GALLARDA, PE – MANAGING MEMBER PLURIS HAMPSTEAD, LLC POST OFFICE BOX 297 HAMPSTEAD, NORTH CAROLINA 28443 Subject: Permit No. WQ0037287 Pluris Hampstead WWTP High-Rate Infiltration System Pender County Dear Mr. Gallarda, In response to your permit major modification request received on March 6, 2024, and subsequent additional information received on June 6, 2024, we are forwarding herewith Permit No. WQ0037287 dated August 14, 2024, to Pluris Hampstead, LLC for the construction and operation of the permitted modifications and the continued operation of the existing wastewater treatment and high-rate infiltration facilities. Modifications to the subject permit are as follows: ➢ The Division has approved the 500,000 gallon per day (GPD) expansion wastewater treatment plant (WWTP) and increased the permitted non-discharge disposal capacity accordingly to 1,000,000 GPD. This permit is effective from the date of issuance through January 31, 2026, shall replace Permit No. WQ0037287 issued on August 2, 2021, and is subject to the conditions and limitations therein. The Permittee shall submit a renewal application no later than August 4, 2025. Please pay attention to the monitoring requirements listed in Attachments A, B, and C for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required operational information may result in future non-compliance. The Division has removed the following permit conditions since the last permit issuance dated August 2, 2021: ➢ Old Condition I.5 – The Division has removed this condition and replaced it with Condition I.5. ➢ Old Condition II.3 – The Division has removed this condition because the Permittee has constructed all proposed groundwater monitoring wells. Gallarda, PE August 14, 2024 Page 2 of 3 The Division has added or modified the following permit conditions and attachments since the last permit issuance dated August 2, 2021: ➢ Condition I.2 – The Division has modified Old Condition I.2 to replace “…250,000 GPD for each infiltration basin” with “…573,000 GPD (102.01 GPD/ft2) for Basin 1”. ➢ Condition I.5 – Within 60 days of this permit’s effective date, the Permittee shall permanently abandon monitoring well MW-1. The Permittee shall permanently abandon each monitoring pursuant to the requirements in 15A NCAC 02C .0113(d). Within 30 days of abandonment, the Permittee shall submit a Well Abandonment Record (Form GW-30) for each permanently abandoned monitoring well. The Permittee shall submit the Well Abandonment Records via the Non-Discharge online portal. ➢ Condition I.7 – The Division has moved Old Condition VI.5 from Section VI to Section I. ➢ Condition II.7 – The Division has modified Old Condition II.8 to replace “…apply for a permit modification to establish a new compliance boundary prior to…” with “…notify the Division of…”. ➢ Condition II.9 – The Division has revised the setbacks in Old Condition II.11 to correspond to the modified facility. ➢ Condition III.4 – The Division has modified Old Condition III.4 to replace “…once per permit cycle” with “…annually”. ➢ Condition III.6 – The Division has modified Old Condition III.6 to include “The Permittee shall take caution to protect the integrity of the infiltrative area”. ➢ Conditions III.15, IV.6, IV.9, IV.10, and V.2 – The Division has modified the recordkeeping duration in Old Conditions III.15, IV.6, IV.9, IV.10, and V.2 from five years to eight years because the next permit renewal will be for eight years pursuant to 15A NCAC 02T .0111(e). ➢ Condition IV.1 – The Division has modified Old Condition IV.1 to include “…including the monitoring of groundwater, surface water or wetlands, waste, reclaimed water, residuals, soil, treatment processes, lagoon or storage ponds, plant tissue, and aquatic biota, if…”. ➢ Condition IV.2 – The Division has modified Old Condition IV.2 to include “Parameters measured on-site with in-line metering equipment are exempt from a Division-certified laboratory analysis”. ➢ Conditions IV.5.e and IV.5.f – The Division has modified Old Condition IV.5.e to specify both “Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings” and “Continuous monthly and year-to-date loadings for any non-hydraulic parameter specifically limited in Attachment B”. ➢ Condition IV.10 – The Division has modified Old Condition IV.10 to include the date of turbidimeter calibration in the maintenance log (for the 500,000 GPD expansion WWTP). ➢ Condition V.3 – The Division has modified Old Condition V.3 to replace “…groundwater, surface water, or leachate samples” with “…influent, treatment process water, generated reclaimed water, residual, soil, plant tissue, groundwater, or surface water samples”. Gallarda, PE August 14, 2024 Page 3 of 3 ➢ Condition V.10 – The Permittee shall pay an annual fee for each year of the term of this permit pursuant to the schedule in G.S. 143-215.3D(a). The Permittee shall continue to pay annual fees for any facility operating on an expired permit that the Division has not rescinded or revoked. ➢ Attachment A – The Division has added PPI 002 for the 500,000 GPD expansion WWTP and renamed the previous “PPI 002 – Gravity Flow Drainage System Effluent” to “PPI 003 – Groundwater Lowering System Effluent”. ➢ Attachment B – The Division has modified the permitted infiltration rates from 44.5 GPD/ft2 to 102.01 GPD/ft2 for Basin 1, 44.5 GPD/ft2 to 76.02 GPD/ft2 for Basin 2, and revised the footnotes accordingly. This permit can be contested as provided in Chapter 150B of the North Carolina General Statutes by filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative Hearings (OAH) within 30 calendar days. Requirements for filing a Petition are set forth in Chapter 150B of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code. Those interested in filing may access additional information regarding the requirements for filing a Petition and Petition forms at the OAH website or by calling the OAH Clerk’s Office at (919) 431-3000. A party filing a Petition shall serve a copy of the Petition on the Department of Environmental Quality’s Office of General Counsel at 1601 Mail Service Center, Raleigh, NC 27699-1601. If the party filing the Petition is not the Permittee, then the party shall also serve the Permittee pursuant to G.S. 150B-23(a). Included with this permit are Division-approved plans and specifications. an influent flow meter; two 2 millimeter (mm) rotary drum fine screens with a shaftless compactor; a simplex grinder station with a 55 GPM submersible pump (and an uninstalled spare) and audible/visual high-water alarms; a 54,893 gallon pre-anoxic basin with coarse bubble diffusers; two 63,303 gallon pre-aeration basins with fine bubble diffusers; four 1,634 GPM feed-forward/internal recycle pumps serving the pre-anoxic and post-anoxic basins; a 36,595 post-anoxic basin with coarse bubble diffusers; two 38,021 gallon membrane bioreactor (MBR) basins (serving as disinfection) with a total of eight 0.02 micron (µm) membrane cassettes, three 386 GPM permeate pumps, and two 80 GPM waste activated sludge (WAS) pumps; a washwater wet well with two 138 GPM submersible pumps serving the CIP system and two 40 GPM submersible pumps serving the rotary drum fine screens; a turbidimeter; an effluent sampling station; an EnviroMix BioMix™ compressed gas mixing system serving the pre-anoxic and post-anoxic basins; two 340 CFM blowers serving the pre-aeration basins; two 250 CFM blowers serving the MBR basins; a 340 CFM common standby blower; a clean-in-place (CIP) system consisting of 55 gallon storage drum and a 15 gallon per hour (GPH) chemical drum pump (and an uninstalled spare) serving the MBR basins; an alum feed system consisting of a 55 gallon storage drum and a 4.17 GPH chemical metering pump (and an uninstalled spare) serving the pre-aeration basins; an alkalinity (sodium hydroxide) feed system consisting of a 55 gallon storage drum and a 4.17 GPH chemical metering pump (and an uninstalled spare) serving the pre-aeration basins; a Micro-C (carbon) feed system consisting of a 55 gallon storage drum and a 17.2 GPH chemical metering pump (and an uninstalled spare) serving the post-anoxic basin; a peracetic acid feed system consisting of a 55 gallon storage drum and a 2 GPD chemical metering pump (and an uninstalled spare) serving the washwater wet well; an automatically activated 300 kilowatt (kW) standby generator; and all associated piping, valves, controls, and appurtenances; the WQ0037287 Version 2.2 Shell Version 230725 Page 2 of 12 continued operation of a 500,000 GPD WWTP consisting of: a static 2-inch screen with a removable trash rack; a 250,000 gallon flow equalization, glass-lined steel tank (shared with the 500,000 GPD expansion WWTP) with two 450 GPM submersible pumps and coarse bubble diffusers served by a 488 CFM blower; an influent flow meter; two 2 mm rotary drum fine screens with a washing press; a 125,000 gallon pre- anoxic/flow equalization basin with two 2.7 hp submersible mixers and three 1,200 GPM submersible pumps; three 38,130 gallon pre-aeration basins with fine bubble diffusers; a 50,604 gallon post-anoxic basin with a 2.7 hp submersible mixer; three 350 CFM positive displacement MBR basins (serving as disinfection) with a total of ten 0.04 µm membrane cassettes, three 257 GPM permeate pumps, and three 25 GPM wasting/rescreening pumps; three 350 CFM blowers serving the pre-aeration and MBR basins; a duplex 128 GPM washwater wet well; an effluent sampling station; two effluent flow meters; a 129,130 gallon aerobic digester, glass-lined steel tank (shared with the 500,000 GPD expansion WWTP) with coarse bubble diffusers served by a 785 CFM blower; a 785 CFM common standby blower; an alum feed system consisting of a 55 gallon storage drum with two 0.20 GPH chemical metering pumps serving the pre- aeration basins; a Micro-C (carbon) feed system consisting of a 55 gallon storage drum with two 0.33 GPH chemical metering pumps serving the pre-anoxic/flow equalization and post-anoxic basins; an automatically activated 400 kW standby generator; and all associated piping, valves, controls, and appurtenances; and the continued operation of a high-rate infiltration system consisting of: two 0.129 acre high-rate infiltration basins separated by 100 feet of engineered fill that meets the requirements of Session Law 2014-95; a passive groundwater lowering system with approximately 992 linear feet (LF) of 12-inch high-density polyethylene (HDPE) pipe and approximately 425 LF of 18-inch HDPE pipe; a 4,138,564 gallon groundwater lowering system effluent storage pond; and all associated piping, valves, controls, and appurtenances to serve the Pluris Hampstead WWTP, with no discharge of wastes to surface waters, pursuant to the application received on March 6, 2024, subsequent additional information received on June 6, 2024, and in conformity with the Division-approved plans and specifications considered a part of this permit. Please note that the Division has approved Alternative Design Criteria for the facility pursuant to 15A NCAC 02T .0105(n). The Division has approved the following administrative code for Alternative Design Criteria: ➢ 15A NCAC 02T .0705(j) – The Permittee shall provide multiple pumps wherever pumps are used. The Permittee shall maintain a spare replacement submersible grinder pump onsite for the 500,000 GPD expansion WWTP. ➢ 15A NCAC 02T .0705(w) – The application rate shall not exceed 10 gallons per day per square foot (GPD/ft2). This permit is effective from the date of issuance through January 31, 2026, shall replace Permit No. WQ0037287 issued on August 2, 2021, and is subject to the following conditions and limitations: WQ0037287 Version 2.2 Shell Version 230725 Page 3 of 12 I. SCHEDULES 1. In accordance with correspondence from the United States Environmental Protection Agency, any unpermitted discharge to surface waters of effluent collected via the engineered material is a violation of Section 301(a) of the Federal Clean Water Act. Accordingly, any unpermitted discharge of water from the groundwater lowering system effluent storage pond shall be prohibited and the Permittee shall report to the Wilmington Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than 24 hours, or on the next working day following the occurrence or first knowledge of the occurrence. However, please note that pursuant to Session Law 2014-95, effluent collected via the non-native material (i.e., engineered) and its associated piping system shall be considered groundwater under this permit, as long as that water is not discharged from the groundwater lowering system effluent storage pond. Accordingly, the Permittee can utilize (i.e., irrigation and amenity ponds) the water from the groundwater lowering system effluent storage pond or discharge to the NPDES Permit No. NC0089524 to maintain the required one-foot freeboard. [15A NCAC 02T .0108(b)(1)(A)] 2. The Permittee shall address the groundwater lowering system effluent storage pond’s ability to accommodate the proposed flow increase if the Permittee applies for a permit modification to increase the disposal capacity from the currently approved 573,000 GPD (102.01 GPD/ft2) for Basin 1. The Permittee can verify the storage capacity by providing freeboard records, flow records, and/or utilization records. Also, the Permittee shall verify that the approved Alternative Design Criteria pursuant to 15A NCAC 02T .0105(n) are still being met. [15A NCAC 02T .0108(b)(1)(A)] 3. Upon completion of construction and prior to operation of the permitted modifications, the Permittee shall submit an engineering certification from a North Carolina licensed Professional Engineer certifying that the permitted facility has been constructed pursuant to G.S. 143-215.1, Administrative Code Title 15A Subchapter 02T, this permit, and the Division-approved plans and specifications. For phased and partially certified facilities, the Permittee shall retain the responsibility to track further construction approved under this permit and shall provide a final engineering certification upon project completion. The Permittee shall submit the Engineering Certification via the Non-Discharge online portal. [15A NCAC 02T .0116(a)] 4. The Permittee shall notify the Wilmington Regional Office, telephone number (910) 796-7215, at least two business days in advance of the initial operation of the constructed modifications so that the Division can conduct a startup inspection. [15A NCAC 02T .0108(b)(1)(A)] 5. Within 60 days of this permit’s effective date, the Permittee shall permanently abandon monitoring well MW-1. The Permittee shall permanently abandon each monitoring pursuant to the requirements in 15A NCAC 02C .0113(d). Within 30 days of abandonment, the Permittee shall submit a Well Abandonment Record (Form GW-30) for each permanently abandoned monitoring well. The Permittee shall submit the Well Abandonment Records via the Non-Discharge online portal. [15A NCAC 02C .0113(d), 02C .0309, 02T .0108(b)(1)(B)] 6. Prior to the operation of the modified facilities, the Permittee shall submit an amended Operation and Maintenance Plan. The Permittee shall submit the amended Operation and Maintenance Plan via the Non-Discharge online portal. [15A NCAC 02T .0108(b)(1)(B), 02T .0707(a)] 7. If the permitted facilities change ownership or the Permittee changes its name, the Permittee shall submit a permit modification request on Division-approved forms within 90 days of the change of ownership. The Permittee shall comply with all terms and conditions of this permit until the Division transfers the permit to the successor-owner. [G.S. 143-215.1(d3)] 8. The Permittee shall request renewal of this permit on Division-approved forms no later than August 4, 2025. [15A NCAC 02T .0105(b), 02T .0109] WQ0037287 Version 2.2 Shell Version 230725 Page 4 of 12 II. PERFORMANCE STANDARDS 1. The Permittee shall operate and maintain the subject wastewater treatment and high-rate infiltration facilities so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities do not perform as designed, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the infiltration areas to assimilate the effluent, the Permittee shall take immediate corrective actions, including Division- required actions, such as the construction of additional or replacement wastewater treatment or disposal facilities. [15A NCAC 02T .0108(b)(1)(A)] 2. This permit shall not relieve the Permittee of its responsibility for contravention of groundwater or surface water standards resulting from the operation of this facility. [15A NCAC 02T .0108(b)(1)(A)] 3. Effluent quality shall not exceed the limitations specified in Attachment A. [15A NCAC 02T .0705(b)] 4. The Permittee shall not infiltrate effluent in exceedance of the hydraulic rates specified in Attachment B. [15A NCAC 02T .0705(m)] 5. For high-rate infiltration sites originally permitted on or after December 30, 1983, the Division has established the compliance boundary 250 feet from the infiltration area boundary or 50 feet within the property boundary, whichever is closest to the infiltration area boundary. Any exceedance of groundwater standards at or beyond the compliance boundary shall require the Permittee to take corrective action. 15A NCAC 02T .0705(y) prohibits subsurface groundwater lowering drainage systems within the compliance boundary. The Division shall note any Division-approved relocation of the compliance boundary in Attachment B. The Division shall consider multiple contiguous properties under common ownership and permitted for use as a disposal system as a single property regarding the determination of a compliance boundary. [15A NCAC 02L .0106(e), 02L .0107(b), 02L .0107(c), 02L .0107(f), 02T .0105(h)] 6. The Division has established the review boundary midway between the compliance boundary and the infiltration area boundary. Any exceedance of groundwater standards at or beyond the review boundary shall require the Permittee to take preventative action. [15A NCAC 02L .0106(d), 02L .0108] 7. The Permittee shall notify the Division of any sale or transfer of property affecting a compliance boundary (i.e., parcel subdivision). [15A NCAC 02L .0107(l)] 8. The Permittee or any landowner who owns land within the compliance boundary shall not construct any water supply wells within the compliance boundary. [15A NCAC 02L .0107(i)] WQ0037287 Version 2.2 Shell Version 230725 Page 5 of 12 9. The Permittee shall operate and maintain the permitted facilities pursuant to the following setbacks: a. The Division permitted modifications to the infiltration sites on August 14, 2024, with an application received on March 6, 2024. The setbacks for high-rate infiltration sites originally permitted or modified with an application received on or after September 1, 2018, are as follows (all distances in feet): i. Each habitable residence or place of assembly under separate ownership: 100 1, 3 ii. Each habitable residence or place of assembly owned by the Permittee: 50 iii. Each private or public water supply source: 100 iv. Non-SA surface waters: 50 4 v. SA surface waters: 100 4 vi. Groundwater lowering ditches: 50 4 vii. Surface water diversions: 50 viii. Each well with exception of monitoring wells: 100 ix. Each property line: 50 2 x. Top of slope of embankments or cuts of two feet or more in vertical height: 100 xi. Each water line: 10 xii. Subsurface groundwater lowering drainage systems: 50 4 xiii. Public right of way: 50 xiv. Nitrification field: 20 xv. Each building foundation or basement: 15 xvi. Each impounded public surface water supply: 500 xvii. Each public shallow groundwater supply (less than 50 feet deep): 500 1 Habitable residences or places of assembly under separate ownership constructed after the Division originally permitted or subsequently modified the facilities are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. 3 Pursuant to a setback waiver recorded in the Pender County Register of Deeds, reduced setbacks from the infiltration area boundary to any habitable residence or place of assembly under separate ownership are as follows: Parcel No. Deed Book / Page Setback Easement 3271-08-8507-0000 4636 / 128 106 feet 94 feet 4 Since the Permittee is meeting effluent limitations of 4 mg/L for Total Nitrogen and 2 mg/L for Total Phosphorus, the Division has reduced setbacks to non-SA surface waters, groundwater lowering ditches, and subsurface groundwater lowering drainage systems from 200 feet to 50 feet., and setbacks to SA surface waters from 200 to 100 feet. The Division permitted modifications to the existing 500,000 GPD WWTP on August 2, 2021, with an application received on March 23, 2021. The Division originally permitted the 500,000 GPD expansion WWTP on August 14, 2024, with an application received on March 6, 2024. The setbacks for treatment and storage units originally permitted or modified with an application received on or after September 1, 2018, are as follows (all distances in feet): i. Each habitable residence or place of assembly under separate ownership: 100 1 ii. Each private or public water supply source: 100 iii. Surface waters: 50 iv. Each well with exception of monitoring wells: 100 v. Each property line: 50 2, 3 1 Habitable residences or places of assembly under separate ownership constructed after the Division originally permitted or subsequently modified the facilities are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. 3 Pursuant to a setback waiver recorded in the Pender County Register of Deeds, reduced setbacks from the treatment and storage units to any property line are as follows: Parcel No. Deed Book / Page Setback Easement 3271-08-8507-0000 4636 / 128 45 feet 5 feet [15A NCAC 02T .0706(d), 02T .0706(e), 02T .0706(f), 02T .0706(g)] III. OPERATION AND MAINTENANCE 1. The Permittee shall operate and maintain the subject facilities as a non-discharge system. [15A NCAC 02T .0101] 2. The Permittee shall maintain an Operation and Maintenance Plan, which shall include: a. A description of the operation of the system in sufficient detail to show what operations are necessary for the system to function and who shall conduct the operations. b. A description of the anticipated maintenance of the system. c. Provisions for safety measures, including restriction of access to the site and equipment. d. Spill control provisions that include response to upsets and bypasses, including control, containment, and remediation; and contact information for personnel, emergency responders, and regulatory agencies. [15A NCAC 02T .0707(a)] 3. Upon the Water Pollution Control System Operators Certification Commission’s (WPCSOCC) classification of the subject non-discharge facilities, the Permittee shall designate and employ a certified Operator in Responsible Charge (ORC), and one or more certified operators as Back-up ORCs. The ORC or its Back-up shall operate and visit the facilities as required pursuant to 15A NCAC 08G .0204 and 08G .0205. [15A NCAC 02T .0117] 4. The Permittee shall test and calibrate the infiltration equipment annually. [15A NCAC 02T .0707(d)] 5. The Permittee shall only infiltrate treated effluent from the Pluris Hampstead WWTP onto the sites listed in Attachment B. The Permittee shall not allow vehicles or heavy machinery on the infiltration area, except during equipment installation or maintenance activities. The Permittee shall take caution to protect the integrity of the infiltrative area. [15A NCAC 02T .0707(e)] 7. The Permittee shall prohibit public access to the wastewater treatment, storage, and infiltration facilities. [15A NCAC 02T .0705(p)] 8. The Permittee shall dispose of or utilize generated residuals in a Division-approved manner. [15A NCAC 02T .0708, 02T .1101]. 9. The Permittee shall not divert or bypass untreated or partially treated wastewater from the subject facilities. [15A NCAC 02T .0705(i)] 10. The Permittee shall maintain a freeboard of not less than two feet in the high-rate infiltration basins. The Permittee shall maintain a freeboard of not less than one foot in the groundwater lowering system effluent storage pond. [15A NCAC 02T .0705(c)] 11. The Permittee shall provide gauges to monitor freeboard levels in the high-rate infiltration basins and groundwater lowering system effluent storage pond. These gauges shall have readily visible permanent markings, at inch or tenth of foot increments, indicating the following elevations: the maximum liquid level at the top of the temporary liquid storage volume, the minimum liquid level at the bottom of the temporary liquid storage volume, and the lowest point on top of the dam. The Permittee shall establish and maintain a protective vegetative cover on all berms, pipe runs, erosion control areas, surface water diversions, and earthen embankments (i.e., the outside toe of the embankment to the maximum allowable temporary storage elevation on the inside of the embankment). The Permittee shall remove all trees, shrubs, and other woody vegetation from earthen dikes and embankments. The Permittee shall keep all earthen embankments mowed or otherwise controlled and accessible. [15A NCAC 02T .0707(g)] 13. The Permittee shall test and calibrate metering equipment annually. [15A NCAC 02T .0707(d)] 14. The Permittee shall provide and maintain onsite an automatically activated standby power source capable of powering all essential treatment units. If the Permittee employs a generator as an alternate power supply, the Permittee shall test it weekly. [15A NCAC 02T .0705(k)] 15. The Permittee shall clean the infiltration areas once per permit cycle to remove deposited materials that may impede the infiltration process. The Permittee shall maintain cleaning records at the facility for eight years and shall make them available to the Division upon request. Prior to each cleaning, the Permittee shall notify the Wilmington Regional Office, telephone number (910) 796-7215. [15A NCAC 02T .0707(h)] IV. MONITORING AND REPORTING 1. The Permittee shall conduct and report any Division-required monitoring, including the monitoring of groundwater, surface water or wetlands, waste, wastewater, residuals, soil, treatment processes, lagoon or storage ponds, plant tissue, and aquatic biota, if necessary to evaluate this facility’s impact on groundwater and surface water. [15A NCAC 02T .0108(c)] 2. A Division-certified laboratory shall conduct all analyses for the required parameters specified in Attachments A and C. Parameters measured on-site with in-line metering equipment are exempt from a Division-certified laboratory analysis. [15A NCAC 02H .0805] 3. The Permittee shall continuously monitor flow through the treatment facility and report daily flow values on Form NDMR. Facilities with a permitted flow of less than 10,000 GPD may estimate its flow from water usage records provided the water source has a metering device. The Permittee shall monitor the treated effluent at the frequencies and locations for the parameters specified in Attachment A. [15A NCAC 02T .0105(k), 02T .0108(c)] 5. The Permittee shall maintain records tracking the amount of effluent infiltrated, which shall include the following information for each infiltration site listed in Attachment B: a. Date of infiltration. b. Volume of effluent infiltrated. c. Site infiltrated. d. Length of site infiltration time. e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings. f. Continuous monthly and year-to-date loadings for any non-hydraulic parameter specifically limited in Attachment B. g. Weather conditions. [15A NCAC 02T .0108(c)] 6. The Permittee shall measure and record weekly to the nearest inch or tenth of a foot of freeboard (i.e., the waste level to the lowest embankment elevation) in the high-rate infiltration basins and groundwater lowering system effluent storage pond. The Permittee shall maintain the weekly freeboard records for eight years and shall make them available to the Division upon request. [15A NCAC 02T .0108(c)] 7. On or before the last day of the month following the previous month’s sampling, t he Permittee shall submit monitoring data (as specified in Conditions IV.3 and IV.4) on Form NDMR for each PPI and operation and disposal records (as specified in Conditions IV.5 and IV.6) on Form NDAR-2 for every site in Attachment B. If no activities occurred during the monitoring month, the Permittee shall still submit monitoring reports documenting the absence of the activity. The Permittee shall submit the reports via the Non-Discharge monitoring report portal. [15A NCAC 02T .0105(l)] 8. Pursuant to G.S. 143-215.1C(a), the Permittee shall provide to its users and the Division an annual report summarizing the performance of the wastewater treatment and infiltration facility and the extent to which the facility has violated this permit, or federal or state laws, regulations, or rules related to the protection of water quality. The Permittee shall prepare this report on either a calendar or fiscal year basis and shall submit it no later than 60 days after the end of the calendar or fiscal year. The Permittee shall submit the annual report via the Non-Discharge online portal. [G.S. 143-215.1C(a)] 9. The Permittee shall maintain records of all residuals removed from this facility. The Permittee shall maintain these records for eight years and shall make them available to the Division upon request. These records shall include: a. Name of the residuals hauler. b. Non-Discharge permit number authorizing the residuals disposal, or a letter from a municipality agreeing to accept the residuals. c. Residuals hauling date. d. Volume of residuals removed. [15A NCAC 02T .0708(b)] 10. The Permittee shall keep a log of all maintenance done at this facility. The Permittee shall maintain this log for eight years and shall make it available to the Division upon request. This log shall include: a. Date of flow measurement device calibration. b. Date of infiltration equipment calibration. c. Visual observations of the plant and plant site. d. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections, cleanings, etc.). e. Date and results of the alternate power supply testing. f. The Permittee shall sample monitoring wells MW-2, MW-3, and MW-4 at the frequencies and for the parameters specified in Attachment C. [15A NCAC 02T .0105(m)] 12. On or before the last day of the month following the previous month’s sampling, the Permittee shall submit a Compliance Monitoring Form (GW-59) and its associated laboratory analyses for each monitoring well in Attachment C. The Permittee shall submit the Compliance Monitoring Forms via the Non-Discharge monitoring report portal. [15A NCAC 02T .0105(m)] 13. Noncompliance Notification: The Permittee shall report to the Wilmington Regional Office, telephone number (910) 796-7215, within 24 hours of first knowledge of the following: a. Treatment of wastes abnormal in quantity or characteristic, including the known passage of a hazardous substance. b. Any process unit failure (e.g., mechanical, electrical, structural, etc.) that makes the facility incapable of adequate wastewater treatment. c. Any facility failure resulting in a discharge to surface waters. d. Any time self-monitoring indicates the facility has gone out of compliance with its permit limitations. e. Overflow from the groundwater lowering system effluent storage pond. f. Effluent breakout from the infiltration sites. Emergencies requiring reporting outside normal business hours shall call the Division’s Emergency Response personnel at the telephone number (800) 858-0368. All noncompliance notifications shall file a written report to the Wilmington Regional Office within five days of first knowledge of the occurrence, and this report shall outline the actions proposed or taken to ensure the problem does not recur. [15A NCAC 02T .0108(b)(1)(A)] V. INSPECTIONS 1. The Permittee shall perform inspections and maintenance to ensure proper operation of the wastewater treatment and infiltration facilities. [15A NCAC 02T .0707(j)] 2. The Permittee shall inspect the wastewater treatment and infiltration facilities to prevent malfunctions, facility deterioration, and operator errors that may result in discharges of wastes to the environment, threats to human health, or public nuisances. The Permittee shall maintain an inspection log that includes the date and time of inspection, observations made, and maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for eight years from the date of the inspection and shall make this log available to the Division upon request. [15A NCAC 02T .0707(i), 02T .0707(j)] 3. Division-authorized representatives may, upon presentation of credentials, enter and inspect any property, premises, or place related to the permitted wastewater treatment and infiltration facilities at any reasonable time for determining compliance with this permit. Division-authorized representatives may inspect or copy records maintained under the terms and conditions of this permit and may collect influent, treatment process water, effluent, residual, soil, plant tissue, groundwater, or surface water samples. The Permittee’s failure to comply with this permit’s conditions and limitations may subject the Permittee to a Division enforcement action. [G.S. 143-215.6A, 143-215.6B, 143-215.6C] 2. This permit is effective only for the nature and volume of wastes described in the permit application and Division-approved plans and specifications. [G.S. 143-215.1(d)] 3. There are no variances to administrative codes or general statutes governing the construction or operation of the permitted facilities unless the Permittee specifically requested a variance in the application and the Division approved the variance as noted in this permit’s facility description. [15A NCAC 02T .0105(b)] 4. This permit does not exempt the Permittee from complying with all statutes, rules, regulations, or ordinances that other jurisdictional government agencies (e.g., local, state, and federal) may require. [15A NCAC 02T .0108(b)(1)(A)] 5. The Permittee shall retain this permit and the Division-approved plans and specifications for the life of the permitted facilities. The Permittee shall comply with all permit conditions and requirements until the proper closure of the permitted facilities, or until another appropriate authority permits the facilities. [15A NCAC 02T .0105(j)] 7. This permit is subject to revocation or modification upon 60-day notice from the Division Director in whole or part for: a. Violation of any terms or conditions of this permit or 15A NCAC 02T. b. Obtaining a permit by misrepresentation or failure to disclose all relevant facts. c. The Permittee’s refusal to allow authorized Department employees upon presentation of credentials: i. To enter the Permittee’s premises where a system is located or where the Permittee keeps any Division-required records under the terms and conditions of this permit. ii. To have access to any permit-required documents and records. iii. To inspect any monitoring equipment or method as required in this permit. iv. To sample any pollutants. d. The Permittee’s failure to pay the annual fee for administering and compliance monitoring. e. A Division determination that the conditions of this permit conflict with the North Carolina Administrative Code or General Statutes. Unless the Division determines that the Permittee needs a permit modification for the construction of facilities to resolve non-compliance with any environmental statute or rule, or the Division Director grants a variance, expansion of the permitted facilities shall not occur if any of the following apply: a. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has been convicted of environmental crimes under G.S. 143-215.6B or under Federal law that would otherwise be prosecuted under G.S. 143-215.6B, and the Permittee or any parent, subsidiary, or other affiliate of the Permittee has abandoned or exhausted all appeals of this conviction. b. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has previously abandoned a wastewater treatment facility without properly closing the facility in accordance with its permit or 15A NCAC 02T. c. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid a civil penalty, and the Permittee or any parent, subsidiary, or other affiliate of the Permittee has abandoned or exhausted all appeals of this penalty. d. The Permittee or any parent, subsidiary, or other affiliate of the Permittee is currently not compliant with any compliance schedule in a permit, settlement agreement, or order. e. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid an annual fee pursuant to 15A NCAC 02T .0105(e)(2). [15A NCAC 02T .0120(b), 02T .0120(d)] 9. Unless the Division Director grants a variance, the Division shall not renew this permit if the Permittee or any affiliation has not paid an annual fee pursuant to 15A NCAC 02T .0105(e)(2).
