Director NORTH CAROLINA Environmental Quality August 09, 2024 Certified Mail # 7017 2680 0000 2236 6422 Return Receipt Requested Jack Meadows, Interim Town of Siler City PO Box 769 Siler City, NC 27344 Dear Mr. Meadows: Town Manager Subject: Notice of Violation and Intent to Assess Stipulated Penalties Tracking Number: NOV-2024-SP-0011 Special Order by Consent: WQ S22-003 Siler City Collection System Permit Number: WQCS00056 Chatham County The subject Special Order by Consent WQ S22-003 (SOC) contains terms and conditions agreed to by the Town of Siler City (permittee) and the North Carolina Environmental Management Commission that were established to promote the subject facility's expedited return to consistent compliance with applicable environmental laws, rules and/or permit conditions. The SOC includes an enforceable compliance schedule and provision for the assessment of stipulated penalties when SOC terms and conditions are not met. Section 2 (a) of the SOC requires the permittee to have completed the following scheduled activity by March 30, 2024: Award Construction Contract for ARPA Sewer Rehabilitation Project. The due date was extended to June 28, 2024, at the request of the permittee. According to the Quarterly SOC Progress Report received from the permittee on July 30, 2024, the Award Construction Contract for ARPA Sewer Rehabilitation Project was not completed by the due date of June 28, 2024, therefore the permittee is in violation of Section 2 (a) of SOC WQ S22-003. Section 5 (c) of the SOC stipulates the following penalties for failure to complete a scheduled activity by the assigned due date: $1,000 per day for the first seven (7) calendar days and $2,000 per day thereafter. If you have information that will prove to the Division of Water Resources (DWR) that any or all the criteria set forth in Section 2 (a) were met by the due date of June 28, 2024, this information must be submitted in writing to the Raleigh Regional Office (RRO) within ten (10) days after your receipt of this notice. In the absence of evidence justifying the application of the provisions within the SOC, DWR may proceed with assessment of stipulated penalties as provided for in Section 5 (c) of the SOC.
