NC 27607-W72 www fthterry.com Butterball received the Notice of Deficiency dated March 27, 2024 for exceedances of the 2L nitrate standards in monitoring wells MW-22 and MW-38 through MW-41. On behalf of Butterball, Dewberry is submitting this response within the required 90 day period. Enclosed are the following requested items: Annual Representative Soil Analysis A copy of the most recent soil analysis for each irrigation site for the parameters required by Section IV.12 of the permit. Flow and Mass Balance Information The annual average flow, and the annual average mass loading for plant available nitrogen (PAN), biochemical oxygen demand (BOD), phosphorous, sodium and total dissolved solids are provided for each field for 2019 — 2023. For each parameter and field, the annual loading data is provided as total pounds per year (Ibs/year) and pounds per acre per year (Ibs/ac/year). Representatives from Butterball, NCDEQ, and Dewberry participated in a conference call on Friday, June 14, 2024 to discuss the measures Butterball is taking and plans to take to continue to address the monitoring well nitrate exceedance. A summary of these measures is provided. Long Term Wastewater Treatment System Enhancements Butterball is currently evaluating options to upgrade the treatment system. In the next two years, the site is preparing to have new operations which will contribute additional flow and loading. Butterball is currently developing treatment alternative options to manage the additional flow and loading and has set a basis of design for the new treatment system that would reduce the PAN concentration in the effluent to the sprayfields by up to 60%. The technology selection, design, and construction are expected to take at least 2 years to complete. Butterball will submit the requisite Authorization to Construct and permit modification application. Interim Studies and Operational Modifications In 2023 Butterball contracted with a licensed soil scientist to evaluate the current condition of the land application fields. The study included 450 acres and the only fields not included were the five fields constructed in 2018. Based on the results of the study, Butterball will make the following adjustments to field operation: • Butterball will continue to rotate fields through a rehabilitation program where fields lie fallow and have gypsum addition with no irrigation for a period of months. The study Page 1 of 2 DocuSign Envelope ID: 597D1 DFO-72904C413-A2A4-MA2EM700D confirmed the gypsum application rates are appropriate and the rehabilitation period of 5- 7 years for each field is appropriate. Butterball currently adds lime and potassium to each field each year based on field data collected by a third party. The study results indicate the lime and potassium application rates could be increased to provide additional improvements to the fields. The study also recommended using Dolomitic lime to provide additional magnesium as well as calcium. Butterball will reduce spray irrigation in the fields closest to the wells with historical nitrate exceedance. Fields that will have irrigation reduced include 01A, 01C, 05, 07, and 15. Irrigation will be reduced by 30-40% in these fields. Irrigation rates will be increased in other fields but still within the permitted hydraulic loading rates. Fields for additional flow will be selected based on hydraulic permitted flow capacity, proximity to wells with data that is below the nitrate standard, and the observations of operators that additional discharge won't cause adverse effects. Butterball anticipates redirecting approximately 775 Ibs/acre/year away from the fields closest to the monitoring wells with exceedance. Butterball will continue to communicate with NCDEQ at appropriate project milestones about the operational expansions and the new wastewater treatment system.
