Please see the attached letter approving the NCDMS Dirty Boots Site Final Mitigation Plan (SAW-2022-02401) for inclusion in the NC Division of Mitigation Services In-lieu Fee Program
as an instrument modification. This electronic copy is your official Department of the Army authorization; no paper copy will be mailed unless you request a copy. Please note that
this approval letter does not release any credits.

As mentioned in the attached letter, submittal of a pre-construction notification (PCN) application for Nationwide Permit 27 authorization is required for work within waters of the United
States associated with the restoration and enhancement of aquatic resources at the project site.

Good morning IRT,

NCDMS has submitted the Dirty Boots Mitigation Project Final Mitigation Plan. The mitigation provider’s response to IRT comments is included with the final mitigation plan. The final
version of this document has been posted to the ILF Site cyber repository on RIBITS. Please note that you must be logged in to access documents in the cyber repository. If you would
prefer to receive a hard copy of the final mitigation plan, please contact me so that I can arrange to have one delivered.

We have evaluated the comments generated during the review period for the draft mitigation plan as well as the responses from the mitigation provider (included with the final mitigation
plan) and determined that all issues have been adequately addressed. Accordingly, it is our intent to approve the Dirty Boots Final Mitigation Plan unless a member of the NCIRT initiates
the Dispute Resolution Process, as described in the Final Mitigation Rule (33 CFR Section 332.8(e)). Please note that initiation of this process requires that a senior official of
the agency objecting to the approval of the mitigation plan notify the District Engineer by letter within 15 days of this email (by COB on August 15, 2024). Please notify me if you
intend to initiate the Dispute Resolution Process.

Provided that we do not receive any objections, we will provide an approval letter to NCMDS following the conclusion of the 15-day Dispute Resolution window. All NCIRT members will
receive a copy of this letter for your records.
