The project area lies within uplands except for 4 perpendicular stream crossings. These jurisdictional stream crossings were flagged and surveyed by BP Barber. Attached is a request for Wetlands Determination and a submittal for coverage under a nationwide permit. All other applicable regulatory agencies have been contacted. A copy of correspondence with other agencies is attached for your information. BP Barber is acting as agent for the Town of Spindale. A letter of authorization is attached. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north axrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. Explain the purpose of the proposed work: The Town of Spindale is the municipality which collects and treats wastewater in the area. This force main is needed to serve the needs of local residences and businesses. III. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. See Attached VII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Impact Justification (Avoidance /Minimization) Avoidance: The proposed force main line avoids impacts to Wetlands /Waters of the U.S. to the greatest extent possible. An existing cleared sewer easement is being utilized for construction of the force main. This allows avoidance of impacts to forested wetlands . This route avoids all wetlands except for the 4 perpendicular stream crossings as shown on the attached drawings. Impacts to wetland area #2 have been avoided by installing the force main below an existing jurisdictional culvert. Each of the 4 jurisdictional stream crossings occur at a point where the stream crossing is narrow. Other wider stream crossings which could have been utilized were avoided. The existing easement generally follows a tributary of Stonecutter Branch. Other routes along Stonecutter Branch were considered for the force main. Other routes considered would have required new easements with new permanent impacts .Following the existing easement eliminates the need for new permanent impacts. M1n1TI11ZatlOn: All impacts are temporary. Excavation across the 4 streams will be confined to the trench only. Excavated material from the trench will be returned as backfill after the pipe is installed .The stream beds will be returned to original grade. Streambeds will be stabilized with biodegradable erosion control matting. Trenches will not remain open overnight. A stormwater management plan will be utilized to prevent adjacent upland soils from silting into the stream. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider- the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Impacts are below the 1 acre/150' threshold 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. The force main is to be constructed within an existing 30 wide mowed sewer easement. The sewer easement passes through forested upland .property which parallels a tributary of Stonecutter Branch. The sewer easement crosses this tributary 4 times. A submittal to the U.S. Army Corps of Engineers is being prepared for these stream crossings. Habitat is predominately clay or rocky clay slopes with mowed grass vegetation. Streams are narrow with well defined streambanks. Findings are as follows: The Indiana bat is a small brown to black bat with a wingspan of 9 to 11 inches and weighs about three-tenths of an ounce. Large numbers of Indiana bats cluster together during hibernation. During the winter the bats hibernate in caves, or occasionally abandoned mines. After hibernation in the summer the bats roost under loose tree bark on dead or dying trees. Habitat for the Indiana Bat is not present at this site. No individuals were found. The Dwarf-flowered heartleaf is a small flower that is less than .4 inch long, with narrow sepal tubes (never more than .28 inch wide). The jug shaped flowers range from beige to dark brown, sometimes greenish or purplish. Leathery evergreen leaves are dark green and heart shaped. This plant has been found on slopes and creekheads along streams. Pacolet Soils and streamsides are located along the project corridor. Areas with habitat for this plant were observed, but no individuals were found. The Small whorled pogonia is a perennial with long, pubescent roots and a smooth, hollow stem 9.5 to 25 centimeters tall terminating in a whorl of 5 or 6 light green, elliptical leaves that are somewhat pointed and measure up to 8 by 4 centimeters. The flower (or occasionally two flowers) are located at the end of the stem. This species is typically found in oak-hickory or acidic cove forests. Herbaceous cover tends to be sparse, however at least two sites are characterized by fairly dense stands of New York fern. Sites historically known to support this plant range from 2000 to 4000 feet in elevation. This sewer line project occurs in an area which is 900 to 1000 feet in eleva#ion. No Small whorled pogonia was observed along the project corridor. The White irisette grows in a dichotomously branching pattern. 4-8 inches tall; basal leaves are pale bluish-green: tiny white flowers (.3 inch) with reflexed petals in a cluster of 4-6 at the ends of winged stems; fruit is round with 3-6 seeds. The plant flowers in the summer and is typically found in dry to moist oak-hickory forests were the canopy of the trees is thin and often where down slope runoff has removed much of the litter layer ordinarily present on these sites. This plant has been found in the mountains of North and South Carolina. This site does not occur in the mountains. Soils may provide some marginal habitat. No White irisette was observed along the project corridor. The Rock Gnome Lichen grows in dense colonies of narrow (0.04 inch) straps that are blue-grey on the upper surface and are generally shiny-white on the lower surface: near the base they grade to black. Fruiting black bodies are grown at the tips of the straps. They typically are found on rocks in areas of high humidity either at high elevations (usually vertical cliff faces) or on boulders and large rock outcrops in deep river gorges at lower elevations. The project area has no habitat that fits this profile.. No Rock Gnome Lichen was found in the project corridor. Summary Prior to assessing the project site, historical data was collected. There were no known occurrences of plant or animal species that are Federally protected. Some habitat exists for dwarf-flowered heartleaf. Onsite investigation did not reveal the presence of this plant. Based upon existing data and based upon a survey of the site, the determination for Federally Protected Species is NO EFFECT. In our opinion, there appear to be no eligible cultural resources onsite. The site is an existing sewer easement with an existing sewer line. This easement is grassed and maintained by periodic mowing. BP Barber has performed a data search at the State Preservation Office in Raleigh, NC to search for recorded sites along the project corridor. The work consists of installation of approximately 8,772 linear feet of 12" force main. The route generally parallels an existing stream (tributary of Stonecutter Branch) in the Broad River Basin. There appears to be no suitable habitat that would support trout. Please review this project and issue your concurrence.
