Dear Mr. Harwood:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

In compliance with the provisions of North Carolina General Statute 143-215.1,
other lawful standards and regulations promulgated and adopted by the North Carolina
Environmental Management Commission, and the Federal Water Pollution Control Act,
as amended, the
AQUA North Carolina, Inc.
is hereby authorized to discharge wastewater from a facility located at the
Rand Meadows Phase II WTP
NCSR 1010 and Rand Road
Wake County
to receiving waters designated as an unnamed tributary to Juniper Branch in the Neuse
River Basin in accordance with effluent limits, monitoring requirements, and other
conditions set forth in Parts I, II, III, and IV hereof.
This permit shall become effective May .1, 2008.
This permit and authorization to discharge shall expire at midnight on April 30, 2013.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked.
As of this permit issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions included herein.
AQUA North Carolina, Inc. is hereby authorized to:
1. Operate a sand, garnet and anthracite drinking -water treatment facility located at
Rand Meadows Phase It Subdivision, NCSR 1010 and Rand Road in Wake County,
and
2. Discharge from said treatment works at the location specified on the attached map
into an unnamed tributary to Juniper Branch, currently classified C-Nutrient
Sensitive Waters in the Neuse River Basin.

Footnotes:
1. For instantaneous flow measurement, the duration of the discharge shall be reported in addition to the total flow.
2. Fluoride should be monitored if the permittee fluoridates at the facility.
3. Zinc shall be monitored if the permittee uses any zinc -based additive in the water treatment process.
4. For a given wastewater sample, TN=TKN+NO3N+NO2N, where TN is Total Nitrogen, TKN is Total Kjeldahl
Nitrogen, and NO3N and NO2N are Nitrate and Nitrite Nitrogen, respectively.
5. TN Load is the mass quantity of Total Nitrogen discharged in a given period of time. See Special Condition A.
(2.), Calculation of TN Loads.
6. Total Residual Chlorine limit and monitoring requirement apply only if chlorine is used in the treatment -process.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
All samples collected shall be from representative discharge events.

A. (2.) CALCULATION OF TOTAL NITROGEN LOADS
a. The permittee shall calculate monthly and annual TN Loads as follows:
L Monthly TN Load (lbs/month) = TN x TMF x 8.34
Where:
TN = average TN concentration (mg/L) of the composite samples collected during the
month
TMF = Total Monthly Flow of wastewater discharged during the month (MG/month)
8.34 = conversion factor, from (mg/L x MG) to pounds
H. Annual TN Load (lbs/year) = Sum of the 12 Monthly TN Loads for the
calendar year
b. The permittee shall report monthly Total Nitrogen results (mg/L and lbs/month) in the
discharge monitoring report for that month and shall report each year's annual results (lbs/year)
in the December report for that year.

You can check "other" but the facility should still be permitted as a "greensand
filter". The "greensand" characterization is meant to capture a variety of filter
systems that do not use a brine recharge.

I'm working on the amended application form. Under the Item 5. Type of Treatment
Plant, should I uncheck greensand and insert a line indicating that the filter
system is sand, garnet and anthracite? Or should I list the system as Other -
(sand, garnet and anthracite)?

I would like to take this opportunity to respond to your comments:
* Thanks, for catching the error found in footnote 2 regarding
fluoride. It has been corrected to read "fluoridates" rather
than "uses chlorine." * With respect to removing Total Zinc and Fluoride
from the
permit, we cannot. The permit merely requires you to monitor
these parameters * if * they are used in the treatment process.
* The requirement to monitor pH is not new to this permit; it is
carried over from and located in this facility's existing
permit. It is a parameter we require in permits like Rand
Meadows. Specifically, it is required by North Carolina's
Administrative Code (T15A NCAC 2B .0500).

After review of this draft permit there are a few discrepancies that I have noted.

The draft permit indicates the filters as being greensand; however they are sand,

The raw water inorganic chemical analysis (attached) shows the pH at 7.7 mg/l,
there is nothing in this process that would change the pH of the water where it

would be t6.0 or >9-0, therefore I am requesting that the pH not be a requirement
as the other NPDES permits don't require this. This seems to be an added
expense that we shouldn't have to incur.

On the August 27, 2004 permit Fluoride was listed with a footnote M. Fluoride

should be monitored if the Permittee fluoridates its finished water

product." which we do not. The new draft permit footnote states "2. Fluoride
should be monitored if the permittee uses chlorine at the facility."
We do not treat any type of fluoride; however we do treat Sodium Hypochlorite
for disinfection. The raw water inorganic chemical analysis (attached) shows the
fluoride well below the MCL; therefore I am requesting that the fluoride be
removed from the permit as this is just an added expense that we shouldn't have

Total Zinc can be removed from the permit at we do not add zinc -based additives
in the water treatment process.

Total Suspended Solids (TSS) - would it be possible to sample this on a monthly

I wanted to send an email regarding the permit renewal for the Rand Meadows Phase II WTP
NC0087998. I have attached a Sludge Management Plan for the facility in response to your October 16,
2007 letter requesting the additional information. I will also mail you the original copy. I am currently trying
to determine who the original engineer for the design of the facility. Per your phone message, the facility
has no Engineer Certification on record. I will verify for you whether the facility is complete. Please let me
know if you need any additional information.

SLUDGE MANAGEMENT PLAN
Facility Name: Rand Meadows Phase H WTP
The sludge removal will consist of passing filter backwash water through a sand filter bed which
in turn goes to effluent stream discharge. Sludge management for this facility consists of the
raking of sludge from, the sand filter and haul to a landfill by Aqua North Carolina, Inc. The
removal service will occur regularly on an as needed basis as determined by Aqua North
Carolina, Inc. operating personnel.
Sludge Collection and Disposal shall conform to 40 CFR 503 of the Clean Water Act.
Every shipment of sludge will be recorded in a log book. This log book will provide a record of:
1. date of shipment
2. volume removed off site
3. destination of sludge
Sludge Collection and Disposal Tracking:
Authorized Representatives shall document each shipment.
