Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes no significant changes from the draft permit sent to you on September 15, 2010. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. I hope y'all are doing well. I just wanted to stay in touch with you regarding the status of the permit renewal. We did receive the sludge management plan for the facility; thank you for sending that to us. In the letter that accompanied the plan it was stated that a change of ownership form had been sent to the previous permit holder for his signature and transmittal of the form to the Division of Water Quality. As of today, we have not received a copy of the fully executed form. While the fully completed form would be desirable, if the previous permit holder does not wish to cooperate in this matter, please send me a copy of the form as complete as it is, along with any documentation you may have noting ownership of the WWTP has been transferred to the property owners' association, and your statement that the association chooses to assume responsibility for the permit. The permit is ready to be renewed. We'd like to renew it in the POA's name, but this formality is holding us up for now. Any help you can provide will be appreciated. I work in a permitting unit within the Division of Water Quality and will be handling the renewal of the permit for the Ledgestone Subdivision WWTP (NC0087556). I wanted to pass along a few pieces of information and ask some questions at the same time. We have received your application for renewal. You should be receiving an acknowledgment letter regarding this in the next few days. The letter will also note that we did not receive a sludge management plan along with the application. This deficiency will not hold up the preparing of a draft version of the permit for you to review, but until it is submitted we will not be able to send you a final version of a renewed permit. The plan does not have to have great detail, it just needs to state how sludge solids are ultimately handled (who pumps the WWTP out and where the sludge is taken, etc.). I noted on the Secretary of State's web site that the current entity listed as permittee (HRS Land Development LLC) has been dissolved. You noted on the renewal application that the permittee should be listed as the Ledgestone Home Owners Association. Does this entity have any particular corporate status? I saw the SoS has a new corporation on file with the name "Ledgestone Property Owners' Association," but it is unclear if this is the same entity. In any event, we do need to square away who the permittee actually is and who the appropriate contact is.
