SW8070933 and SW8090223 that a designer's certification that the project was constructed in accordance with
the approved plans as required by the permit has not been submitted.Please include this with your application.

Dear Mr. Martin:
On December 19,2008,the Wilmington Regional Office received a copy of a Soil and Erosion Control Plan for the subject
project. The North Carolina Administrative Code requires any project that proposes more than 10,000 square feet of built-upon
area,or that must receive either Sedimentation and Erosion Calbol Plan approval and/or a CAMA Major permit to apply for and
receive a Stonnwater Management Permit by the Division of Water Quality.Any construction on the subject site,prior to
receipt of the required permit,will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action
by this Office.
Either a Stormwater Permit Modification Application Package including 2 sets of plans,completed application form,fee,and
supporting documentation,or a written response regarding the status of this project and the expected submittal date must be
received in this Office no later than April 10,2009.A copy of this letter must accompany your permit application. Failure to
respond to this request may result in the initiation of enforcement action,and constriction may experience a subsequent delay.
Do not confuse the NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter or a
non-delegated local stormwater ordinance approval with the Coastal Stormwater Management Permit which will be signed by
the Stormwater Supervisor of the Division of Water Quality. Please reference the Project Number above on all

Dear Randy Martin:
This office has received a soil erosion and sediment control plan for the project listed above which
was submitted as required by the North Carolina Sedimentation Pollution Control Act(G.S.
113A-57(4)).
The Act requires that all persons disturbing an area of one or more acres of land must obtain
approval of a soil erosion control plan prior to the commencement of the land-disturbing activity
(G.S. 113A-54(d)(4)). The Act further states that this plan must be filed a minimum of 30 days
prior to the activity and the approving authority must approve or disapprove the submitted plan
within 30 days of receipt. Failure of the approving authority to approve or disapprove the submitted
plan within the 30-day period will be deemed approval of the plan.
Commencement or continuation of a land-disturbing activity under the jurisdiction of this Act prior
to the approval of an erosion and sediment control plan is a violation of the Act.
We have performed a preliminary review of your submitted plan and have determined that

The approval of an erosion and sediment control plan is conditioned on the applicant's compliance
with Federal and State water quality laws,regulations and rules.

EROSION and SEDIMENTATION CONTROL PLAN PRELIMINARY REVIEW
CHECKLIST

To expedite the approval process, a cursory review of your submitted Erosion and Sediment Control Plan
application has been made and has shown the need for additional information as specified below. To meet
our review schedule,any additional information should be received by this office no later than
(January 06,2009). Failure to meet this schedule may result in disapproval of your plan.
The following items shall be incorporated with respect to specific site conditions, in an erosion&sediment
control plan:

Comments:1. Limits of Disturbance should be clear and shown on the plans.
2. Maintenance Requirements are required, should be specific to each measure and shown on
the details sheet of the plans.
3. In the notes, under erosion control plan,#3 states that"immediately upon completion of
clearing and grubbing,silt fence should be installed...". Clearing and grubbing should only be
completed for that which is necessary for the installation of erosion control measures until the
measures are installed.
4. A note suggests that the Town of Morehead City is responsible for all grading work done except
for that part along Wilson Avenue. The area along Wilson Ave. should be included within the
limits of disturbance, and there must be a financially responsible party since it is considered part of
the proposed additional 1.84 acres.
