Dear Sir/Madam: The City of Raleigh proposes to extend Edwards Mill Road from Trinity Road to NC 54 (Chapel Hill Road). The project was previously authorized under USAGE Nationwide Permit 14 (Action ID Nos. 200520178 and 200520179). NCDWQ Section 401 Water Quality Certification and Riparian Buffer Certification were also issued (NCDWQ Project No. 040092). These authorizations expired on March 17, 2007. Details of the project that relate to streams, wetlands, and riparian buffers have not changed since the issuance of the referenced authorizations. The project will impact Richland Creek through the installation of a 72-inch reinforced concrete pipe culvert (RCPC) and the extension of an existing 42-inch RCPC, for a total impact of 176 linear feet. There are no jurisdictional wetlands in the project area. Approximately 31,211 square feet of Neuse River riparian buffer will be impacted by the project. Detailed project information, including proposed mitigation is provided in the enclosed pre-construction notification form (PCN) and attached design drawings. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. The southern half of the project consists of approximately 0 25 mile of new location roadway with one stream crossing The equipment required will be heav~ghway construction equipment, including dozers with~ans for gradin a crane and track hoes will be used for installation of the culvert and construction of the footings associated with the culvert. Additionally, standard grading equipment including backhoes and motor graders paving equipment including pavers and rollers and a pile driver for guardrail posts will be used. 11. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. A USACE NWP #14 was issued March 4, 2004 under Action ID 20040558 It was subsequently determined that the project could not be constructed and maintained as designed The permit was rescinded. The new design was authorized on March 17 2005 by NWP 14 under Action IDs 200520178 & 200520179. NCDWQ Water Quality and Riparian Buffer Certification (Proiect No 040092) was issued on March 23, 2005. Mitigation for 176 linear feet of stream and 33,970 ft2 (17 540 ft2 zone 1 and 16 430 ft2 zone 2) of riparian buffer mitigation was purchased from the NCEEP 'for $114 075.20. The NWP 14 and accompanying NCDWQ certifications expired on March 17 2007. This application is a request to re-issue the NWP 14 and accompanying NCDWQ certifications. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. VI. Proposed Impacts to Waters of the United States/Waters of the State Updated 11/1/2005 Page 7 of 15 It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Provide a written description of the proposed impacts: One hundred and fifty-six (156 feet of jurisdictional stream channel Richland Creek, is proposed to be impacted by the road crossing. A 72-inch reinforced concrete pipe (RCP) will be used to convey the stream under the proposed road. At that location (Sta. 23+25), the proposed crossing is a 4-lane undivided highway and sidewalks. In addition, 20 feet of jurisdictional channel, Richland Creek will be impacted by the extension of an existing 42-inch RCP (Sta. -Y- 12+60). The existing_pipe conveys Richland Creek under NC 54. Finall ~~approximately 15 718 ft2 (0 36 ac) of forested land within zone 1 and 15 493 ft2 (0.356 ac) of forested land within zone 2 of the designated Neuse River riparian buffers will be impacted. The buffer impacts are associated with the proposed stream crossing, extension of the existing culvert and encroachment in other locations. There are no jurisdictional wetlands associated with the project area• therefore there are no jurisdictional wetland impacts. 2. Individually list wetland impacts. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Due to the linear nature of the project and relatively narrow area available for the project impacts to jurisdictional resources can only be completely avoided b~plementation of a no-build scenario. In order to remain within the property currently owned by the State of North Carolina and within the City of Raleigh's permanent easement it is necessary to make a road crossing of Richland Creek The location of the crossing was chosen such that a perpendicular crossing could be made while keeping the proposed roadway as strai h~ t as possible Due to the alignment of Richland Creek and one of its unnamed tributaries it is not possible to reali ng the proposed road without creating, anon-perpendicular crossing of the creek(s). Perpendicular crossings minimize the impacts to the stream. The extension of the existing culvert on Richland Creek under NC 54 is necessary to accommodate improvements to NC 54 at the proposed intersection with Edwards Mill Road. The road cannot be realigned to the east to avoid impacts associated with the culvert extension, since this would create an off-set intersection with a future road proposed for construction south of NC 54. An off-set intersection could potentiallygenerate unsafe driving conditions. At the proposed stream crossing there are unavoidable riparian buffer impacts. The buffer impacts at the stream crossing have been minimized by designing an undivided highway from the existing Edwards Mill Road terminus south through the riparian buffer at the Richland Creek crossing. South of the buffer the proposed road will be a divided highway. A preformed scour hole at the discharge of a stormwater pipe will be located in the riparian buffer just south of the stream crossing. Due to the topography and need to maintain a perpendicular stream crossing, it is not possible to relocate the proposed outfall to another location or outside of the riparian buffer. There are also buffer impacts along NC 54 which are associated with the need for the culvert extension as described above Buffer impacts have been minimized through the use of 2:1 fill- slopes where the road is proposed for widening. The widenin /gimprovements to NC 54 include the relocation and upgrades to the existing road-side ditch on the south-side of NC 54. The ditch is currently undersized for its drainage area and is severely eroded. The new ditch will consist of Updated 11/1/2005 Page 10 of 15 arip-rapped channel and will be located at the base of the proposed fill-slope. Due to the volume of water that will flow in the ditch steepness of slope, and limited area available for construction it is not feasible to create alevel-spreader or retention structure prior to the ditch entering the riparian buffer. Riparian buffer will be impacted immediately south of the existing Edwards Mill Road terminus. At this location Richland Creek parallels existing Edwards Mill Road and the proposed extension along_the road's eastern edge. To avoid impacts to the riparian buffer, all proposed widening of the existing road is planned to the west side away from Richland Creek. The proposed road extension cannot be relocated further west because of potential impacts to existing housing and the narrow approach corridor available to create the proposed perpendicular crossing of Richland Creek Also changes in the proposed alignment to avoid riparian buffer impacts while maintaining the perpendicular crossing of Richland Creek are unacceptable, since it would create a sharp curve that could generate potentially unsafe driving conditions according to national and state safety_guidelines. A stormwater outfall will be located in the riparian buffer near Sta. 27+50 The outfall will consist of a riprapped ditch leading to Richland Creek. Due to the topography it is not feasible to relocate the outfall and there is not enough area available for the construction of apreformed scour hole. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). Updated 11/1/2005 Page 11 of 15 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. As noted in Section IV, mitigation for 176 linear feet of stream and 33,970 ft2 (17,540 ft2 slightly less than the 33 970 ft that was previously mitigated for. Actual impacts are 15,718 ft2 of forested land within zone 1 and 15 493 ft2 of forested land within zone 2 for a total of 31.211 ft2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the .applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http•//www nceep net/pages/inlieureplace.htm. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. If percent impervious surface exceeds 20%, please provide calculations demonstrating total proposed impervious level. The project corridor is approximately 3,900 feet in length with an average width of 150 feet resulting in an area of about 13 acres. The existing impervious area consists of an existing three lane roadway, about 1,800 feet in length, 40 feet in width, and about 1.7 acres in area and is located in the northern portion of the site. The remainder of the corridor is wooded and undeveloped. The proposed roadway will consist of four travel lanes, divided and undivided, with a grass median where divided, a sidewalk on one side, and a paved bike path on the other side. This will result in an additiona13.5 acres of impervious area. The existing roadwa~is parallel to Richland Creek, which is located approximately 350 feet to the east. The existing roadway includes an under round pipe storm drainage system that discharges either directly into the stream or into ditches that flow directly to the stream. The proposed storm drainage system for the widening/improvements in this section of the project will tie to the existin doge system and will not include any additional discharge locations. The southern half of the project is a new road located approximately 150 feet east of Richland Creek. The proposed storm drainage system will consist of curb inlets with individual discharge points located upstream of the riparian buffers along Richland Creek. These dischar eg s will include a preformed scour hole to reduce flow rates and thus erosion and flooding_potentials. The preformed scour hole will also function to spread out the water flow prior to reaching the riparian buffer. Uptake of nutrients b~plants in the riparian buffer will attenuate any nutrient loading. Due to limitations from topography, large size of drainage area, anticipated rate of flow, and land available for construction, one outfall on the new location road and the relocated ditches along NC 54 will either not havepreformed scour holes and drain directly into the creek and a third discharge will have its preformed scour hole located within the riparian buffer. A minimum amount of flow as possible will be handled by these structures. The drainage system, in general, will be as small as possible to minimize the concentration of flow at the discharge locations. Temporary sediment traps, silt fence, and temporary diversion ditches may also be utilized during construction. XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility.
