Reference is made to your request for rescission of the subject NPDES Permit. The staff
of the Winston-Salem Regional Office has confirmed that this permit is no longer required.
Therefore. in accordance with your request, NPDES Permit NCO036994 is rescinded, effective
immediately.
If in the future you wish to again discharge wastewater to the State's surface waters, you
must first apply for and receive a new NPDES Permit. Operating a facility without a valid
NPDES Permit will subject the responsible party to a civil penalty of up to $25,000 per day.

INTRODUCTION
Rockingham County Schools / Monroeton Elementary (also herein referred to as the Permittee)
requires a National Pollutant Discharge Elimination System (NPDES) permit to dispose treated
wastewater to the surface waters of the state. The Permittee's 5-year NPDES permit expired January
31, 2001 and they have requested renewal from the Division of Water Quality (the Division). This
Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to
determine permit limits and conditions. This document also references information sources relevant to
this permit renewal (superscripted numbers in order of appearance, see References).
FACILITY RECORDS REVIEW
Facility Description. Monroeton Elementary (Table 1) serves 350 staff and students. The school
utilizes a Class I wastewater treatment facility consisting of a septic tank system with dosing tank and
re -circulating sand filter followed by tablet chlorine disinfection with timed effluent release.'

Previous Permit. The previous permit expired on January 31, 2001 and the Division received
appropriate documentation to renew (Short Form D) on December 18, 2000.1 The Division's records
date from 1982 and indicate discharge flow monitoring five days per week through Outfall 001. The
school operates year-round except summers (June and July) and holidays when discharge is typically
reported as "No Flow."8 Although the permit specifies a design flow of 0.00425 million gallons per
day (MGD), actual discharge averaged about 0.003 MGD (1999 through May 2001) or about 71 % of
permitted capacity.$
Waste Load Allocation (WLA). The Division prepared the last WLA in October 1989 and
developed effluent limits and monitoring considering an in -stream waste concentration (IWC) of 100
%.6 The Division judges these limits and monitoring requirements to be appropriate for this renewal
(see PERMITTING APPROACH).
COMPLIANCE SUMMARY
Notices of Violation (NOVs) and Special Conditions. Previous permit limits and monitonn&
requirements have been waved through Special Order by Consent (SOC), effective April 9, 1997.
There have been no other NOVs issued to this facility within the last two years.
Verifying Existing Stream Conditions. This facility discharges to a "zero -flow" stream.3''
Wastewater from this facility discharges to an unnamed tributary (UT) of Troublesome Creek ,2'6 a
Class WS-III NSW stream within the Cape Fear River Basin.3 Troublesome Creek is an "impaired
waterbody" [303(d) listed] due to "...sediment based on biological impairment." 5
DMR Data and Instream Monitoring Review. Previous permit limits and monitoring requirements
have been waved through Special Order by Consent (SOC), effective April 9, 1997.9 The SOC
precluded instream monitoring, therefore there are no instream data.9 Treatment -system effluent
typically discharges to a dry creek bed (zero -flow conditions) disappearing to the subsurface at some
unspecified distance downstream of Outfall 001. Effluent fecal coliform counts in 1999 and 2000
averaged about 2 colonies per 100 ml (maximum 4 colonies per 100 ml) with Total Residual Chlorine
(TRC) concentrations averaging about 500 µg/L. Dissolved oxygen concentrations are reported
between 8 an 11 mg/1L.8
CORRESPONDENCE
Staff Reports. Inspection Reports for the past five years (1997 through 2001) indicate that the
permittee has satisfactorily maintained and operated this facility under the SOC. Monroeton
Elementary School is one of eight facilities covered under the SOC. The SOC requires, at minimum,
annual inspections and staff reports, and also requires the permittee to discontinue discharge and to
rescind the permit by September 1, 2005.9 Therefore the permittee intends to abandon this
NPDES permit during this next permit cycle.

Permitting Approach
Because this facility discharges under "zero -flow" stream conditions to an "impaired" waterbody,
restrictive limits are already in place (ammonia -- 2.0 mg/L summer / 4.0 mg/L winter). The Division
has therefore made no changes to previous effluent limits and monitoring requirements. The permittee
will be reminded in the cover letter that this facility discharges under "zero -flow" and "impaired"
conditions.

Elementary School.. The Rockingham County School System is hereby requesting renewal of
permit # NC0036994 and permit #NC0066010. There have been no changes at these two
facilities since the issuance of the last permits. Also, enclosed are maps that we hope will be
helpful.
SLUDGE MANAGEMENT PLAN:
These two plants do not have sludge removal. The sludge and solids generated are pumped by
Billingsley Septic Tank Company in the month of June each year after school closing for the
summer.

Dear Mr. Holcomb:
The Division is beginning the cycle of permit renewals for the Cape Fear river basin. An examination of the Cape
Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES
permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary
delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for
NPDES permits in the Cape Fear river basin.
This permit modification changes the expiration date of the subject permit in subbasin 30601 to April 30, 2001.
Please find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page.
All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit
modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of
Agreement between North Carolina and the U. S. Environmental Protection Agency.
In accordance with the modification of the permit expiration date, the new due date for your renewal application was
November 1, 2000. Renewal application forms are enclosed. If you require additional copies of the form, you may
download it from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.htnil. You will need to
download Short Form D. If you have already submitted a permit renewal form, there is no need to submit any other
forms to the Division; the application will be processed during the renewal period for your subbasin.
If any part of this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming
to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final. and binding.

Rockingham County Consolidated Schools' Board of Education,
hereinafter referred to as the Board, and the North Carolina
Environmental Management Commission, an agency of the State of
North Carolina created by G.S. 143B-282, and hereinafter referred
to as the Commission:
1. The Board and the Commission hereby stipulate the following:
(a) That the Board holds North Carolina NPDES permits
for nine (9) wastewater treatment works which discharge into

(b) That current Division of Water Quality procedure
mandates the eventual removal of all oxygen consuming
effluents discharging to zero 7Q10 and 30Q2 flow streams.
It is anticipated that during the next permit renewal period
the schools listed in 1(a) above will receive permit limits
of 5.0 mg/l BOD and <2.0 mg/l NH3-N.
(c) That the Board is presently unable to comply,,or will
be unable to comply, with the final effluent limitations
found in Part I.A. of the permits in 1(a) above.

(d) That noncompliance with final effluent limitations
constitutes causing and contributing to pollution of the
waters of this State named above, and the Board is within
the jurisdiction of the Commission as set forth in G.S.
Chapter 143, Article 21.
(e) Since this Special Order is by Consent, neither party
will file a petition for a contested case or for judicial
review concerning its terms.
2. The Board, desiring to comply with the permits identified in
paragraph 1(a) above, hereby agrees to do the following:
(a) Comply with all terms and conditions of the permits
except those effluent limitations identified in Attachments
A (1-9) for all current monitoring requirements and effluent
limitations. The permittee may also be required to monitor
for other parameters as deemed necessary by the Director in
future permits or administrative letters.
(b) Undertake the following activities in accordance with
the indicated time schedule:
(1) Submit plans, specifications and any required
applications for the Rockingham County High School,
Wentworth Elementary School, and the County Center
Building on or before July 1, 1997.
(2) Submit plans, specifications and any required
applications for Bethany School on or before September
1, 1997.
(3) Submit plans, specifications and any required
applications for Lincoln School on or before December
1, 1997.
(4) Begin construction on appropriate connections or
improvements for Rockingham County High School,
Wentworth Elementary School, and the County Center
Building on or before February 1, 1998.
(5) Begin construction on improvements at Bethany
School on or before March 1, 1998.
(6) Begin construction on improvements at Lincoln
School on or before July 1, 1998.
(7) Cease discharge by subsurface disposal or spray
irrigation at Lincoln School on or before September 1,
1998.
(8) Complete construction on improvements at Bethany
School on or befdria November 1, 1998.

(9) Submit plans, specifications and any required
applications (if applicable) for Happy Home School,
Sadler School, Monroeton School and Williamsburg School
on or before December 1, 1998.
(10) Achieve compliance with final effluent limits at
Bethany School on or before February 1, 1999.
(11) Begin construction on improvements (if applicable)
at Happy Home School, Sadler School, Monroeton School
and Williamsburg School on or before July 1, 1999.
(12) Complete construction by connection to the Mayodan
sewer collection system at Rockingham County High
School, Wentworth Elementary School and the County
Center Building on or before August 1, 1999.
(13) Cease discharge by subsurface disposal or
connection into a sewer collection system or spray
irrigation (if applicable) at Happy Home School, Sadler
School, Monroeton School and Williamsburg School on or
before November 1, 1999.
(14) Submit an annual status reports for all schools on
or before January 31 of each year this Order is in
effect.
(c) During the time in which this Special Order by Consent
is effective, comply with the interim effluent limitations
contained in Attachments A(1-9). The attachments should
replace the effluent limitations and monitoring requirements
page of the subject NPDES permits while this Order is in
effect or until the targeted compliance dates contained in
2(b) are met. The following reflects only the limitations
that have been modified from NPDES requirements by this
Order:

3. The Board agrees that unless excused under paragraph 4, the Board
will pay the Director of DWQ, by check payable to the North Carolina
Department of Environment, Health and Natural Resources, according to the
following schedule for failure to meet the deadlines set out in
paragraphs 2(b) and 2(d), or failure to attain compliance with the
effluent limitations/monitoring requirements contained in Attachment A.

4. The Board and the Commission agree that the stipulated penalties are
not due if the Board satisfies the DEM that noncompliance was caused
solely by:
a. An act of God;
b. An act of war;
c. An intentional act or omission of a third party
but this defense shall not be available if the act or
omission is that of an employee or agent of the defendant or
if the act or omission occurs in connection with a
contractual relationship with the permittee;
d. An extraordinary event beyond the permittees control.
Contractor delays or failure to obtain funding will not be
considered as events beyond the permittee's control; or
e. Any combination of the above causes.
Failure within 30 days of receipt of written demand to pay the penalties,
or challenge them by a contested case petition pursuant to G.S. 150B-23,
will be grounds for a collection action, which the Attorney General is
hereby authorized to initiate. The only issue in such an action will be
whether the 30 days has elapsed.
5. Noncompliance with the terms of this Special Order by Consent is
subject to enforcement action in addition to the above stipulations,
including injunctive relief pursuant to G.S. 143-215.6.
6. This Special Order by Consent and any terms, conditions and interim
effluent limitations contained herein, hereby supersede any and all
previous Special Orders and Enforcement Compliance Schedule Letters, and
terms, conditions, and limitations contained therein issued in connection
with NPDES Permits listed above.
7. The permittee, upon signature of the Special Order by Consent, will
be expected to comply with all scheduleLlates, terms, and conditions of
this document.

8. The Board may request an SOC amendment which would remove a
school(s) from the requirement of ceasing to discharge providing that the
proper NPDES Permit modifications and Authorizations to Construct are
acquired and that the removed facility will meet the stricter permit
limits by the cease discharge date.
9. This Special order by Consent shall expire on February 1, 2000.

These are existing limits except for fecal coliform, which has been
revised.
Per standard Division procedure for dischargers to streams with
7Q10=0 and 30Q2=0, recommend removal of discharge as soon as an
alternate method of wastewater disposal can be found.
The instream monitoring requirement may be dropped when the facility
agrees, in writing, to a schedule for removal of discharge.
The instream monitoring requirement of the existing permit is not being
fulfilled. Recommend the Region investigate, and make sure the instream
monitoring will be done in the future.

A letter of request for Authorization to Construct was received April 2,
1984, by the Division and final plans and specifications for the subject project
have been reviewed and found to be satisfactory. Authorization is hereby granted
for the construction of a 0.00425 MGD wastewater treatment facility consisting of
a new grease trap, an existing septic tank and dosing tank, upgrade of the exist-
ing sand filter with recirculation pumps, chlorination and post aeration to serve
the Monroeton School.
This Authorization to Construct is issued in accordance with Part III paragraph
C of NPDES Permit No. NCO036994 issued December 20, 1983, and shall be subject to
revocation unless the wastewater treatment facilities are constructed in accordance
with the conditions and limitations specified in Permit No. NCO036994.
The Permittee must employ a certified wastewater operator in accordance with
Part III paragraph D of the referenced permit.
The sludge generated from these treatment facilities must be disposed of in
accordance with G.S. 143-215.1 and in a manner approvable by the North Carolina
Division of Environmental Management.
The Winston Salem Regional Office, telephone number 919/761-2351 shall be
notified at least twenty-four (24) hours in advance of backfilling of the installed
surface filter system so that an in -place inspection can be made of said system
prior to backfilling. Such notification to the Regional Supervisor shall be made
during the normal office hours from 8:00 A.M. until 5:00 P.M, on Monday through
Friday, excluding State Holidays.

In event the facilities fail to perform satisfactorily in meeting it's
NPDES permit effluent limits, Rockingham County Schools shall take such
immediate corrective action as may be required by this Division, including
the construction of additional wastewater treatment and disposal facilities.
The sand media of the surface filter must comply with the Division's sand
specifications and must be analyzed and approved by this Division either by
direct sampling or by acquisition of filter sand from a dealer who is currently
certified by the Division as an acceptable source.
One (1) set of approved plans and specifications is being forwarded to
you. If you have any questions or need additional information, please contact
