Dear Sir or Madam:
On August 27, 2007, the Division of Water Quality (DWQ) received your application dated
April 17, 2007, to impact 0.13 acres of 404/wetland, 140 linear feet of perennial stream, and
6,098 square feet of Zone 1 Neuse River basin protected riparian buffer, and 3,920 square feet of
Zone 2 Neuse River basin protected riparian buffer to construct the proposed residential
subdivision. On November 21, 2007, the DWQ received additional information from you,
however, this submittal failed to address the items listed in the DWQ's most recent Request for
More Information letter dated October 9, 2007.
Six level spreaders have been indicated on the plan sheets. Two different level spreaders
are labeled "LS-1"and two different level spreaders are labeled "LS-2." Only three Level
Spreader Supplement Forms have been provided and the supplement form associated
with LS-1 has only been partially filled out. Separate Required Items Checklists have not
been provided for each Supplement Form and the required items are not included even
though they have been checked and initialed.
2. Cross sectional details of the bypass channel associated with level spreader 4 have not
been provided as requested.
3. A Bioretention Supplement Form has not been provided for the proposed bioretention
area. The DWQ will neither evaluation nor approve a BMP unless a supplement form
with all the required items has been provded.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
