DWR does not return fees for applications that are not needed after further review as staff time was still taken to

We apologize for not getting back to you sooner. We have been coordinating with Cube Hydro to confirm that the
DWR#20240317 application will satisfy their requirements for their Activity Permit. As discussed in our meeting on Friday,
August 2nd, we would like to move forward with combining the two permits submitted to NCDEQ DWR into the one
DWR#20240317 application, which was the initial permit sent in that covers all impacts from the project. The second
permit sent in for shoreline stabilization (DWR#20240763) can be withdrawn after its contents are copied to the all -
encompassing permit.
Additionally, will SRU's most recent check for the Cube Hydro Shoreline Stabilization permit be returned now that the
permits are being combined?

We would still like to have the meeting on Friday. One of the applications is the 401 permit application and the second
application is a separate Shoreline Stabilization permit that we were requested to submit on behalf of Cube Hydro/Eagle
Creek. I think these 2 applications are creating the confusion and we would like to explain their purposes and come to an
agreement on the best option to move both of them forward or combine them together.

It just came to my attention that two applications were submitted to DWR for the same project. DWR#20240317
which was submitted in February but fee to complete the application wasn't submitted until April 30. This
application appears to be for all impacts from the project and is currently under review. We also received
DWR#20240763 which was submitted as a shoreline stabilization project only, using an incorrect DWR application
form.
Now that I've made this connection, it appears that DWR can withdraw the second application as an error and all
parties can continue the review of the original submittal. Would Salisbury or Black & Veatch please confirm this.
Does this address any questions such that we no longer need a meeting.

Regarding the Shoreline Stabilization permit as mentioned in the email below, we would like to hold a meeting to discuss
the previously submitted 404 and 401 permits for Salisbury -Rowan Utilities Yadkin River Raw Water Supply Facilities
project. The goal of this meeting will be to ensure that the correct application forms are being submitted, and to avoid

Hello Jason,
As discussed yesterday by phone, the application for the above noted project was submitted on an incorrect
application form. The Shoreline Stabilization Form that you used is only valid for shoreline stabilization along
specific lakes in NC. As a result, the correct process was not initiated and the Division is unable to conduct a
complete review. Please complete the attached correct application form (PCN) and submit it using our online
submittal process. You should select "More Info Response" in the online form and enter the existing project
number 20240763, version 1. This will link the correct application to our existing record and you will not be
required to submit a new application fee.
In addition, we discussed that the review agencies will need to see the plans/proposal for the entire scope of the
work for the intake, including all permanent and temporary impacts within the Yadkin River as well as the
streambank stabilization. Please submit that information at the same time, the online form will allow you to
attach as many documents as necessary.

You will also need to submit this application to the US Army Corps of Engineers. Typically applications submitted
to DWR are forwarded to them for review, however this project did not go through that process as a result of the
incorrect form. I've copied Jennifer Lawrence with the USACE who covers Rowan County so that she can inform
you how to submit it to the USACE once you have the correct form filled out and plan sheets compiled.
Please note that the application you submitted is considered incomplete by DWR and "on -hold" until the above
information is submitted. Please submit the information within 30 days or contact me to discuss the schedule.
