Thanks for talking to me this morning. Just want to confirm that if Wal-Mart signs the "Filter Strip,
Restored Riparian Buffer and Level Spreader Inspection and Maintenance Agreement" ("Agreement"),
Wal-Mart will not be obligated to install or maintain any of the BMP elements if Wal-Mart chooses to not
develop the property. Of course, if Wal-Mart develops the property, it would be required to adhere to the
terms of the Agreement.
I would appreciate it if you would confirm that this is accurate. Thanks for your help.
