The proposed dock will have four (4) slips be used as dockage for our personal boats and watercraft and the crafts of our guests. No other services will be offered at this facility. The dock will be floating concrete sections 10 ft x 10 ft times eight (8) units. The pier will be constructed of steel beams, supported by mono steel pile construction and decked with concrete hog slats. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that maybe required. NOTE: Future development of the permittee's property may require a modification of this permit. CC: Tere Barrett, DCM Ted Tyndall, DCM Tracy Wheeler, USACE Asa Dail November 26, 2007 Page 2 of3 corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 5 Any portion of the permitted access pier and docking facilities built over wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 6 No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7 The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8 The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9 This permit authorizes a maximum of four boat slips. At no time shall more than four vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 10 The permittce will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The pcrmittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 1 1 In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 12 The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 13 Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 14 Any development or land disturbing activity that is considered non-water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Neuse River buffer regulations in place at the time of such development. e~~ ~- NCDENR North Carolina Department of Environment and Natural Resources Division of Coastal Management Michael F. Ross Jr., Secretary MEMORANDUM DATE: November 26, 2007 TO: Doug Huggett THRU: Tere Barrett FROM: Brad Connell ~~ SUBJECT: Comments and Recommendations - CAMA Major Permit -Asa Dail, Pamlico County The following is my assessment and consequent recommendations of the above referenced proposal: The project, as proposed, will have minimal environmental impacts. The proposed docking facility is 50' waterward into the 200' wide waterbody, and side-to dockage- may pose a threat to navigation. This proposal is not in conflict with the current usage of Upper Broad Creek, and this waterbody should not be deleteriously affected. There was not any observable submerged aquatic vegetation at the time of the field investigation. However, it should be noted that the presence of SAV is in the immediate vicinity. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 2 The authorized stntctures and associated activity must not cause an unacceptable interference with navigation, and shall not exceed 50' waterward of the nwl. 3 This permit authorizes, only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. Upper Broad Creek is about 200' wide at this location and the docking facility will be about 50' from the centerline of the creek. 11. Anticipated Impacts: The fixed pier leading down to the floating docking facility will shade 600 square feet of coastal vegetation and 456 square feet of Section 404 wetlands. The floating docking facility will shade 60 square feet of shallow bottom habitat and 890 square feet of open water habitat. Although the presence of submerged aquatic vegetation was not observed at the time of the field investigation, the presence of SAV was observed in the nearby vicinity. Water depths in the docking facility project area range from -0.5' to -20.5' nwl. This docking facility will be shared by two waterfront lots with a total platform area of 800 square feet and four wet slips and will be 50' waterward of the 200' wide waterbody (nwl). The side-to slip on the outside is to accommodate a 65' long and 17' wide vessel. Thus, the wet slip will extend farther than '/a of the width of the waterbody and could possibly be a hazard to navigation. Narrative Description: The property is 2.8 acres that is currently divided up into two lots (Lot #4 & #5) on N. Berne Landing Road off of Lees Landing Road near Reelsboro, Pamlico County. The combined property has 299' of shoreline. As a part of the purchase agreement with Weyerhaeuser Real Estate and Development Company, the applicant wishes to develop the property with afour-slip docking facility on the southwest side of the property on Upper Broad Creek, a tributary of Neuse River in Pamlico County. The property is currently undeveloped with no existing man-made features. North Berne Landing Road is a gravel road used to access the Weyerhaeuser tract, directly northwest of the WRC Lees Landing public boat ramp. The property consists of a post-harvest upland pine plantation bordered by wooded Section 404 and coastal wetlands to the southwest. Along the shoreline, there is a span of approximately 0.5 acres of coastal wetlands and 0.3 acres of Section 404 wetlands. The elevation of the tract is +8.0' nwl. The width of Upper Broad Creek at its most constrictive point on the property is approximately 200' across. Water depths in the project area range from -0.5' to -20.5' nwl. None of the project area has submerged aquatic vegetation, however SAV was observed in the immediate vicinity. There are no permanent mooring facilities adjacent to this property. The adjacent lots in this new subdivision are also currently undeveloped. The Pamlico County Land Use Plan has classified this area as Rural with Services, with CAMA AEC's classified as Conservation. The headwaters of Upper Broad Creek are inland waters and are not designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SC; Sw, NSW. There is no evidence of a shellfish resource. 10. Proposed Development: The request is for a private four-slip docking facility to serve the owner of two adjoining lots. The construction of the docking facility will take place within Upper Broad Creek on the southwestern portion of the property, sharing the property line for Lot #4 & #5. An elevated pier will connect the high ground through the Section 404 and coastal wetlands to the docking facility platform.
