July 13, 2001 DENR / DWQ / NPDES Unit FACT SHEET FOR NPDES PERMIT DEVELOPMENT NPDES Permit No. NCO036994 INTRODUCTION Rockingham County Schools / Monroeton Elementary (also herein referred to as the Permittee) requires a National Pollutant Discharge Elimination System (NPDES) permit to dispose treated wastewater to the surface waters of the state. The Permittee's 5-year NPDES permit expired January 31, 2001 and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and conditions. This document also references information sources relevant to this permit renewal (superscripted numbers in order of appearance, see References). FACILITY RECORDS REVIEW Facility Description. Monroeton Elementary (Table 1) serves 350 staff and students. The school utilizes a Class I wastewater treatment facility consisting of a septic tank system with dosing tank and re -circulating sand filter followed by tablet chlorine disinfection with timed effluent release.' The previous permit expired on January 31, 2001 and the Division received appropriate documentation to renew (Short Form D) on December 18, 2000.1 The Division's records date from 1982 and indicate discharge flow monitoring five days per week through Outfall 001. The school operates year-round except summers (June and July) and holidays when discharge is typically reported as "No Flow."8 Although the permit specifies a design flow of 0.00425 million gallons per day (MGD), actual discharge averaged about 0.003 MGD (1999 through May 2001) or about 71 % of permitted capacity.$ Waste Load Allocation (WLA). The Division prepared the last WLA in October 1989 and developed effluent limits and monitoring considering an in -stream waste concentration (IWC) of 100 %.6 The Division judges these limits and monitoring requirements to be appropriate for this renewal (see PERMITTING APPROACH). COMPLIANCE SUMMARY Notices of Violation (NOVs) and Special Conditions. Previous permit limits and monitonn& requirements have been waved through Special Order by Consent (SOC), effective April 9, 1997. There have been no other NOVs issued to this facility within the last two years. Verifying Existing Stream Conditions. This facility discharges to a "zero -flow" stream.3'' Wastewater from this facility discharges to an unnamed tributary (UT) of Troublesome Creek ,2'6 a Class WS-III NSW stream within the Cape Fear River Basin.3 Troublesome Creek is an "impaired waterbody" [303(d) listed] due to "...sediment based on biological impairment." 5 DMR Data and Instream Monitoring Review. Previous permit limits and monitoring requirements have been waved through Special Order by Consent (SOC), effective April 9, 1997.9 The SOC precluded instream monitoring, therefore there are no instream data.9 Treatment -system effluent typically discharges to a dry creek bed (zero -flow conditions) disappearing to the subsurface at some unspecified distance downstream of Outfall 001. Effluent fecal coliform counts in 1999 and 2000 averaged about 2 colonies per 100 ml (maximum 4 colonies per 100 ml) with Total Residual Chlorine (TRC) concentrations averaging about 500 µg/L. Dissolved oxygen concentrations are reported between 8 an 11 mg/1L.8 CORRESPONDENCE Staff Reports. Inspection Reports for the past five years (1997 through 2001) indicate that the permittee has satisfactorily maintained and operated this facility under the SOC. Monroeton Elementary School is one of eight facilities covered under the SOC. The SOC requires, at minimum, annual inspections and staff reports, and also requires the permittee to discontinue discharge and to rescind the permit by September 1, 2005.9 Therefore the permittee intends to abandon this NPDES permit during this next permit cycle. Fact Sheet Renewal -- MIDES \C 003699-t N2C Permitting Approach Because this facility discharges under "zero -flow" stream conditions to an "impaired" waterbody, restrictive limits are already in place (ammonia -- 2.0 mg/L summer / 4.0 mg/L winter). The Division has therefore made no changes to previous effluent limits and monitoring requirements. The permittee will be reminded in the cover letter that this facility discharges under "zero -flow" and "impaired" conditions. An intentional act or omission of a third party but this defense shall not be available if the act or omission is that of an employee or agent of the defendant or if the act or omission occurs in connection with a contractual relationship with the permittee; d. An extraordinary event beyond the permittees control. Contractor delays or failure to obtain funding will not be considered as events beyond the permittee's control; or e. Any combination of the above causes. Failure within 30 days of receipt of written demand to pay the penalties, or challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection action, which the Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the 30 days has elapsed. 5. Noncompliance with the terms of this Special Order by Consent is subject to enforcement action in addition to the above stipulations, including injunctive relief pursuant to G.S. 143-215.6. 6. Authorization is hereby granted for the construction of a 0.00425 MGD wastewater treatment facility consisting of a new grease trap, an existing septic tank and dosing tank, upgrade of the exist- ing sand filter with recirculation pumps, chlorination and post aeration to serve the Monroeton School. This Authorization to Construct is issued in accordance with Part III paragraph C of NPDES Permit No. NCO036994 issued December 20, 1983, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NCO036994.
