We have a small break in the Training Schedule due to the holiday season in order to get this work to be done. We have contractors on site, ready to begin immediately. I would like permission to begin the work this week. This will allow us to start on the work previously submitted and approved by the 401 Section. We will re-apply for a modification, with a new application and include the appropriate fee for the additional work. Please note the following: Fees and Payment Details: The 1998 North Carolina General Assembly adopted fees for the 401 Water Quality Certification Program effective January 1, 1999 (see attached) (Section 143-215.3D(e)]. Major Water Quality Certification (defined as those with greater than or equal to one acre of wetland or water fill or equal to 150 feet of stream impact) These will have a fee of $475.00 1 of 5 12/19/2007 9:51 AM RE: Request for 401 Certification, DWQ #051058; USACE Action L.. Minor Water Quality Certifications (defined as less than one acre of wetland or less than 150 feet of stream impact) These will have a fee of $200.00 * Any applications received by DWQ after January 1, 1999 must be accompanied by a check for the required amount. * If payment is not included with a request for a Nationwide Permit, the application will be returned to the applicant as incomplete. * If the correct payment is not included with an Individual 404/401 or a LAMA Permit Application, a project file will be created, but the applicant will receive a letter informing them that the project will not be processed until the full payment is provided. * Checks should be made out to "N.C. Division of Water Quality" Additional Provisions: Changes to an existing 401 Water Quality Certification require a full new Certification by DWQ. Additionally, any 401 Certification that is requested to be renewed, as a result of the work not being completed prior to the expiration date, also results in a full issuance of a new Certification. However, I feel our request to fill an additional 2,600 square feet (100 square feet per target/26 targets) is quite modest and will not result in any measurable, adverse effect to the already active live-fire range area. The project area is within the existing cleared footprint of a maintained live-fire range (photo attached). The additional fill we request is scattered out across 26 individual target sites. The Certification states that if revision to the plan results in a change in impact, a new application for 401 certification "may" be required. This means a new application and a new fee, however, they may provide a strong narrative of what was previously approved, what is proposed and plans on full plan sheets clearly depicting the proposed changes. - Ian McMillan Ian J. However, we request that a copy of any amendments that may be issued be submitted to us for tracking purposes.
