* The above observations were made during a post -construction site visit.

** Six-inch diameter PVC pipe with a reportedly eight -inch thick concrete cap
was reportedly used instead of ductile iron piping.
*** The grit/sand separator and oil/water separator were installed seven feet
closer to the curbline; however, they are still reportedly located outside
of the 50-foot setback.

A letter of request for Authorization to Construct was received on September 23, 2004,
by the Division. Final plans and specifications for the subject project have been reviewed and
found to be satisfactory. Authorization is hereby granted for the construction of an oil/water
separator treatment system to capture fuel spilled at the diesel dispensing island at the Wilco
Station #197 located on 13960 Capital Boulevard (Route 1), Wake Forest, with discharge of
treated storm/wash water into an unnamed tributary to Richland Creek in the Neuse River Basin.
This authorization is awarded for the construction of the following:
Ductile iron frame and grate trench drains on the east, west, and south sides of the diesel fuel
island; two oil/water separators (one 1,500 and one 2,000-gallon capacity), placed in series; and
all related structures, equipment, piping, controls, and other appurtenances, pursuant to the
application received on September 23, 2004, and in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources.
This Authorization to Construct is issued in accordance with Part 11I, Paragraph A of NPDES
Permit No. NCO087912 issued June 29, 2004, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit
No. NC0087912. The Permittee should note that the NPDES.permit includes special conditions
pertaining to the operation and maintenance of the new treatment units.
The oil and/or sludge generated from these treatment facilities must be disposed of in
accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of
Water Quality.

In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to Cecil G. Madden, Jr., P.E.,
Construction Grants & Loans, DWQ / DENR, 1633 Mail Service Center, Raleigh, NC 27699-
1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class I1, III and 1V facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T 15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.

The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

They can't be half as confused as I am all of a sudden.
The package that arrived here was addressed to me and didn't have you on the cc: list. So I assumed
they forgot about CG&L and sent it to me by mistake ( or is that "mistake o " ?1). I scanned the
package and it looked okay to me; so I sent that e-mail to Darin (and you), figuring it would be simpler
for me to wrap it up than to pull you into it at this late stage (even though that's what we agreed to).
I'll try to call you before my 9:30 meeting in the a.m. to sort it out.

Attached are responses to the NPDES's comments regarding the Oil/Water separator for
WilcoHess on US 1 North.
Since it took 3 months to receive a response this should be considered a new project.
Please acknowledge and assign as we would a new project, but the subject should be
"Responses to Request for Additional Information Dated June 8, 2004".
Cecil has accessed and printed all the pertinent files from the DWQ server, and I believe
they are in the file. If not I have them in an email (including the NPDES permit).
I realize that some of the required application information may not be included, but we
can request those items during our review.

As you may have gathered from my previous message, I'm handing this ATC project to CG&L. The permittee
is having to submit a new design to address the comments I provided in early June, so it's essentially a new
project.
The facility is a gas station/ convenience store that has had a problem keeping all its diesel on -site and is now
subject to an individual NPDES permit (attached). They have proposed installing an O/W separator system to
treat contaminated runoff from their diesel fueling island.
The following is the first of two a -mails I'm forwarding regarding the Wilco Hess project. This one and the
RRO's staff reports (attached) will give you some background on the project. The next message includes my
comments on the original ATC request.

Darin - Here are my review comments for the WlcoHess ATC Request
087912A01. Let me know if you have questions. - Mike Templeton
1. The project drawings show the ON separators located within 1-2 ft.
of the southern property line. This is contrary to state rules (T15A
NCAC 2H .0219), which require that treatment devices be located at least
50 ft. from any property line. Therefore, the units must be relocated to
provide the necessary setback from both the southern and eastern edges
of the property. [ System is being re -designed to address this
requirement. ]
Because this places the units in an awkward location, the Division is
willing to consider a variance of the setback requirement if the
permittee presents an alternate location that is technically feasible
and provides maximum setback, and obtains the consent of the adjoining
property owner(s) and documents that consent in writing and notarized.
[ They've decided it's unlikely they can get the necessary consent ]
2. The site plan should include elevations for the for the diesel fuel
island pad, new drains and sewer lines, O/W separators, and other key
points at the site in order to verify the as -built elevations (for
drainage) and show the vertical placement of the proposed drains,

treatment units, etc. on the site. The sewer lines must maintain the
slopes specified in the 2H.0219 design criteria. [ Mr. McClure will
add these features in the next submittal. ]
3. The site plan should show the approx. location of the storm sewer
line behind (east of) the paved area and note its size, material, slope,
and elevations. [ Ditto. ]
4. It appears that stormwater can run onto the diesel fuel island pad
and into the drainage trench on the uphill (un-trenched) side of the
island. It might also be able to run directly into the drain on the
western side of the pad. The design should include low berms or other
features to prevent the unnecessary capture of stormwater. [ Ditto. ]
5. The design does not appear to include a waste oil storage tank for
storage of accumulated diesel and/or O/W separator cleaning waters.
Please provide appropriate storage or indicate how the system can be
managed without it.
6. The Kleerwater system, like other O/W separators, is not intended to
remove emulsified petroleum products. Please indicate what impact the
windshield washer fluid will have on their performance.
7. The Kleerwater materials indicate that the systems can be designed to
produce effluent as low as 5 mg/L free hydrocarbons. The ATC package
should indicate what performance criterion was used in selecting this
system.
8. Item #6 of the Kleerwater "Maintenance Instructions" instructs the
operator to remove and clean the coalescer media packs on a periodic
basis. The ATC package should include a brief description of this
process (is it as simple as hosing off the media, or is it more
involved?) and how the resulting wash waters will be handled.
[ The new NPDES permit requires them to document and submit their spill
response and regular operating procedures. ]
9. Please describe how the operator will inspect the system for sheen, etc.

10. The O/W separators call for a Grade 1 Phys/Chem-certified operator.

PART III - EVALUATION AND RECOMMENDATIONS
This office has received complaints from the residents along
Wall Road that the Wilco Hess facility periodically
discharges various quantities of diesel fuel to the storm
drain and ditch. It was determined that the truck fueling
island which has large volume nozzles for filling large tanks
was probably the source of the spills. To address these
illegal discharges, the Company has proposed to install
oil/water separators. They intend to eliminate any
stormwater from entering the treatment by installing
interceptor trenches under the canopy over the island and
berming on the uphill side of the trenches. I did not see any
specific details of the berming in the submitted plans.
The company also plans to install 2 oil/water separators in
series. I did not see any mention of a waste oil tank in the
submitted information.
After these 2 items have been addressed and after any central
office items of concern have been addressed, we recommend
that the A to C be issued concurrent with the NPDES Permit.
We ask that this project be given priority due to the impact
the facility is having on the environment.

Hi Folks,
We just received today and Shannon and J.D. investigated, a spill at
the Willco Hess Station which is on US 1 at the Franklin County line.
The spill amounted to less than 5 gallons on the pavement which was
cleaned up by the service station using oil dry. Mr. Ben Crabtree who
lives beside the service station reported this (and I still have the
voice mail) as "a pretty good-sized diesel spill". As you know,
spills of less than 25 gallons that do not reach surface waters and
which are cleaned up within 24 hours do not need to be reported to us
and we certainly do not need to be visiting these sites unless there is
a problem. This is the second such report which we have received in
recent days from Mr. Crabtree.He also called the Franklin County Fire
Department who reportedly were not happy about being called on this
spill. We will try to obtain a copy of their report.
Based on previous investigations by Jimmie Greer and one by me when
we found small amounts of diesel fuel in the ditch in front of Mr.
Crabtree's house, we have requred the service station to obtain an NPDES
Permit and install an o/w separator. The company has submitted a permit
application and plans for the treatment facilities. We have sent our
comments to the central office and asked that the project be placed on
priority. To my knowledge, this is the first such permit the RRO has
required under these circumstances. We also told Mr. Crabtree that he
should call us if he notices any spill which reaches the ditch.
