(for Occidental Chemical Corporation), Hart & Hickman, PC (H&H) is submitting the attached Groundwater Quality Monitoring: Compliance Report Forms (GW-59A and GW-59) and laboratory analytical report for groundwater samples collected during July 2024 in accordance with the Occidental Chemical Corporation Surface Disposal of Residuals (SDR) Permit No. WQ0001492 for the Elementis Chromium Castle Hayne Manufacturing Facility. Under the terms of the SDR permit, groundwater within an established Compliance Boundary (generally surrounding the Quarry as depicted in Figure 1) is monitored on a semi-annual basis (during July and November) for chloride, total chromium, total iron, total nickel, pH, and total dissolved solids (TDS). Note that the chromium business of Elementis plc (including Elementis Chromium, LP) was purchased by Yildirim Holding A.S. (a Dutch -Turkish industrial group headquartered in Istanbul and Amsterdam) during January 2023, and the Facility is now being operated under the name American Chrome and Chemicals, LLC (ACC). Legal obligations and contracts between Occidental and Elementis remain in effect between Occidental and ACC. Background Information The facility is currently operating under a 1999 Corrective Action Plan (I -CAP) for remediation of compounds of concern (COCs) in groundwater above standards by processes of natural attenuation pursuant to 15A NCAC 2L .0106(1). The COCs addressed by the 1-CAP are chlorides, iron, pH, and TDS. The objective of the 1-CAP is to reduce COC concentrations which exceed target cleanup concentrations at or outside of the compliance boundary established in the SDR permit by natural attenuation. For total iron, the target cleanup concentrations are background levels established under a now -expired Special Order by Consent (SOC) agreement. Annual natural attenuation groundwater monitoring reports are submitted to the NC Department of Environmental Quality (DEQ) Division of Water Resources (DWR) to satisfy the 1-CAP monitoring reporting requirements. The results of the July 2024 monitoring indicate the presence of COCs covered by the 1-CAP above 2L Standards or background. Immediate notification of elevated iron, chloride, and TDS concentrations and pH levels outside the 2L Standard range was not made to DWR after receipt of the analytical results because these conditions are already known to DWR and are addressed under the 1-CAP. Immediate notification of elevated chromium in well MW-24/CPW-4D was not made after receipt of the analytical results because this condition is attributable to the Plant Process Area (PPA) of the site and is already known to DEQ. Chromium impacts associated with the PPA are being managed under an Administrative Agreement (AA) for Voluntary Assessment and Remedial Action under the Inactive Hazardous Sites Branch (IHSB) Registered Environmental Consultant (REC) Program, DEQ ID NCD057454670. Because chromium and nickel are not COCs in the 1- CAP, if chromium and/or nickel concentrations are detected above the 2L Standards in the compliance wells (other than chromium in well MW-24/CPW-4D), notification is made to DEQ in accordance with the SDR permit.
