The modification follows an October 22, 2007 Water Quality Certification from the DWQ. Recently project engineers discovered potential flooding issues related to the proposed plans upon completion of a flood study. Specifically, neighboring townhomes could be flooded upon construction of the proposed Cottage Oaks Drive and Thomas Ridge Road crossings. Due to this fact the applicant and project engineer have had discussions with City of Charlotte regarding changes to the proposed plans. The attached letter outlines the current status and proposed changes to the project. Namely one of the proposed crossings will not be constructed, a second crossing will result in increased stream impacts and the proposed thoroughfare impact will not change. If City planning, DOT, etc are agreeable to the proposed changes a modification to the 401 approval will be submitted. No impacts will be performed without proper approvals from all agencies. In summary, our client and S&EC wanted to provide NC DWQ with a status report for the project. Once plans are finalized we will submit a request for modifications to the Water Quality Certification. Those approvals allowed for the impact of 0.174 acres of wetlands and 296 linear feet of unnamed stream to Stony Creek in order to construct the Prosperity Village Development The permit application and subsequent information was based on the construction of three stream crossings. The crossings consisted of a City of Charlotte Thoroughfare, Prosperity Ridge Road (149 LF of impact), a City of Charlotte Collector, Thomas Ridge Road (80 LF of impact) and a City of Charlotte Local Road, Cottage Oaks Drive (67LF of impact) with aforementioned wetland impact acreages. Since receiving the approvals and per the requirements of the City of Charlotte a detailed 1 D0+1 flood analysis was performed on the unnamed stream to Stony Creek. The conclusion of the analysis was that an increase in the 100-year water surface elevation along the stream would place existing neighboring rnutfi family dwelling structures out of compliance with the City of Charlotte requirements. In an effort to design Cottage Oaks Drive and Thomas Ridge Road in a manner that would not increase the chance of flooding several scenarios using traditional and bottomless culverts and bridge structures were analyzed. It was determined that there is no feasible solution to the crossing at Cottage Oaks Drive and that the Thomas Ridge connection could be achieved by the installation of a 4'x16' box culvert. The crossing of Thomas Ridge would require additional stream disturbance than originally permitted. Based on the results of the flood study we believe modifications to the approvals are necessary. Currently discussions are being held between the developer and his consultants with the City regarding these proposed changes. Upon completion of proposed plans approximately 140 linear feet of stream disturbance will tie requested for the Thomas Ridge Road crossing, 0 linear feet of stream disturbance at Cottage Oaks Drive and 149 linear feet of stream disturbance at Prosperity Ridge Road. The proposed Prosperity Ridge Road impact will not change from the approved design. In summary, upon satisfaction from the City regarding the proposed plans a new preconstruction notification modification request will be submitted to the USACE and NC DWQ. Sincerely, ~~ Bryan C.
