Section D: Summary of Finding/Comments (Attach additional sheets of narrative and checklists as necessary) On July 11th, 2024, Ron Boone and Michael Gearren, of the Winston-Salem Regional Office of the NC Division of Water Resources, attempted to conduct a compliance evaluation inspection of the Rich Fork Creek Operation sand dredging facility in Davidson County. This facility discharges to Rich Fork Creek covered by NPDES general permit NCG520000, certificate of coverage NCG520091. DWR's database indicates the site is owned by Jamie James. Attempts to contact Mr. James at the phone number listed in the database were unsuccessful. Mr. Boone and Mr. Gearren visited the only address listed in the database: 217 John Deere Ln, in Lexington, Davidson County, NC. They were able to make contact with Jacob James at the John Deere Ln address, who is the son of Jamie James. He informed Mr. Boone and Mr. Gearren that Jamie James had passed away several years prior, and that a real estate company had purchased the property where the Rich Fork Creek operation is located. After asking Jamie James for a more accurate location of the Rich Fork Creek Operation, Mr. Boone and Mr. Gearren proceeded to the site. The site was gated, closed, and inactive. Documentation found onsite for a construction stormwater permit showed the current owner as Kennedy Real Estate Holding, LLC. The Division of Energy, Mineral, and Land Resources was able to provide contact information for Kennedy Real Estate Holding, LLC. Mr. Boone was able to contact Cale Kennedy post inspection. Mr. Kennedy expressed interest in maintaining the permit. Mr. Boone sent him a copy of the ownership change form and instructed him on how to fill it out and send it in to DWR's Central Office for update. These sites are subject to inspection by DWR once every five years. Mr. Boone will schedule an inspection at the site with you in the future. We've attached a copy of the general permit. The permit requires certified analysis of effluent from the facility for turbidity twice annually. This analysis must be done by a NC certified laboratory. We also attached a listing of currently certified labs in NC.
