In accordance with WilcoHess, LLC's February 5, 2004 application for issuance of an NPDES
discharge permit for the Wilco Station # 197, the Division is forwarding herewith Permit No.
NC0087912. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated May 9,1994, as revised; and becomes effective on August 1, 2004.
The Division published a notice of the proposed permit in the Raleigh News & Observer on May 14,
2004. We received no comments and are issuing the permit as drafted.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless
such a demand is made, this permit shall be final and binding.
Please note that this permit is not transferable except after proper notice to the Division of Water
Quality. The Division may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or
any other federal or local governmental permit.

1. The grab sample for Oil and Grease should be skimmed from the surface in a quiescent zone, if possible.
2. If Naphthalene is not detected above the method detection limit during the first eight sampling events, its monitoring
requirement shall be waived for the remainder of the permit term. If it is detected above the method detection limit
during any of the first eight sampling events, the monitoring requirement shall remain in effect for the remainder of the
permit term.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A.(2.) SITE MANAGEMENT PRACTICES AND SPILL RESPONSE
No later than 90 days after the effective date of this permit, the Permittee shall submit:
a. site management practices it proposes to use to minimize the amount and strength of wastewater
generated at the diesel island and discharged from the treatment facility; and
b. spill response procedures for limiting the release of fuels from the site.
These requirements are intended to ensure good housekeeping practices at the fueling islands and
surrounding areas and are not expected to serve as a Spill Prevention, Control, and Countermeasure
Plan or similar document.
Upon approval, each of these documents shall become an enforceable part of this permit.
A.M) OPERATIONS AND MAINTENANCE (O&M)
Any start-up and O&M procedures approved pursuant to ATC request 087912A01 shall become, upon
approval, an enforceable part of this permit.

FINAL PERMIT ACTION
The Division is issuing a new NPDES Permit NC0087912 to Wilco -Hess, LLC for its Wilco Station
# 197, located at 13960 Capital Boulevard, Wake Forest, North Carolina. The facility is a convenience
store with gasoline and diesel fuel pump islands, and the permit authorizes the discharge of treated
wastewaters from the diesel fueling island to a nearby surface drainage.
The Division received application for the permit on February 5, 2004, and published its notice of
intent to issue the permit in the Raleigh News & Observer on May 14, 2004. No comments were
received, and the permit is being issued as drafted.
FACILITY OVERVIEW
The Wilco Station # 197 is a convenience store with vehicle fueling facilities. Gasoline and diesel are
dispensed at separate "islands," and neighbors have complained of finding diesel in the road front
drainage. DWQ inspectors have verified that there is at least occasional spillage from the diesel
fueling island as well as discharges from rinsing of the concrete pad and incidental amounts of
windshield washer fluid. It has been conservatively estimated that an average of 50 gallons per day
of spillage and/or rinse water contacts the concrete pad.
Wilco -Hess, LLC proposes to install perimeter drains around the diesel island to capture any spills
or rinse waters, treat the resulting wastewater in two sequential oil -water separators, and discharge
the treated wastewater to an existing storm drain. An existing canopy covers the island and will
minimize the potential for stormwater to enter the treatment system.
The company included a request for an Authorization to Construct permit with its NPDES
application. The Division has reviewed the ATC request but, as required by its rules, has not take
action on the request, pending issuance of this NPDES permit.

Since at least November 2003, the Division has received complaints from nearby residents
regarding diesel fuel spills from the facility. WilcoHess has tried to institute corrective measures but
has found that discharges caused by the spillage and cleanup from truck fueling are a chronic
condition. Staff from DWQ's Raleigh Regional Office issued a Notice of Violation in February 2003
regarding an unreported spill. DWQ staff have met with WilcoHess representatives at the site in
January 2004 and agreed to a course of action that includes collection, treatment, and discharge of
the wastewaters; implementation of management practices to minimize the amount of waste
discharged; and cleanup of soils contaminated by past spills.
SUMMARY OF PERMIT REQUIREMENTS
The permit will expire March 31, 2008, less than the usual five-year term, in order to keep the
permit synchronized with other permits in this portion of the Neuse River basin.
Effluent Limitations and Monitoring Requirements
The effluent limitations and monitoring requirements are based on NPDES general permit
requirements for groundwater remediation projects involving diesel fuel only (NCG510000). These
include limits for Total Suspended Solids (TSS) and Naphthalene. The TSS limit is technology -
based, and the naphthalene limit is equal to the water quality standard applied at the end of pipe.
Monitoring requirements are consistent with those in the general permit except that, consistent with
the nutrient permitting strategy for the Neuse River basin, nitrogen and phosphorus monitoring are
required, in this case, annually.
Special Conditions
The permit requires the company to submit a set of best management practices - "good
housekeeping" practices, for the most part - that will be implemented at the site. The permittee has
apparently prepared a list of practices and submitted it to the Raleigh Regional Office, but the
permit file does not yet include that document.
The permit also requires the permittee to follow the operation and maintenance procedures for the
proposed O/W separators, assuming those procedures are approved with the ATC request.

unhappy about incidental spills and other larger spills which have flowed down the ditch. The facility
has a large flow truck diesel fueling area where spills occur.The facility proposes to install catch
grating to convey any pad wash down water and spilled fuel to the O/W separator. Since this
wastewater is generated from fueling activity and from pad washing, it was decided that a stomwater
permit is not appropriate. It was determined that this wastewater is process wastewater.

Dear Mr. Williams:
On January 12, 2004, Judy Garrett and Joe Albiston with the Water Quality Section staff and Jimmie Greer with the
Groundwater Section staff of the Raleigh Regional Office met with Darrell Smith , Construction Maintenance
Supervisor with WilcoHess LLC, and 5 homeowners whose properties the water leaving the truck stop/filling station
crosses.
On November 21, 2003, Ms. Garrett received a complaint concerning diesel fuel in the ditch in front of the
houses on Wall Road. Ms. Garrett observed an oil sheen on the water in the ditch and diesel odor in the ditch on
Wall Road just downstream of the WilcoHess facility during an investigation on November 22, 2003.
You previously received a Notice of Violation dated February 7, 2003 from the Groundwater Section of
this office concerning a diesel fuel spill that had occurred two weeks prior to that date and had not been reported or
cleaned up. The recent investigation revealed that although the company has tried to institute corrective measures,
the discharge of various quantities of petroleum products from the truck filling area is a chronic condition caused by
spills from filling activities and washing down of the area by stormwater and staff of the facility.
Discharge of petroleum products to the lands or waters of the State is a violation of NCGS 143-215.75
which states that no discharge of petroleum products is allowed to water or lands of the state without a permit, and
NCGS 143-215.1 which states that a permit is required for a discharge of pollutants to waters of the state; and is
subject of civil penalties of up to $5,000 per day per violation and up to $25,000 per day per violation, respectively.
Therefore, this office is requiring that WilcoHess obtain an NPDES Permit for the discharge of this water and that
the Company install treatment to remove the petroleum to an acceptable level prior to discharge of the wastewater.
Attached is an application for the NPDES Permit. You will be required to submit plans and specifications for
treatment facilities signed and sealed by a NC certified Professional Engineer and receive an Authorization to
Construct permit prior to installing treatment facilities.
Mr. Smith stated that the facility will cease the washing of the fueling area until appropriate treatment of
the water is installed. Any further discharge of petroleum products without a permit is considered to be in violation
of the above cited laws and subject to civil penalties.
Mr. Smith was told that the Company is required to remove the contaminated materials from the ditch on
Wall Road in accordance with NCGS 143-215.84 which requires that the petroleum be removed as soon as possible.
He indicated that work would begin the next day, January 13, 2004. After cleanup, soil Testing must be completed
as directed in item B. of the February 7, 2003 letter (copy attached).

This engineering proposal sets forth the information requested in 15A NCAC 2H
0.0105(c). The requirements of 15A NCAC 2H 0.0105(c) are written in italics with
company responses below.
15A NCAC 2H .0105 (c)(1) — a description of the origin, type and flow of waste which is
proposed to be discharged. Justification and a demonstration of need shall be provided
for expected flow volumes.
The Wilco Station #197 consists of a convenience store with both gasoline and diesel
fuel pump islands. There has been some concern that operations at the diesel fuel
island may be contributing contaminants to runoff at the site. Truck windshield washing
and pavement rinsing activities at the diesel fuel island appear to be mixing with trace
diesel fuel spills in the area and discharging off site as surface water. Runoff from this
area currently discharges into a storm drain at the southeast corner of the site and is
conveyed through underground piping to a roadside drainage ditch at the northeast
corner of the property. During a recent meeting on site between several Division of
Water Quality (DWQ) personnel (Judy Garrett, Joe Albiston and Jimmie Greer) and Mr.
Darryl Smith of WILCOHESS, it was agreed that the origin of flow to be addressed
would be the discharge off of the concrete pad underneath the diesel fuel canopy. The
agreed upon remedy (treatment works) is discussed below under the response to
section 15A NCAC 2H .0105 (c)(3).
It has been conservatively estimated (based on Mr. Smith's site -specific knowledge of
this and other similar WILCOHESS facilities) that on average, 50-gallons of water per
day contacts the concrete pad under the diesel fuel canopy.
15A NCAC 2H .0105 (c)(2) — a summary of waste treatment and disposal options that
were considered and why the proposed system and point of discharge were selected, -
the summary should have sufficient detail to assure that the most environmentally
sound alternative was selected from the reasonably cost effective options.
After discussions with the aforementioned DWQ personnel, it was also agreed that the
proposed treatment outlined in the next section was reasonable, as it had been
successfully implemented at other WILCOHESS stations.

15A NCAC 2H .0105 (c)(3) — a narrative description of the proposed treatment works
including type and arrangement of major components, in sufficient detail to assure that
the proposed facility has the capacity to comply with the permit limits; for commonly
used treatment system or components with well established treatment capabilities,
detailed plans and specifications need not be submitted until the application for the
authorization to construct, however, detailed plans and specifications shall be required
with the permit application for any system or component without well established
treatment capabilities for the nature and waste or degree of treatment needed to meet
the permit limits.
The proposed treatment works at the facility will consist of ABT, Inc., 512AF Ductile Iron
Frame and Grate installed around the .east, west and south sides of the diesel fuel
canopy. The trench drain will be installed inside the drip -line of the canopy and be
sloped during installation so that rainfall and/or surface water does not enter the drain.
Flow captured by this grate will be discharged through six-inch diameter PVC piping to a
1,500-gallon capacity, pre -cast concrete oil -water -sand separator. Discharge from this
unit will be discharged to a 2,000-gallon capacity, Kleerwater oil -water separator.
Discharge from this unit will be discharged through six-inch diameter PVC piping which
will ultimately tie into the existing storm sewer line at the southeast corner of the site.
Information sheets on system components are included as Attachment A and a map
showing approximate locations of the proposed components is included as Attachment
B.
15A NCAC 2H .0105 (c)(4) — a general location map, showing orientation of the facility
with reference to at least two geographic references (numbered roads, named
streams/rivers, etc.).

proposed treatment works and the proposed point of discharge.
