Please review this draft carefully to ensure thorough understanding of the requirements and conditions it contains. There are several changes from the existing permit, including the following: The facility components list has been updated per consultation with the ORC (see Supplement to Cover Sheet). Based on NPDES guidance regarding the reduction of monitoring frequencies in NPDES permits for exceptionally performing facilities, monitoring requirements for NH3-N, Total Suspended Solids and Enterococci are maintained at twice per week at the 2.25 MGD flow tier [See A.(1)]. As reduced monitoring only applies to the current flow, monitoring frequency for the above parameters has been reset to daily at 2.8 and 3.5 MGD flow tiers [See A.(2.) and A.(3.)]. Once the 2.8 MGD limits page has been placed into effect and after six (6) consecutive months of daily sampling, the Permittee may request a reduction in the monitoring frequency to twice per week sampling for any of the three parameters (TSS, NH3-N and Enterococci) for which no effluent permit limit violations have occurred. • For consistency with other issued NPDES permits, the Total Residual Chlorine (TRC) Special Condition has been removed from the permit and conditional TRC limit and monitoring has been added to each flow tier sheet with a footnote explaining the conditional monitoring and reporting requirements [See A.(L), A.(2.) and A.(3.)]. • For consistency with other issued NPDES permits, the order of the nutrient -related special conditions (Total Nitrogen Allocations, Annual Limits for Total Nitrogen, and Calculation of Total Nitrogen Loads) have been placed after the Chronic Toxicity and Additional Monitoring Requirements special conditions [See A.(7.), A.(8.) and A.(9).]. • Some of the wording has changed in Special Condition A.(5.), Chronic Toxicity Permit Limit, please review each paragraph carefully. In addition, at the end of the Special Condition, 2nd species Toxicity Testing Requirements for municipal permit renewals per Federal Regulations [40 CFR 122.210)(5)] have been added. • A special condition to monitor effluent PFAS chemicals twice per year has been added to the permit, to be effective six (6) months after EPA has a wastewater method in 40 CFR136 method published in the Federal Register [See Special Condition A.(12.) PFAS Monitoring Requirements]. • To verify that the existing sample location is representative of the monitored activity, Special Condition A.(11.) Demonstration of Representative Sampling has been added to the permit. Is A notation was made concerning the Electronic Reporting Rule — NPDES Electronic Reporting Rule — Phase 2 Extension. EPA extended the Phase 2 deadline to December 21, 2025. • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The requirement to continue reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application has been added to your NPDES permit [See Special Condition A.(13.)]. The NPDES standard conditions (Parts II, III, and IV) that are a part of the permit are not included in this draft document (cover, map, and Part I). The conditions are the same as in your current permit except that agency and division names have been updated. The latest version is available at https://bit.ly/3k5NFaL and can be viewed online or downloaded as a PDF file. Concurrent with this notification the Division is publishing a notice in a newspaper having circulation in the general Craven County area, soliciting public comments on this draft permit. As of this permit issuance effective date, any previously issued permit bearing this number is no longer effective. INSTREAM MONITORING REQUIREMENTS [NCGS 143-215.1(b)] (a.) Instream monitoring is required for the following parameters and locations while discharging via a diffuser into the Neuse River. No provisional waiver is applicable: S 1 = upstream 10 feet (approximately 2,076 feet offshore, perpendicular to diffuser center); S2 = downstream 10 feet (approximately 2,076 feet offshore, perpendicular to diffuser center); S3 = within 10 feet beyond the end of the diffuser and in line with the diffuser. CHRONIC TOXICITY PERMIT LIMIT (Quarterly) [15A NCAC 0213.0200 et seq.] The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Americamysis bahia (= Mysidopsis bahia) at an effluent concentration of 15% at 2.25 MGD, 16% at 2.8 MGD, and 16% at 3.5 MGD. The permit holder shall perform at a minimum, quarterly monitoring using procedures described below to establish compliance with the permit condition. The tests will be performed during the months of January, April, July, and October. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed (at a minimum) in each of the two following months as described in EPA Method 1007.0, Mysid, Mysidopsis bahia, Survival, Growth, and Fecundity Test, as described in Short -Term Methods for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Marine and Estuarine Organisms, Third Edition, EPA821-R-02- 014, October 2002. The test procedure will be based on EPA Method 1007.0, Mysid, Mysidopsis bahia, Survival, Growth, and Fecundity Test, as described in Short -Term Methods for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Marine and Estuarine Organisms, Third Edition, EPA-821-R-02-014. The procedure will be performed as written with the following exceptions: • The test treatments will consist of a control and a 15% at 2.25 MGD, 16% at 2.8 MGD, and 16% at 3.5 MGD effluent concentration ("pass/fail"), or a control and five effluent concentrations, one of which will be 15% at 2.25 MGD, 16% at 2.8 MGD, and 16% at 3.5 MGD and one of which will be (1/2 the IWC) 7.5% at 2.25 MGD, 8% at 2.8 MGD, and 8% at 3.5 MGD. • Mortality for pass/fail tests will be evaluated using the t test described in Section 11.3 in Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms, Fifth Edition, EPA-821-R-02-012, October 2002, applying an alpha level of 0.05. • The growth endpoint for pass/fail tests will be determined using Appendix G of Short -Term Methods for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Marine and Estuarine Organisms, Third Edition, EPA-821-R-02-014, October 2002, applying an alpha level of 0.01. • Mortality and growth endpoints for multiple -concentration tests will be determined using hypothesis testing as described in EPA Method 1007.0, Mysid, Mysidopsis bahia, Survival, Growth, and Fecundity Test, as described in Short -Term Methods for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Marine and Estuarine Organisms, Third Edition, EPA-821-R-02-014, October 2002. • Fecundity will not be evaluated. All toxicity testing results required as part of this permit condition will be entered electronically using the Division's eDMR system for the months in which tests were performed. Should the Permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three-month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. For any given calendar year, the Permittee shall be in compliance with the annual TN Load limit in this Permit if- (v.) the Permittee's annual TN discharge is less than or equal to its TN Load limit, or (vi.) the Permittee is a co-permittee member of a compliance association. If the Permittee is not a co-permittee member of a compliance association and the Permittee's cumulative annual TN discharge exceeds the effective TN Load limit in this permit at any point during the calendar year, the Permittee is in violation of its TN Load limit, and each day of a continuing violation shall constitute a separate violation. (e.) The TN Load limit in this Permit (if any) may be modified as the result of allowable changes in the Permittee's TN allocation. (i.) Allowable changes include those resulting from purchase of TN allocation from the Wetlands Restoration Fund; purchase, sale, trade, or lease of allocation between the Permittee and other dischargers; regionalization; and other transactions approved by the Division. The Permittee shall report monthly Total Nitrogen results (mg/L and pounds/month) in the appropriate discharge monitoring report for each month and shall report each year's results (pounds/year) with the December report for that year. Each increase in permitted flow beyond 2.25 MGD is further conditioned on issuance by the Director of an Authorization to Operate (AtO). In order to receive each AtO, the Permittee must demonstrate to the Division's satisfaction that it has completed treatment plant improvements, or acquired TN allocations or offset credits, and can consistently meet its total nitrogen limit at the increased flow. (b.) DEMONSTRATION OF REPRESENTATIVE SAMPLING (Fecal Coliform, Dissolved Oxygen & pH Sampling) [NCGS 143-215.1(b); 40 CFR 122.410)] 1. The Permittee shall conduct investigative grab sampling for dissolved oxygen, fecal coliform and pH in the vicinity of the receiving stream Outfall 001 in conjunction with effluent sampling conducted at the existing effluent sampling location. 2. A study plan for the additional sampling with the proposed location of the grab sample point should be provided by December 1, 2023. Once approved, this study plan should be used for these analyses. Sampling shall be conducted in accordance with monitoring frequencies as identified in Section A. (L) and for a period of 2 months during the Winter season (November 1 — March 31) and 2 months during the Summer season (April 1— October 31). The sampling should be conducted on the same day and close enough together in time to be reasonably comparable. 3. By September 1, 2024, the Permittee shall submit to the Division a report summarizing the data results. A comparison of the effluent data and the alternative sampling point should be conducted by the permittee. 4. Should the existing sampling location for fecal coliform, dissolved oxygen and pH be considered unrepresentative; i.e., there is a statistically significant difference in the results (between locations 001 and 001B) with respect to the receiving stream, the Permittee shall identify and sample at a location that is representative. This change, once approved, will be incorporated into the permit as a minor modification. (a)1 The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted monthly electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. The eDMR system may be accessed at: https://deq.nc.gov/about/divisions/water-resources/edmr. If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Starting on December 21, 2025, the permittee must electronically report the following compliance monitoring data and reports, when applicable: • Sewer Overflow/Bypass Event Reports; and • Pretreatment Program Annual Reports; and • Clean Water Act (CWA) Section 316(b) Annual Reports. The Permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver from Electronic Reporting" section below). 2. Electronic Submissions In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of each electronic submission. The Permittee should use the EPA's website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. To obtain an electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the Permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable.
