Division of Water Quality Raleigh Regional Office 3800 Barrett Drive Raleigh, NC 27609 Re: Hotel Sierra: The Market at Perimeter Park, Morrisville, NC DWQ Project No. 2007-1998 Ms. Karoly & Ms. Witherspoon: Environmental Services, Inc., (ESI) is providing this information on behalf of Duke Construction pursuant to your letter dated 18 December 2007. Duke Construction is applying for authorization from DWQ to impact a portion of the riparian buffer associated with a tributary to Stirrup Iron Creek. Your recent letter requested additional information for three (3) items. I have included your concerns below followed by the applicant's response. 1.) Provide documentation that the proposed scour hole will provide diffuse flow. The DWQ BMP manual states that the slopes must not exceed 4%. The project engineer [ANC Engineering, Inc.] was able to shift the location of the low flow outlet and scour hole to a new location where the natural slope to the adjacent stream bank is less than 4%. The attached figures depict the new location. This revision should satisfy DWQ's concerns regarding the scour hole and slope. 2.) The proposed mulch path is currently proposed in both Zones 1 and 2. Please reconfigure to show the mulch path in Zone 2 only. The project engineer and the applicant have agreed to reconfigure the proposed mulch path to avoid Zone 1 impacts. The revised location is depicted on the attached FLORIDA • GEORGIA • NORTH CAROLINA • SOUTH CAROLINA ENVIRONMENTAL SERVICES, INC. drawings. Zone 2 impacts resulting from the proposed mulch path now tota12,370 feetz (0.05 acre). No impacts to Zone 1 are proposed to result from the new mulch path location. 3.) The detention pond outlet will need to be moved from the buffer. Please reconfigure your plan sheet to show this change. The project engineer has moved the outlet to be just outside the riparian buffer. The necessary bypass ditch for the 10-year storm event must remain in the buffer and is depicted on the attached figures. Buffer impacts resulting from the bypass ditch include the following: Zone 1 = 310 ftz; Zone 2 = 350 ftz.
