Sullins, Director Division of Water Quality January 3, 2008 DWQ Project # 07-0936 Mecklenburg County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Beacon #18, LLC Attn: Jon Morris 9335 Harris Corners Parkway, Suite 250 Charlotte, NC 28269 Subject Property: 77 Overlook Park UT to Long Creek [030834, 11-120-(0.5), C] STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. Morns: On July 16, 2007, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to impact to impact 300 linear feet of unnamed tributary to Long Creek to construct the transportation center described in your application received by the DWQ on May 29, 2007. In order to meet Condition 6 of the 401 Certification for this project, a stormwater management plan was submitted to the DWQ on August 1, 2007. On August 27, 2007, the DWQ sent you a Stormwater Duplicity of Effort Notice. Since that time, your consultant, John R. McAdams Company, Inc., has demonstrated that this project does not fall under this policy and that the DWQ is the appropriate stormwater reviewing authority for this project. On November 6, 2007, the DWQ received a revised stormwater management plan for this project. On November 15, the DWQ received a second revised stormwater management plan for this project. This. Plan has been reviewed and satisfies Condition 6 of the 401 Water Quality Certification issued on July 16, 2007. The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all storm water conveyances on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. This letter completes the review of the DWQ under Section 401 of the Clean Water Act.
