Loiacono,Vice President 1121 Military Cutoff Road, Suite C-322 Wilmington,NC 28405 Subject: Permit Modification and Second Notice of Non-Compliant Inspection State Stormwater Management Permit No. SW8 130412 Hawkeswater at the River High Density Subdivision Project Brunswick County Dear Mr. Loiacono: The Wilmington Regional Office received a complete,modified State Stormwater Management Permit Application for the subject project on October 6,2017. During the review,DEMLR found that the project's plans did not match the configuration on Google Earth, and so a site inspection was conducted. There are ponds not built per the plan, and there is unpermitted construction. It also appears that unpermitted lots may have been sold without recorded deed restrictions, and the impacted ponds may not have been designed to accommodate full build-out from those lots. Restrictions are recorded in B2745/P0986,but these restrictions may not cover all of the lots in the current configuration. A Notice of Non-Compliant Inspection was mailed on August 24,2017 and a Plan of Action to address the issues found was due on September 25,2017. The Plan of Action has not been received. This letter serves as a Second Notice of Non-Compliant Inspection. The modification issued on October 12,2017 does not address the non-compliance. Please respond to the August 24,2017 letter by November 13,2017 or a Notice of Violation will be issued. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 effective January 1,2017. We are forwarding modified Permit No. SW8 130412 dated October 12,2017, for the construction, operation and maintenance of the stormwater control measures (SCMs),built-upon areas,as well as the stormwater collection system and/or vegetated conveyance system associated with the subject project. This permit shall be effective from the date of issuance until April 30, 2021 and shall be subject to the conditions and limitations as specified therein,and does not supersede any other agency permit that may be required. Please pay special attention to the permit conditions regarding the operation and maintenance of the SCMs,stormwater collection system, and/or vegetated conveyances;the limitation of built-upon area;modification of the project;the procedures for changing ownership of and/or transferring the permit; and the need to renew the permit. Please also pay attention to the permit conditions that requires the recordation of deed restrictions and protective covenants, easements,and the maintenance agreement,which must all be provided along with certification upon completion of the project. Failure to comply with these requirements will result in future compliance problems. The following modifications are included and covered by this permit: . 1. Phase 3/Pond 4 and Phase 3/Pond 6: These two ponds have been redesigned per the 2017 rule using a design storm of 1.5 inches due to drainage area changes. 2. Phase 3A Section C: Deed restrictions have been added to the permit. This covers Lots 3273- 3332. 3. The following plans make up the full permitted set: a. Approved 9/9/08: Cover sheet, SW-1, SW-3, SW-5,P-1,P-2,P-3, and D-1. (SW-4 has been replaced by data approved on 10/12/17.) b. Hawkeswater at the River • NC 133, Belville, Brunswick County FOR THE construction, operation and maintenance of ten (10) wet detention ponds in compliance with the provisions of 15A NCAC 2H .1000, effective September 1, 1995 (for all ponds other than Phase 3/Pond 4 and Phase 3/Pond 6), and 15A NCAC 2H .1000, effective January 1, 2017 (for Phase 3/Pond 4 and Phase 3/Pond 6). These rules are hereafter referred to as the "stormwater rules" and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources (DEMLR) and considered a part of this permit. This permit shall be effective from the date of issuance until April 30, 2021 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Attachment B. Phase I of the subdivision is permitted for 351 lots; each allowed a maximum of 4,500 square feet of built-upon area. Phase 3A Section 2C of the subdivision is permitted for 59 lots (Lots 3273-3332); each allowed a maximum of 4,000 square feet of built-upon area. This project is not in compliance. There are additional lots that do not have deed restrictions established for them in this permit. A Plan of Action to address the non-compliant items listed in the August 24, 2017 Notice of Non-Compliant Inspection is due on November 13, 2017. 3. The runoff from all built-upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control system. Page 3 of 15 State Stormwater Management Systems Permit No. SW8 130412 4. The tract will be limited to a maximum of 2,485,218 square feet of built-upon area. The wet ponds designated and identified in Attachment B and have been designed to treat the runoff from the impervious surfaces as illustrated in said table. 5. The design elements specified in Attachment B have been permitted for this wet detention pond stormwater facility, and must be provided in the system at all times. II. SCHEDULE OF COMPLIANCE. 1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 2. The permittee is responsible for verifying that the proposed built-upon area for the entire lot does not exceed the maximum allowed by this permit. Once the lot transfer is complete, the built-upon area may not be revised without approval from the DEMLR, and responsibility for meeting the built-upon area limit is transferred to the individual property owner. 3. If an Architectural Review Board or Committee is required to review plans for compliance with the BUA limit, the plans reviewed must include all proposed built-upon area. Any approvals given by the Board do not relieve the homeowner of the responsibility to maintain compliance with the permitted BUA limit. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built-upon surface. 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area. e. Further development, subdivision, acquisition, or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. The construction of permeable pavement for impervious credit. 7. The Director may determine that other revisions to the project should require a modification to the permit. Page 4 of 15 State Stormwater Management Systems Permit No. SW8 130412 8. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 9. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 11. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 12. Permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 13. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and re-vegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of structures, orifice, catch basins and piping. g. Access to all components of the system must be available at all times. 14. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEMLR. The records will indicate the date, activity, name of person performing the work and what actions were taken. 15. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 16. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 130412, as issued by the DEMLR under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. c. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, DEMLR. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the DEMLR. Page 5 of 15 State Stormwater Management Systems Permit No. SW8 130412 f. The maximum built-upon area per lot is as follows: i. Phase I: 4,500 square feet ii. Phase 3A Section C: 4,000 square feet (This covers Lots 3273-3332) iii. Remainder: The remainder of the subdivision will be specified with a future stormwater permit modification. This allotted amount includes any built-upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. h. Built-upon area in excess of the permitted amount will require a permit modification. 17 A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 18. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 19. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in these ponds can be found in Attachment B. III. GENERAL CONDITIONS 1. The permittee is responsible for compliance with all of the terms and conditions of this permit until such time as the Director approves the transfer request. Neither the sale of the project nor the transfer of common area to a third party constitutes legal transfer of the stormwater permit. Page 6 of 15 State Stormwater Management Systems Permit No. SW8 130412 2. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6-07; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the DEMLR, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re-issuance or termination does not stay any permit condition. 8. The Permittee grants permission to staff of the DEMLR to access the property for the purposes of inspecting the stormwater facilities during normal business hours. 9. The permittee shall notify the Division in writing of any name, ownership or mailing address changes at least 30 days prior to making such changes. 10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 11. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. 12. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 13. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. . If the use of permeable pavement for BUA credit within the lot is desired, the permittee shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. No design changes were made. The permit was maintained under the 1995 rules(1.0 inch). 5/16/2014 Adjacent permit,SW8 131207 for Phase 4 was issued. (Phase 4 is across River Road directly on the river.) 12/6/2016 Partial Certification(Phase 3 Pond 2 only) 6/15/2017 An application was submitted to change the designs of Phase 3 Pond 4&Phase 3 Pond 6. 8/24/2017 During the review,DEMLR found that the project's plans did not match the configuration on Google Earth,and so a site inspection was conducted. That is a significant change and needs to be reflected on the plans. Additionally,the townhomes shown below are in an area of the permitted plan that is labeled "future" and does not have a development layout. But,from a quick review of the county GIS, many of these units are build and owned by homeowners. This area needs to become permitted. The project must be constructed per the plans and also fully permitted prior to construction. I will ask the inspector to do an inspection. But, since this permit has spanned three versions of regulations, the permit needs to document that the average depth has been designed per the 2017 rule rather than the 2008 rule. This phase is located within the Hawkeswater at the River development off of previously constructed Hawkeswater Blvd. The development is on Highway 133 approximately 0.85 miles south of the intersection of Highway 76 and Highway 133. Phase 3a Section 2C consists of 60 residential lots with associated streets and sidewalks. This section of the project drains to two proposed stormwater wet ponds (Pond#4 and Pond#6),which were previously permitted under SW8 130412 which is to be modified per this submittal. The proposed permit modification is due to a change in drainage area and built upon area for the two proposed ponds. The proposed permanent pool elevations remain the same as previously permitted. Pond #4 was previously permitted as"Pond#4 Phase 3" and Pond#6 was previously permitted as"Pond#6 Phase 3". The project is within a drainage basin which drains to the Cape Fear River. The receiving stream is the Brunswick River (SC). The runoff will be conveyed into the wet detention ponds via a storm drainage system. The runoff will be controlled in the ponds through the use of outlet structures to meet the pre/post requirements of Brunswick County. The impervious area was calculated by taking into the account the roadways,sidewalks and single family lots. PROPOSED IMPROVEMENTS The stormwater will be conveyed to the wet detention ponds via a piped underground storm system. The ponds will discharge to the existing wetland areas onsite. The ponds have been designed to meet the State required minimum 1.5"runoff temporary storage volume at 90%TSS removal. Please find all reference material and stormwater calculations in the following pages of this report. Note that some calculations have also been located on the plans for easy reference during construction. DESIGN METHOD Hydrologic calculations have been performed utilizing HydroCAD version 10.0 software which employs the USDA SCS Method. The Type-III 24-hour storm rainfall depth has been taken from the Brunswick County Storm Water Management Manual. Curve Number(CN)and Time of Concentration(TOC)calculations have been performed in accordance with the USDA TR-55 manual, with a minimum TOC of 5 minutes. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter,which summarizes the findings of the recent inspection. As indicated in the attached inspection report,the following deficiencies must be resolved: 1 Modification Needed: Once the permit has been issued to modify Phase 3 Ponds 4 and 6,please modify the permit again to ensure that its permitted condition matches its intended configuration for the entire subdivision. Per Permit Section II(1),"No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature(such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division."Per Permit Section II(6),"The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including,but not limited to any revision to the approved plans,regardless of size; Project name change;Transfer of ownership; Redesign or addition to the approved amount of built upon area; Further development, subdivision, acquisition, or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee,for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought; or Filling in,altering,or piping of any vegetative conveyance shown on the approved plan." a. Ponds not Built per the Permitted Plan: All ponds must be built per the permitted plan. For instance,Phase 3 Pond 5 was permitted outside of the loop formed by Keekle Lane but it was constructed inside the loop formed by Keekle Lane. Please ensure that the permitted plans match the intended configuration for all ponds in the subdivision. b. Unpermitted Construction: Phase 2(the townhomes behind Belville Elementary School) has been constructed but not permitted. c. Lots on Plans: Please ensure that all the lots that are built and/or planned are shown on the plans. For instance, 10222 Hawkswater Blvd is not on the plans, but it is constructed. There may be other examples. Per 15A NCAC 021I .1002(43),please ensure that if you have sold homes without deed restrictions that those lots are accounted for at full build-out condition in the stormwater ponds' designs. c. Permit Section 11(17): The deed restrictions must be recorded and a copy must be submitted to the Division before lots are sold. Deed restrictions are not on file. i. Please submit recorded deed restrictions for all lots that are sold. ii. For lots that are not sold,please submit the notarized form indicating that deed restrictions will be recorded prior to sale. 3. Operation and Maintenance(O&M)Agreements: O&M agreements are on file for most of the ponds. However,please update the O&M for any pond(s)that must be modified in the permit. 4. Certification: Per Permit Section II(10),please submit a Designer's Certification for any pond(s) that are no longer being used for Erosion and Sediment Control(E&SC). 5. Specific Ponds: The following specific items were observed for the following ponds: a. Phase 1: i. Pond 2—The inspector could not observe the outfall. The emergency overflow needs maintenance. ii. Pond 3 —The pond and its outfall location differ from the permitted plans. (The area is currently under development.) b. Phase 2: An additional pond is in an area that has not been constructed without permitting. c. Phase 3: i. Pond 2—The slope is eroding along southeastern slope. ii. Pond 3 —Not constructed. iii. Pond 4—The pond is not constructed. (It is in the early stages of development). iv. Pond 5 —The pond has been constructed in an area that differs from the permitted plan. v. Pond 6—The pond is not constructed. (It is in the early stages of development). vi. Pond 7—Please maintain the riser where vegetation is beginning to obstruct the flow. That is a significant change and needs to be reflected on the plans. Additionally,the townhomes shown below are in an area of the permitted plan that is labeled "future"and does not have a development layout. But,from a quick review of the county GIS, many of these units are build and owned by homeowners. This area needs to become permitted. The project must be constructed per the plans and also fully permitted prior to construction. I will ask the inspector to do an inspection. In the meantime I will send a request for additional information tomorrow asking for a modification package that reflects the construction. A preliminary in-depth review of that information has determined that the application is not complete and that additional information is needed. To continue the review,please provide the following additional information: 1. General: This project was originally permitted as permit number SW8 060354 in 2008 under 15A NCAC 02H .1000, effective September 1, 1995 (commonly referred to as the"1995 Rules"). In 2013,this permit was reissued to DR Horton,Inc. as SW8 130412 after the original permittee was foreclosed on. The 2013 permit was re-permitted under the 1995 Rules as opposed to the rules in effect at that time, 15A NCAC 02H .1000, effective October 1,2008 (commonly referred to as the"2008 Rules".) The current proposal modifies two ponds,Phase 3 Pond 4 and Phase 3 Pond 6. The impervious area draining to both ponds has increased since the 2013 permit. The rules currently in effect are 15A NCAC 02H .1000, effective January 1,2017(commonly referred to as the"2017 Rules"). Per .1002(23)and .1042(1)(b)the redesign of the two ponds is a major modification subject to the requirements of the 2017 Rule. 2. Average Depth [.1053(2)]: The average depth has been calculated using Equation 2 of the 2008 rules' manual. Since the permanent pool is at the top of the vegetated shelf and the pond is designed per the 2017 rules, it appears that Equation 3 of the 2017 manual should be used. This is likely a simple and quick mathematical exercise that won't impact the pond's design. But, since this permit has spanned three versions of regulations,the permit needs to document that the average depth has been designed per the 2017 rule rather than the 2008 rule. Please run Equation 3. 3. Project Area[.1042(2)(a)(iv)]: The project area on the application appears to cover only the two drainage areas being modified as opposed to the entire project area that is covered by the permit's ten ponds. Please list the entire project area on the application. 4. Pipe Inverts [.1042(2)(g)(vii)]: The storm drain structures are shown on the plan, but it appears that the associated pipe schedule was not included. Please show the inverts of these features on the plan set. 5. Deed Restrictions [.1003(7)]: a. Phase 3A Section 2C: The notarized deed restrictions were submitted for this section. However, it appears that Lot 3271 has been excluded. Please include this lot in the restrictions. Project Name: The permit has historically been titled"Hawkswater at the River". The current application lists the title as "Hawkswater at the River,Phase 3A Section 2C". It is recommended that you continue the historical title for the permit since it covers more than just Phase 3A Section 2C. 7. Pond Titles: There are ten (10)ponds covered by this permit;Phase 1 Ponds 1, 2, and 3 and Phase 3,Ponds 1,2, 3,4, 5, 6, and 7. This application lists "Drainage Area 1"and"Drainage Area 2" on the application and the respective Ponds are"Pond 4" and"Pond 6". Since the currently-proposed plans will be combined with plans that were permitted in 2013, it is recommended that you continue the historical pond numbering titles of"Phase 3 Pond 4" and "Phase 3 Pond 6" in the application materials for consistency and clarification. 8. Full Permitted Plan Set: Please provide a list of plan sheet numbers of the currently-permitted set to carry over and be re-permitted for this set so that there will be a full set for the project. 9. Upcoming Inspection: There appear to be areas of the project that have not been built per the plan. For instance,the townhomes behind Belville Elementary are not permitted. Additionally, there is a pond constructed inside the loop made by Keekle Lane that is not on the plans while the pond permitted to be adjacent to Keekle Lane has not been constructed. The modification currently being reviewed will focus only on the two ponds that were submitted with this application. A future modification is likely. Please remember to confirm that any revised information is presented consistently throughout the application documents including calculations, supplements,narrative, and plans. Please also remember to provide two hard copies of any updated documents per 15A NCAC 02H.1042(2). The requested information should be received in this Office prior to August 25,2017, or the application will be returned as incomplete. When I looked through this file, and this latest application, nothing had ever been submitted for this particular permit showing that Mr. Loiacono was given any authority to sign for the company. Please let your clients know that when they send in modifications on one permit we do not automatically change signing official names for all their permits. That means that we may ask for it if there is nothing in the file or in that particular application that shows that authorization. Therefore they need to make sure that they give you(their engineer) the latest info with their applications, that way I can get this into review faster. This information is critical because we can not give a permit without the correct authorization from the company. We have had problems with older permits in the past where someone requested a modification of a. permit that was not authorized by the permit holder. DR Horton can contact us directly, if they choose, and request that all their permi.t(s) be updated with the latest point of contacts that they authorize to sign for them. The purpose of this letter is to inform you that this activity was found to be in violation of the SPCA, G.S. 113A-50 to 66, Title 15A, North Carolina Administrative Code (NCAC), Chapter 4 and Construction Stounwater Permit NCG 010000. If you feel that you are not responsible for the following violations,please notify this office immediately. The violations of the SPCA that were found are: 1. Failure to conduct a land-disturbing activity in accordance with the approved erosion and sedimentation control plan. G.S. 113A-57(5). Approved plans do not reflect current site conditions. 2. Failure.to provide ground stablization, NCG 010000 Section II. All perimeter dikes, swales, ditches,perimeter slopes and all slopes steeper than 3 horizontal to .1 vertical (3: 1) shall be provided temporary or permanent stabilization with ground cover as soon as practicable but in any event within 7 calendar days from the last land-disturbing activity. ii. All other disturbed areas shall be provided temporary or permanent stabilization with ground cover as soon as practicable but in any event within 14 calendar days from the last land-disturbing activity. b. Conditions - In meeting the stabilization requirements above,the following conditions or exemptions shall apply: i. Extensions of time may be approved by the permitting authority based on weather or other site-specific conditions that make . compliance impracticable. ii. All slopes 50' in length or greater shall apply the ground cover within 7 days except when the slope is flatter than 4: 1. Slopes less than 50' shall apply ground cover within 14 days except when slopes are steeper than 3: 1,the 7 day-requirement applies. iii. Any sloped area flatter than 4: I shall be exempt from the 7-day ground cover requirement. iv. Slopes 10' or less in length shall be exempt from the 7-day ground cover requirement except when the slope is steeper than 2: 1. v. Although stabilization is usually specified as ground cover, other methods, such as chemical stabilization,may be allowed on a case- by-case basis. vi. For portions of projects within the Sediment Control Commission- defined "High Quality Water Zone" (15A NCAC 04A. 0105), stabilization with ground cover shall be achieved as soon as practicable but in any event on all areas of the site within 7 calendar days from the last land disturbing act. vii. Portions of a site that are lower in elevation than adjacent discharge locations and are not expected to discharge during construction may be exempt from the temporary ground cover requirements if identified on the approved E&SC Plan"or added by the permitting authority. The peimittee must select, install, implement and maintain best management practices (BMPs) and control measures that minimize pollutants in the discharge to meet the requirements of this permit. Control measures not maintained throughout site. To correct these violations, you must: 1. Submit a revised sedimentation and erosion control plan for approval for the following areas: Phase 1B 2. Install erosion and sedimentation control devices sufficient to retain sediment on the tract. • 3. Take all reasonable measures to prevent sedimentation damage to adjacent property such as the following: wetlands throughout site. • 4. Provide an adequate stream buffer zone of sufficient width to confine visible sedimentation within the 25%of the buffer nearer the land disturbance using natural or artificial means (minimum 25-foot width in Trout Waters) including the following areas: along wetlands throughout site. 5. Slopes left exposed will, within 7 calendar days of completion of any phase of grading, be planted or otherwise provided with temporary or permanent ground cover, devices, or structures sufficient to restrain erosion. 6. Provide adequate temporary or permanent ground cover on areas where land- disturbing activity has ceased in 7 or 14 days according to NCG 01000 permit conditions at the following locations: slope along wetlands. 7. Maintain all sedimentation and erosion control measures as specified in the approved plan and as required to prevent sedimentation damage including the following: silt fence along wetlands and construction entrance. SPCA Violations The violations of the SPCA cited herein may be referred to the Director of the Division of Energy, Mineral and Land Resources (Director) for appropriate enforcement action, including civil penalty assessments for an initial one-day violation and/or a continuing violation. The penalty for an initial one-day violation of the SPCA may be assessed in an amount not to exceed $5,000.00. The Division of Energy, Mineral and Land Resources is not required to provide a time period for compliance before assessing an initial penalty for the violations of the SPCA cited herein.
