the mass of the pollutant discharged cannot be related to a measure of op- eration (for example, discharges of TSS from certain mining operations), and permit conditions ensure that di- lution will not be used as a substitute for treatment. (2) Pollutants limited in terms of mass additionally may be limited in terms of other units of measurement, and the permit shall require the per- mittee to comply with both limita- tions. Environmental Protection Agency (g) Pollutants in intake water. (1) Upon request of the discharger, tech- nology -based effluent limitations or standards shall be adjusted to reflect credit for pollutants in the discharg- er's intake water if: (i) The applicable effluent limita- tions and standards contained in 40 CPR Subchapter N specifically pro- vide that they shall be applied on a net basis; or (it) The discharger demonstrates that the control system it proposes or uses to meet applicable technology - based limitations and standards would, if properly installed and operated, meet the limitations and standards in the absence of pollutants in the intake waters. (2) Credit for generic pollutants such as biochemical oxygen demand (BOD) or total suspended solids (TSS) should not be granted unless the per- mittee demonstrates that the constitu- ents of the generic measure in the ef- fluent are substantially similar to the constituents of the generic measure in the intake water or unless appropriate additional limits are placed on process water pollutants either at the outfall or elsewhere. (3) Credit shall be granted only to the extent necessary to meet the ap- plicable limitation or standard, up to a maximum value equal to the influent value. Additional monitoring may be necessary to determine eligibility for credits and compliance with permit limits. (4) Credit shall be granted only if the discharger demonstrates that the intake water is drawn from the same body of water into which the dis- charge is made. The Director may waive this requirement if he finds that no environmental degradation will result. (5) This section does not apply to the discharge of raw water clarifier sludge generated from the treatment of intake water. (h) Internal waste streams. (1) When permit effluent limitations or stand- ards imposed at the point of 'discharge are impractical or infeasible, effluent limitations or standards for discharges of pollutants may be imposed on inter- nal waste streams before mixing with other waste streams or cooling water § 122.4; streams. In those instances, the moni- toring required by § 122.440) shall also be applied to the internal waste streams. (2) Limits on internal waste streams will be imposed only when the fact sheet under § 124.56 sets forth the ex- ceptional circumstances which make such limitations necessary, such as when the final discharge point is inac- cessible (for example, under 10 meters of water), the wastes at the point of discharge are so diluted as to make monitoring impracticable, or the inter- ferences among pollutants at the point of discharge would make detection or analysis impracticable. (i) Disposal of pollutants into wells, into POTWs or by land application. Permit limitations and standards shall be calculated as provided in § 122.50. Fecal Colifotm limitation: The fecal coliform limit was assigned at the request of the Winston-Salem regional office. Though our standard operating procedure (SOP) requires a fecal coliform limit only if the dilution ratio is less than 333:1 and in this case, the dilution ratio is 427:1, a fecal limit is recommended based on poor operating performance by the facility. In addition, chlorination is already part of the treatment process but levels are not reported. To ensure protection of the Haw River, a fecal coliform limit and chlorine monitoring are recommended. 2.) Daily Max. limitations: The permit should be renewed at existing limits for BOD5 and NH3-N with monthly and weekly average limits. All listed daily maximum limits should be changed. 3.) Total Phosphorus: The total phosphorus limit of 2 mg/1 is an existing limit. This limit is based on the NSW designation of the Haw River per our SOP for the Jordan Lake Watershed.
