Reference: USAGE Action ID 199606041 DWQ Project No. 20070047, WQC No. 3608 CAMA Major Permit #20-07 The North Carolina Department of Transportation (NCDOT) is hereby requesting modifications to the 404 Individual Permit, 401 Water Quality Certification and CAMA Major Development Permit for the construction of the Second Bridge to Oak Island in Brunswick County, TIP R-2245. NCDOT is requesting authorization to change the alignment of the proposed bulkhead located at Sta. 56+40.47, adjacent to Bent 2 of the bridge over the AIWW (Site 5). The NCDOT has concerns with potential maintenance issues and scouring between the footer and bulkhead in the southeast corner as currently proposed. To alleviate these concerns, the NCDOT is proposing to realign the bulkhead. to encompass the bent as shown in the attached detail drawing. The proposed alignment will include a 60° angle at the proposed turn on the SW corner of the bent and a 30° angle at the NW corner, which will reduce debris jams, and vortexes that could cause scouring and other maintenance issues. The short 90° angles on the east side of the new alignment do not present any scouring concerns. To minimize new impacts the bulkhead will abut the outer edge of the footer, with the exception of the west wall that will be at a 60° skew and a small section on the west wall. The area inside the bulkhead under and around the footer will be back filled with earthen material after construction of the footer has been completed. The new alignment will permanently impact an additional 445 sq. ft (0.010 ac) of tidal mud flat (surface water). No jurisdictional wetlands will be impacted by this new alignment. REGULATORY APPROVALS Section 404: NCDOT is hereby requesting a modification to the USAGE Individual Permit, Action ID # 199606041, to allow for the realignment of the proposed bulkhead at Station 56+40.47 as described above and depicted on the attached drawings. The new alignment is being requested by NCDOT to reduce maintenance concerns, enhance safety and improve constructability of the structure. Section 401: NCDOT is hereby requesting a modification to the 401 Water Quality Certification. In accordance with 15A NCAC 2H, Section .0500(a) we are providing five copies of this application to NC Division of Water Quality for their review and approval. The processing fee of $100 will be debited for processing of the LAMA Permit Minor Modification. CAMA: NCDOT is hereby requesting a Minor Modification to the LAMA Major Development Permit. We have provided a method of debiting $100 to the NC Division of Coastal Management for .the processing of the CAMA Permit Minor Modification, as noted in the subject line of this application, as payment for the processing the permit modification.
