Please find your comments listed below with our response provided in bold. 1.15A NCAC 02H.1042(2)(a)(iv): As previously noted in Item 2 of the previous request of additional info,the deed restriction with attached BUA table does not correspond to the listed BUA on the application.The response confirmed that tracts#143 will obtain their own offsite permits in the future. Please address the following: A. The BUA table for the deed restrictions identifies the allocations for each of the tracts, however this isn't clearly represented in the application. In section IV.10 of the application these tracts that have been given a BUA allocation should be listed as onsite instead of future and offsite.This onsite lot BUA allocation should match the deed restrictions and attachment B. • See revised deed restriction draft copy pages 1 and 2 that matches the SWU-101 Form BUA total of 1,524,600 sf(sum of Tract 1 and 2 and 3)(378,772+453,212+ 692,616 sf). B. In section IV.10 of the application the allocated BUA for streets and sidewalks are not clearly represented on the deed restriction document for tracts#1 and#2. To sum 1. 15A NCAC 02H. 1042(2)(a)(vii)-(ix)and Permit Conditions 8 and 13: Land Ownership.The current permit lists WNDP#2, LLC as the developer and Dry Pond Partners, LLC as the property owner. During the review,WNDP#2, LLC was found to have obtained Tract#3 in the development in July 2022. In order to resolve this issue, please use one of the following options or present another alternative for consideration: A.Complete the full application form,SWU-101,to list WNDP#2 as applicant, developer, and partial property owner and Dry Pond Partners as the partial property owner. Note that since there is a second property owner,they must sign as a second property owner on the application. By signing the application,that shows they have agreed to this as a type of Development Agreement. In addition,the Operation and Maintenance Agreements must be signed accordingly. Please also ensure that all signatures are originals as opposed to copies. or, B.Since Tract#3 is recently delineated and now owned by WNDP#2, LLC and all other tracts are owned by Dry Pond Partners, LLC,Tract#3 could be subdivided as part of this modification (along with any other tracts intended to be subdivided)and an offsite permit could be obtained for development on those lots. If there are other tracts or outparcels that will eventually be sold, it is better to set them up as offsite permits. Note that tract boundary lines will need to be shown on the plans to clarify where BUA is located. • We are proceeding with option B. The current permit SW8 210614 will be the master permit under Dry Pond Partner, LLC(DPP)solely. Since we have 4 tracts and DPP as the entire landowner,and a developer of the Timbers at Whiskey Branch currently listed as WNDP #2, LLC,we'll proceed with the offsite permit option for tracts 1-3 and tract 4 has the pond on it with no impervious assigned. As proposed only Tract 3 will be the only offsite permit for now, which is described by deed restrictions for the 44 single family lots and 46 duplex lots. Please note that the built-upon area should be presented in square feet instead of acres as shown in the spreadsheet. This allocation should match the deed restrictions and Attachment B, included as part of the deed restrictions. Also reference item#6. • See updated BUA Table. Please provide a signed,sealed, and dated spreadsheet. • Provided BUA Table with signed and sealed by Engineer. 4. 15A NCAC 02H.1042(2)(g)(ii)-(v): The application package did not include all plan sheets. In an effort to prepare the files for scanning and digitization, please provide two signed,sealed and dated paper copies of the entire plan set for the site. More specifically, please reference the items below: A. The application package did not include a site plan with the project limit bearings and distances(previous plan sheet C-2.0). B.If information is available for Tract 2, a site layout and grading plan for the proposed apartment buildings. ee Tract 2 is proposed multi-family and a development plan is not ready for this area at this time. It should be more clearly shown now. 6. 15A NCAC 02H.1003(7)and .1042(2)(k): The approved amounts of impervious(BUA)allocation for Tract 1 and Tract 2 of the recorded Declaration of Easements, Restrictions, and Cost-Sharing Provisions document(DERCSP)do not match the amounts listed on the new spreadsheet,which was submitted to document the breakdown of BUA. It appears that paragraph 3(f)of this recorded document and/or Attachment B will need to be revised. Please provide a copy of this proposed DERCSP document, along with a signed agreement to provide the final recorded versions. Alternately, please provide a revised,final recorded DERCSP document. • The DERCSP signed document will be revised once NCDEQ has reviewed the permitting included herein and we understand the breakdown of BUA before re-recording numbers. 7. 15A NCAC 02H.1042(2)(a)(i): It appears that the project name may be changing as shown on the plan cover sheet as `Timbers at Whiskey Branch". If so, please submit an additional "Permit Information Update App Form"or submit the regular permit application form with the revised project name on Form SWU-101 and mark it up as "Minor Modification." This permit has a developer and property owner. They have sold a section of residential tracts to another developer,similar to Avalon (SW8 060750)with its four owners. Option 1 is somewhat consistent with how we decided to handle Avalon by allowing the permit application to serve as the Development Agreement between a developer and several property owners(homebuilders who bought lots in the subdivision). The difference is that Avalon is transferring from one developer to another and the transfer application has the option for developers and property owners to sign independently. For that transfer, I had the current perm ittee/deve lope r, proposed permittee/developer,and all four property owners sign. Steve's project is a minor modification,and the signature block is not as extensive. It only has the"current permittee". If we want to do this I would recommend continuing the review as a minor modification but using the SWU-101 form because it has a more extensive signature block. The developer can sign as the developer, and both property owners can sign (one of which is the developer). Option 2 is to subdivide a tract(23 duplex units)owned by the new owner in the master permit and have the new owner get an offsite permit. The third option would be for them to become co-permittees, but I never encourage that. I have excluded that as an option for now. There is a deed on file from the first review. There is a lengthy description of the land in the deed, but it does not reference a plat(map book/page). (It instead references concrete monuments and is difficult to understand the exact location of the land.) But, it appears that the whole tract was owned by Dry Pond for the last permit issuance. Option 1: You currently have an application with WDNP#2, LLC as the developer and Dry Pond Partners, LLC as the landowner. By signing the application that shows they have agreed to this as a type of Development Agreement. 2. Option 2: Subdivide Tract 3 in SW8 210614 and have that owner get an offsite permit. Since Dry Pond no longer owns Tract 3,they would modify SW8 210614 to subdivide Tract 3 and allocate a total BUA to that tract. If they are planning to develop Tract 3,then the owner of Tract 3 (currently WNDP#2, LLC)would apply for an offsite permit to SW8 210614. It looks like they are re-allocating BUA for SW8 210614, including the BUA on Tract 3. The details for what will be built on Tract 3 would need to instead be covered by and tracked under that offsite permit if they choose this option. I would also ask them if the duplexes on Tract 3 will have"yard" because I do not see lot lines on the plans. If the homes will be sold with the footprint of the building then there is nothing to subdivide or deed restrict. But, if each duplex unit will have a yard then they need lot lines on the plans and each home needs to be deed restricted.
