Accordingly, the Division is forwarding the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please note the following changes from the draft permit: ❖ The sampling type for the Acute Toxicity test shall be composite instead of grab. 4 Limits for fecal coliform and total residual chlorine have been included in the final permit. Division guidelines require total residual chlorine and fecal coliform limits for new discharges. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or any other federal or local governmental permit. Acute Toxicity Pass/Fail Limit (Fathead minnow); March, June, September, December; refer to Special Condition A(2). There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit No. NCO087084 SECTION A(2).ACUTE TOXICITY PASS/FAIL PERMIT LDGT (QRTRLY) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (PiTnephales promeias) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of March, June, September and December. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR 1) for the month in which it was performed, using the parameter code TGE6C. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (Al) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. The industrial park is actually under construction. The design of the industrial park contains 48 individual lots on 1,152 acres. The developer projects that the industrial park will eventually employ 5,000 workers. The original permit application requested a total flow of 0.450 MGD. A modification was latter submitted to reduce the flow to 0.10 MGD. This flow will cover the industrial park only. Engineering Alternative Analysis (EAA) An EAA was submitted with the permit application. The project is divided in two phases, the first one providing waste treatment facilities for 100,000 GPD and the second one, ten years later providing facilities to bring the total wastewater flow to 450,000 GPD. ' The proposed flow of 450,000 gpd was estimated based on 5,000 employees at 25 gpd/employee, 15,000 gpd from Chase High School, 200 homes at 360 gpd/home and 238,000 gpd from general industrial process flow. The first phase will provide a treatment system for the initial facilities that locate at the industrial park. It is not known how many industries will comprise this first phase and what amount and kind of flows they will have. The developer has a commitment from one industry that intends to relocate to the industrial park in the near future. The flow from this facility will be domestic only. It is uncertain if the industrial park will develop to full capacity. In view of these issues, the Town agreed to modify the request to get a permit for 0.10 MGD. The permit will be issued for 0.10 MGD. Fact Sheet Renewal -- NPDES Permit NCO087084 Page 1 Future expansions may be considered after the facility submits a speculative limit request and an Engineering Alternatives Analysis. The following alternatives were considered by the Town: • Connection to the Town of Forest City WWTP — This alternative consists of a force main and several pump stations. The Town's WWTP is more than 8 miles from the industrial park and the plant will have to be upgraded. • Connection to the Town of Chesnee, SC — This alternative consists of a force main and several pump stations. This town is about 4 miles form the industrial park and the WWTP will have to be upgraded. • Discharge to Broad River — This alternative consists of a WWTP at the industrial park. • Drip irrigation I Spray irrigation — This alternative consists of a WWTP at the industrial park and additional acquisition of land for irrigation. • Reuse — Since there are no tenants yet at the industrial park there are no options open for reuse. The feasible economical alternative is the discharge to the Broad River with a present worth cost of $2,288,500, followed by the connection to Chesnee with a cost of $3,019,720. Basinwide Plan The basinwide plan rates this section of the Broad River as good based on benthic microinvertebrate information. Proposed Permit Limits A level B model was run for the proposed discharge to the Broad River. The results of the model are attached. The proposed limits and monitoring frequencies are based on a Class II domestic facility and the results of the Level B model. Secondary limits will protect for summer and winter conditions. Since there are no industries located at the industrial park yet, no limits can be established for pollutants that could be present in industrial effluents, for this reason toxicity monitoring is proposed. The permit will include the boilerplate language for Pretreatment. Our comments are provided in accordance with provisions of the North Carolina Environmental Policy Act (G.S. 113A-1 et seq., as amended; 1 NCAC 25) and the National Environmental Policy Act (42 U.S.C. 4332(2)(c)). The proposed project involves the extension of 7,500 linear feet of water line and the construction of a wastewater treatment plant and outfall line. The infrastructure will serve an unspecified manufacturing site to locate on the 1,100-acre industrial park. This first manufacturing site consists of 14 acres. The document states that the greatest impact to the environment will result in the discharge of effluent from the WWTP to the Broad River. We do not disagree with this assessment; however, we do not believe it is the only adverse impact associated with this project. Our greatest concern from projects such as this are the secondary and cumulative impacts of development. Stormwater runoff from the many hundreds of acres of impervious surface that could eventually be facilitated by this publicly funded infrastructure is of concern. There is no discussion in the document of if or how stromwater will be managed to minimize adverse impacts to area streams. We recommend that stormwater management be required for roads and each industrial site to treat stormwater from impervious surfaces to maintain quality and quantity to the preconstruction conditions. We are also concerned about the discharge of effluent to the Broad River. This project will facilitate the development of a 1,100-acre site: however, there was -no habitat characterization of the overall industrial site that we understand will be served by this infrastructure. This request is being submitted in order to expedite the issuance of the NPDES permit and construction on the new wastewater treatment facility. The Town of Forest City reserves the right to request a modification to their permit to increase the discharge to the river as the industrial park continues to develop. The new wastewater treatment plant is currently planned to treat the domestic wastewater that is generated at the industrial park. The developer of the property does not have any commitments from "wet" industries that will contribute industrial process flow to the plant at this time. Therefore, the wastewater that is treated at the new facility is anticipated to have characteristics similar to typical domestic wastewater. The following sections describe our understanding of your questions and comments, and provide responses to each comment. 1. You inquired about the total anticipated flow 450,000 gallons per day (GPD) that is being requested in the NPDES permit application, and was calculated on Page 3 of the Alternatives Analysis. Specifically, you asked us to clarify the source of the 5,000 employees that are used in the calculation and the 238,000 GPD of industrial process flow that was included in the flow projections. The developer of the property currently has a preliminary design completed to construct facilities on approximately forty-eight (48) lots on the 1,152 acre site. Several buildings within the industrial park area are already under construction. The developer ultimately projects that 5,000 people will be employed at the park. Therefore, the developer's projections were used in the Alternatives Analysis to calculate the total flow to the new wastewater treatment facility. The 238,000 GPD of industrial process flow is an estimated amount. The number was determined based on an estimated average process flow from each facility of 5,000 GPD (48 facilities X 5,000 GPD = 240,000 GPD). The estimated process flow was reduced to 238,000 GPD in order to make the total anticipated flow to the wastewater treatment plant a round number (450,000 GPD). The developer currently does not have any commitments from "wet" industries to locate to the industrial park. Therefore, it is unknown at this time how many industries that use a significant amount of water for their process will locate to the park. 2. You commented that you have been informed that the Town's existing wastewater treatment plant is currently treating an average daily flow that is in excess of 80% of the E n g i n e e r i n g 0 P l a n n i n g • F i n a n c e McGill Associates, P.A. • P.O. Therefore, the Town is required to be in the planning stages of an expansion to the facility. You specifically inquired as to how this affects our cost estimate for Phase 2 of Alternative 2-A, which includes a $1,005,000 upgrade to the existing Forest City wastewater plant. The wastewater treatment plant is currently operating at greater than 80% capacity, and the Town is currently in the planning stages of an expansion to the facility. The Town does not have immediate plans to expand the plant. It is our opinion that this information further substantiates the need to upgrade the facility if the flow from the Riverstone Industrial Park is pumped to the Town's treatment plant. Therefore, this information does not affect the cost estimate that was included in the Alternatives Analysis. 3. You commented that you have been informed that the Town's existing wastewater treatment plant does not have the capacity to treat and dewater the biosolids generated at a new plant on the Broad River. The Alternatives Analysis assumes that the biosolids would be hauled from the new plant to the existing Forest City plant for treatment, dewatering, and disposal. Upon further discussion with the Town, it appears that you have been misinformed on this issue. The Town's existing wastewater treatment plant does have additional capacity in the sludge digesters, thickener, and dryer to accept the biosolids from the new plant. The sludge dryer is currently in operation approximately 20% of the time, and production can be increased as necessary to dewater the additional sludge from the new plant. 4. You faxed me a memo from Mr. Owen Anderson, Mountain Region Coordinator of the North Carolina Wildlife Resources Commission that included concerns about the discharge of effluent to the Broad River, particularly the impact of residual chlorine on the river. Mr. Anderson recommended that ultraviolet light be used for disinfection and that the new treatment plant be equipped with an emergency power supply to prevent discharge of untreated wastewater during power outages. The Alternatives Analysis includes costs for a standby generator at the new plant to provide emergency power in the course of a power outage and to prevent the discharge of untreated wastewater during these power outages. It is currently planned to provide disinfection at the new plant using chlorine gas. In addition, it is also planned to dechlorinate the plant effluent using sulfur dioxide prior to discharging into the Broad River to reduce the chlorine residual. We anticipate that chlorine residual limits will be included in the NPDES permit that is issued by NCDENR. If the limits are similar to those that have been issued in the past, the maximum effluent chlorine limit will be extremely low to protect fish and wildlife in the river. Ultraviolet light disinfection facilities have a poor track record at municipal wastewater treatment plants in the region, and several ultraviolet light facilities have been replaced with chlorination/dechlorination facilities. Based on this information, we request that u Ms. Teresa Rodriguez June 26, 2001 Page 3 of 3 chlorination be approved as the method of disinfection at the new plant, with dechlorination provided through the use of sulfur dioxide to reduce the chlorine level prior to discharge. 5. You requested the permit numbers for the existing Town of Forest City lift stations that would need to be upgraded if the option of pumping to the Town's wastewater treatment plant (Alternative 2-A) is implemented. Per my telephone conversation with Mr. Roger Edwards of the NCDWQ Regional Office, Mr. Edwards provided you with the necessary permit numbers on June 25, 2001. Therefore, we are not providing additional information on the lift stations at this time. 6. You asked for a clarification of the items that will be necessary to upgrade the existing four (4) Town of Forest City lift stations if the alternative of pumping the flow to the Town of Forest City (Alternative 2-A) is implemented. The cost estimates included in the Alternatives Analysis include a lump sump estimate for each pump station upgrade. It is assumed for Phase 1 of the project that all four (4) lift stations would need to be completely replaced, due to the large increase in capacity of the lift stations. Therefore, the lump sum costs included on Page 9 of the Alternatives Analysis for each pump station in Phase 1 include all excavation and sitework, a new concrete wetwell and valve vault, two (2) pumps, and all related piping, valves, and electrical work to complete the construction of a new duplex lift station. We have also assumed that the new wetwells that would be constructed during Phase 1 would be sized so that the wetwell could also be utilized during Phase 2. Therefore, the lump sum costs included on Page 11 of the Alternatives Analysis for Phase 2 include an upgrade without needing to replace the entire lift station. The estimated cost includes replacement of the pumps, upgrading the necessary piping and valves, electrical upgrades, and all miscellaneous appurtenances necessary to complete the upgrade.
