Buchanan St. Columbia, SC 29206 c/o Bruce Marek— Sent via email to mare4dPec.rr.com Dear Mr. Reynor, This is with reference to the request received by DCM on August 5, 2024 to refine State Permit No. 8-18, which was issued to Middle Island POA, Inc. on January 12, 2018, including a 9 slip residential docking facility at the end of Cape Creek Road, adjacent to the Cape Creek on Bald Head Island, Brunswick County. State Permit No. 8-18 was modified on February 27, 2023, for two land bridge replacements with wetland impacts. State Permit No. 8-18 is due to expire on February 27, 2028. The action proposed in your request consists of elevating the permitted vinyl sheet piles adjacent to the existing boat ramp, pouring the new concrete boat ramp in place and replacing 6 fixed dock piles. The authorized sloped sheet pile groin associated with the boat ramp would be elevated and horizontal across the top of the structure. According to the proposal, the concrete for the boat ramp would be poured in place within a containment structure and would not come in contact with surface waters. In addition, six existing pilings associated with the existing dock would be replaced. Attached with this request is DWG C1 showing the proposed changes (dated as received by DCM 8/5/24). Upon reviewing the information provided, the Division of Coastal Management, in coordination with the Division of water Resources, has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit No. 8-18 as described in your request dated received on August 5, 2024. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. Hi Tara, Attached is a Letter of Refinement request for the Middle Island POA Boat Ramp Replacement Project. As we have spoken on several occasions and per your March 2024 Site Visit, my request is to construct the boat ramp with a horizontal top vinyl sheet pile sides, with a ptsyp wood cap, rather than the 1-24-19 Jeff Troutman sloped with ramp sheet pile top. This is more in line with theexisting VBHI boat ramp construction. And now with the two aged timber bridges to the marina replaced with land bridges, which will allow heavier trucks and construction equipment, I am showin as an alternate method to the concrete plank ramp as 6" thick poured concrete. As per building the land bridges, it worked well for some temporary 6x6 ptsyp piles to the outside of the outer whalers, to keep the sheet pile in line until the cross structure 1" diameter hdgtie rods and backfill are in place. I am showing my ramp with a 2.5:12 slope, which is what I measured as existing. Troutman had ramp slope at 16 degrees = 1.92:12. This allows me to show a shorter length than permitted ramp as 42' length rather than at 55'-3 1/z". Last year's preliminary estimates were $6000to $10,000 per foot of ramp length, so shortening up the ramp has considerable savings. I may fine tune the ramp slope and the ramp[ length once we get quotes in hand, but I would not go outside the permitted ramp footprint. My drawing C1 is meant to be in conjunction with the Jeff Troutman 1-24-19 Major Permit Drawings, rather than being a full replacement. All builders have slightly different ideas on ideal ramp construction based on any site constraints, and I prefer to work within their methods to keep costs down. We also askthatwe can replace in kind the existing 6 fixed dock piles, or to sister new piles to the outside of the existing, while we have the machinery on site. Barring any major hurricanes, we would like to start this fall after the permit moratorium is over and we are clear of Labor Day and early September boating periods. The Middle Island Homeowners Association, Inc., (MIHOA) has retained me as authorized agent to apply for a Letter of Refinement to LAMA Major Permit 8-18 for the existing permitted replacement Boat Ramp. The current permit expiration date is February 27, 2028. The permit approval was based on drawings S0.0 Cover Page — Maps & Notes; SI.0 Demolition Plan; Sl.l New Work; & S2.0 Ramp Sections. all seal date 1-24-19 by Jeff Troutman of Criser, Troutman & Tanner. The 9 slip Cape Creek Marina floating dock replacement has been complete for several years. A Major Mod was issued 2-27-23 for replacement of the 40+/- year old two timber bridges to the marina with Vinyl Sheet Pile Land Bridges. The land bridges project likewise has been completed, which allows for truck/heavy machinery access to the boat ramp for demolition and the construction of the replacement boat ramp. This letter of refinement request is for changes to the approved boat ramp Sections & Details on Troutman sheet S2.0 with my sheet Cl seal date 8-2-24. Today's request maintains the 15'-2" permitted ramp width outside to outside of vinyl sheet pile and the will be at or shorter than the permitted 55'-3 ''/z" horizontal length of the ramp incline, i.e. "within the permitted footprint". The proposed changes include maintaining the top of vinyl sheet pile as a horizontal at appx +6 ML W (Troutman calls top of fixed dock deck as +7 ML W). This is a similar detail to the VBHI Bald Head Creek Boat Ramp. The horizontal top will be capped by a ptsyp "flat", ideally 3x14 or 4x14 CCA 2.5 treated lumber (long lead time/expensive), or with 2x8 sloppy vee or 2x6 ptsyp deck boards. As a clarification, as we did with the land bridges, we intend to set temporary 6x6 ptsyp piles outside of the whaler that is outside of the vinyl sheet pile, to keep straight alignment of the sheet pile. With the highway rated land bridges in place, we are able to bring in a concrete truck to "pour" a 6" thick concrete ramp slab as a builder option. (Troutman's concrete panel method is still a valid bid detail). Note that my poured concrete ramp detail calls for several timber piles within the ramp footprint as slab support/tiedown. The LOR drawing actually provides a watertight containment structure, asthe sides will be above high tide, and I can keep the water end, what Troutman called a cut-off wall equally high so that we are not affected by the tide. I have no problem keeping the top of the vinyl sheet pile at the top of the dock during construction, which is at least 6 fmsl. There is a benchmark that we used to construct the land bridges to road elevation +6 fmsl that I can transfer over to the dock. Or I can go higher, but 6 fmsl is 13" higher than the Bald Head Island Marina cap, and we haven't flooded over that in along time at a king tide /storm event. I'll reach out to Michael. We will need to send something to DWR to review to ensure that live concrete would not contact State waters if you are requesting to change the methodology. If water does touch live concrete, it should not be discharged to surface waters, it should be pumped to uplands. If you have any additional questions, please let me know.
