In accordance with the application for discharge permit received, the Division is forwarding
herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
The final permit authorizes the discharge of wastewater from the Buckeye Creek Wastewater
Treatment Plant to the Thunderhole Creek, a class C water in the Catawba River Basin after
receiving an Authorization to Construct permit from the Division of Water Quality, Construction
Grants and Loans Section. The permit includes discharge limitations/or monitoring for flow,
BODS, ammonia nitrogen, total suspended solids, dissolved oxygen, total residual chlorine, fecal
coliform, total nitrogen, total phosphorus and pH.
The following procedure has been implemented by DWQ: Total residual chlorine (TRC)
compliance level changed to 50 ug/l. Effective March 1, 2008, the Division received EPA approval
to allow a 50 ug/l TRC compliance level. This change is due to analytical difficulties with TRC
measurements. Facilities will still be required to report actual results on their monthly discharge
monitoring report (DMR) submittals, but for compliance purposes, all TRC values below 50 ug/1 will
be treated as zero. A footnote regarding this change has been added to the effluent limitations page
in the permit.

The following modifications in April 14th draft permit remain in the final permit:
• Monthly average winter limits of BOD5=10 mg/L and NH3=4 mg/L have been added to
the permit to allow for the seasonality of wastewater treatment. Weekly average winter
limits of BOD5=15 mg/L and NH3=20 mg/L are also included.
• The effluent parameter "total suspended residue" has been changed to "total suspended
solids" for consistency with other domestic dischargers.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. The Division may require modification
revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by
the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local
governmental permits maybe required.

for renewal of my NPDES Permit NCO087963 which expires on February 28, 2010. As
we discussed by phone this morning, there is no facility as construction has been put off
owing to the general economic state of affairs.
I am enclosing NPDES APPLICATION — FORM D. with my updated contact
information. The engineering firm that has helped me through the permitting process is
