Further, the location of the proposed marina is approximately 3.6 miles up -river from the Section 10 portion of the Catawba River (Mountain Island Lake Dam). The floating marina will be supported using metal and wooden piles, driven into the lakebed until refusal. There will be no concrete used to support these structures. The Corps does not consider the installation of piles without the use of concrete to be a discharge of fill, but rather, but rather de minimus and a method of avoidance and minimization. Based on the above referenced information, the proposed activity will not require a Section 10 or Section 404 Department of the Army permit from our office. You may proceed with your project as proposed, provided you obtain any required local and state permits. Please reach out with any additional questions. Doug J.
