Attn: Kenny Fisher 2549 Amanda Place Winterville, NC 28590 Subject Property: Arden Ridge Section 3 Tar-Pamlico Basin, Phillippi Branch, 030305, 28-98.6, NSW, C REQUEST FOR MORE INFORMATION Dear Mr. Fisher: On November 21, 2007, the Division of Water Quality (DWQ) received your application dated November 20, 2007, to impact 6180 square feet (ft2) of protected riparian buffers to construct a road on the subject property. This request was submitted in part to fulfill the requirement of a Notice of Violation issued to Bristol Moore, LLC. by the DWQ for unauthorized impacts to the Tar-Pamlico Riparian Buffer 15A NCAC 2B .0259. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 1 SA NCAC 2H .0506 and 2B .0259(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Insufficient Impact Remediation On December 5, 2007, a staff member of this office conducted a compliance check to the subject property to review the remediation of the violation areas. The areas indicated as "Impact" sites 1 and 3 on the map provided with this application were considered to be in compliance with the restoration request of the NOV. The manor of installation does not allow for diffuse flow. b) Please provide the engineered specifications indicating the level spreader is appropriately sized to diffuse the flow from the stormwater discharge. Please contact Kyle Barnes of the Washington Regional Office and Ian McMillan of the DWQ Central Office in writing within four weeks of the receipt of this letter with the requested information. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
