Accordingly, the Division is forwarding the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended) . The permit allows the discharge of wastewater from the Champion Hills WWTP during the period of November 1 through March 31. During the period of April 1 through October 31 the facility shall continue to operate the non -discharge spray system under permit WQ004115. Please note two minor changes from the draft permit; the limit for Total Residual Chlorine has been changed from a monthly average to a daily maximum and the expiration date was changed to November 30, 2005. The Total Residual Chlorine limit is implemented as a daily maximum. The new expiration date corresponds to the sub -basin in which the discharge is located. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699- 6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. The Division may require modification or revocation and reissuance of the permit. The facility is covered by non - discharge permit WQ0004115. They have experienced problems during cold weather months when they can't spray on the golf course due to the freezing of the piping system and long periods of saturated conditions of the soil. For this reason they have requested a discharge permit for the winter season only. • The treatment system consists of a package plant with influent bar screen, flow equalization, two aeration tanks, clarifier, aerated sludge holding tank, chlorination, and a 70,000 gallon holding pond. There is a 2.4 million gallon irrigation pond which is not part of the treatment system. Irrigation can be from either the holding pond or the irrigation pond. They pull water from the creek into the irrigation pond when the wastewater holding pond is low. • The permitted flow in the non -discharge permit is 0.14 MGD. This flow is for the ultimate capacity of the system when development is finished. The present capacity of the treatment system is 0.07 MGD. The effluent from the treatment plant will not be allowed to be mixed with the water in the irrigation pond prior to discharge. F act Shect NPDF.S Permit NCOOS7 FUG Face F PERMIT DEVELOPMENT The proposed permit limitations and monitoring requirements were developed based on Division policy for non-POTW and waters classified as C-Tr. A Level B Model was developed. The actual permit limits for spray irrigation are more stringent that the proposed limits for surface discharge. The facility consistently meets the spray irrigation permit limits, therefore it is expected that they will have no problem in meeting their discharge limits. The discharge will be limited to the winter months (November 1 to April 30). Level B Model The results of the Level B model predicted that the stream will be protected with the secondary limits for BOD. To protect for ammonia toxicity the stream standard will be implemented. The results for the model are attached. COMPLIANCE REVIEW Notices of Violation (NOVs) No NOVs has been issued for the facility for the period of 1999 to 2000. DMR Data Review DMRs were reviewed for the years 1999 and 2000. The average effluent flow for the months of November to March was 0.0377 MGD. BOD averaged 3.3 mg/l, TSS averaged 3.08 mg/l, Ammonia averaged 0.33 mg/l and Fecal Coliform averaged <1 #/100ml. All parameters were within permit limits for the time period reviewed. CORRESPONDENCE Regional Office An inspection was performed by regional office staff on January 2001. They facility was found in compliance with their permit requirements and well operated and maintained. The regional office recommends the issuance of the permit. If not already provided, a complete alternative analysis should be submitted documenting the current system or the current system with minor changes could be operated as a non -discharge facility. • The following limits are currently used in the non -discharge permit: BOD 10 mg/l, NH3 4 mg/l, TSS 5 mg/l, Fecal 14/100 ml. The NPDES Unit should consider using these (in part or whole) limits as BAT since the facility can meet these limits. • This type of operation (discharge in winter, non -discharge in summer) will be requested on a more frequent basis in the future - particularly with a couple of permits issued. The NDPU has received several inquiries from consultants on these types of permits and whether any have been issued. It is suggested the two units open a dialogue on a framework / policy to allow these types of permits in the future. We find all conditions and requirements of the permit acceptable as written, but would like to submit a minor modification or clarification for your consideration. During our telephone conversation, you indicated that it would be best if we discharged the effluent after the point where the two streams come together, approximately 200 yards downstream from our plant. The reason being that there would be greater flow where the effluent mixes with stream water. We can do this and will do it, if required. However, it does create some problems for us as follows: 1. It requires a relatively long discharge line with twists and turns. 2. It must pass under or through a Tee Box and our concrete cart path. 3. It would empty at a highly visible point on our golf course in front of the 15"' green. 4. It makes a noise when flow is occurring, which would disturb golfers on the green. We would much prefer to discharge into the stream that flows by our plant at a point 75 to 100 yards upstream from where the two streams meet. This is the larger of the two streams, and would require a shorter, relatively straight run of pipe. It would flow to a point of low visibility and would be much less costly. You will recall that Champion Hills currently spray irrigates treated domestic wastewater onto their golf course. As a result of difficulties encountered operating the irrigation system during the winter months, the property owners association (POA) has submitted an application for an NPDES seeking authorization to discharge treated wastewater to the State's surface waters during the winter months. The Asheville Regional Office no longer has original construction plans. Lee Weber, Chairman, Wastewater Systems Committee for the Champion Hills POA, met me on August 16 and provided a set of original construction drawings. The original drawings show a dual unit tertiary treatment plant followed by a five day holding pond followed by a much larger irrigation pond, all in series (see my attached pencil sketch). The five day holding pond could not be used as side stream storage for off quality effluent. The treated wastewater was mixed with water from the South Fork of Willow Creek prior to being irrigated onto the golf course. Accordingly Champion Hills modified the piping between the two ponds so that the irrigation pumps could pull out of either pond (again see my attached pencil sketch). Today the standard practice is to irrigate treated wastewater until the five day holding pond is substantially drawn down and then start pumping from the irrigation pond which contains no effluent but is filled exclusively from the South Fork of Willow Creek. Piping arrangement do not now nor have they ever, so far as I can determine, allowed storage of off quality effluent for subsequent return to the head of the treatment plant. The irrigation pond is in the middle of a fairway which would make Champion Hills very reluctant to drain it down completely at the beginning of winter for purposes of long term storage of treated wastewater. The present treatment plant has a design hydraulic capacity of 70,000 g.p.d. which is half of the flow allowed by Permit Number WQ0004115. The plant is receiving a flow of approximately 25,000 to 30,000 g.p.d. during the summer months. Attached is a copy of a portion of the United States Geological Survey Quadrangle for Horse Shoe, N.C. marked to show the location of the treatment system and there ore the proposed point of treated wastewater discharge into the South Fork of Willow Creek. Champion Hills would propose to discharge to the South Fork of Willow Creek in the area of the present irrigation pond. It is my recommendation that we find a way to issue Champion Hills a permit to allow the discharge of treated wastewater during the winter months. Protecting the irrigation system from freeze damage during this time of year is a headache all out of proportion to any environmental benefit resulting from continued land application of wastewater during the time of year that streams have their maximum assimilative capacity. We take great pride in the natural beauty of our surroundings and work hard to maintain it. One of the attractions to the community is that we offer a first class wastewater system, where many similar mountain communities with difficult terrain employ septic systems. The success of our community, however, centers on the condition of the Fazio designed golf course. It is a beautiful layout, but has the usual mountain course problem of growing adequate grass on fairways, roughs and greens. Part of the problem stems from periods of prolonged soil saturation during winter months. As you know, our permit requires us to spray effluent onto the golf course. For the most part, we are pleased with this requirement, as it is consistent with our environmental beliefs. However, during cold weather it creates some serious problems for which we seek your help. Our permit stipulates that irrigation should not be performed when the ground is in a condition that will cause run-off. It is not always possible to fully comply with this requirement here in the mountains where extended freezing conditions are common. This is especially true when the effluent holding pond is full and one or more the following conditions exist: • The ground is already saturated • The ground is frozen • The sprinkler heads are frozen • The ground is covered with ice or snow During such times, attempts to spray are not only questionable under the permit, but also detrimental to the turf -grass we work so hard to grow.
