Rockingham County Dear Mr. Lord: Reference is made to your request for rescission of the subject NPDES General Permit. Staff of the Winston - Salem Regional Office have confirmed that the facility no longer needs this discharge permit. Therefore, in accordance with your request, NPDES General Permit No. NCG510224 is rescinded, effective immediately. If in the future you again need a NPDES General Permit to discharge to the State's surface waters, you must first apply for and receive a new NPDES Permit. Discharging without a valid NPDES Permit will subject the discharger to a civil penalty of up to $10,000 per day. Box 1148 Reidsville, North Carolina 27320 Subject: General Permit NCG510000 Cert. of Coverage NCG510224 Love Oil Company Rockingham County Dear Mr Love: In accordance with your application for an NPDES discharge permit received September 7, 1994 by the Division, we are herewith forwarding the subject Certificate of Coverage under the state-NPDES general permit for Groundwater Remediation Projects and one set of final approved plans and specifications. Authorization is hereby granted for the construction and operation of a groundwater treatment system consisting of a 1000 gallon oil water separator, dual diffused aeration tanks providing a minimum air/water ratio of 374/1 at a flow rate of 10 gallons per minute, a flow meter, particulate filter, a granular activated carbon canister providing 95 pounds of total activated carbon, sample ports located before the air stripper, before the GAC unit and prior to discharge, and all necessary pumps, piping and appurtenances with discharge of treated wastewater into an Unnamed Tributary to Lake Hunt in the Cape Fear River Basin. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the US Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as subsequently amended. If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to you, you have the right to submit an individual permit application and letter requesting coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please take notice this permit is not transferable. Part H, E.4. addresses the requirements to be followed in case of change of ownership or control of this discharge. The Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES Permit No. NCG510000, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NCG510000. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. The Winston-Salem Regional Office, telephone number (910) 771-4600, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. P.O. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC 27626-0535. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143- 215.E for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be required by the Division of Environmental Management or permits required by the Division of Land Resources, the Coastal Area Management Act or any Federal or Local other governmental permit that may be required. This certificate of coverage shall become effective February 6, 1995 This Certificate of Coverage shall remain in effect for the duration of the General Permit.
