The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete Stormwater Management
Permit Application for the subject project on July 26, 2024. Staff review of the plans and specifications has
determined that the project,as proposed,will comply with the Stormwater Regulations set forth in Title 15A
NCAC 2H.1000 - 1062 rules.We are forwarding Permit No.SW6130203, dated July 29, 2024,for the
construction,operation and maintenance of the built-upon areas (BUA) and vegetated conveyances or areas
associated with the subject project.This permit shall be effective from the date of issuance and shall be subject
to the conditions and limitations as specified therein, and does not supersede any other agency permit that may
be required.
The original signed permit package and approved plans are being mailed to the permittee,Allied Investors, Inc.,

I looked over the additional information you provided on April 26, 2024. Everything looks good except for a few
small issues:
Please correct the following:

On the Infiltration System page of the Supplement-EZ form, please revise the following as needed:
1. Line 23 - Please make sure this is listed as being greater than 124 inches, not less than.
2. Line 45 -The drawdown time listed here is no longer consistent with the updated values
presented on the Supplement-EZ form.Your sizing is fine,this number just needs to be updated with
the actual drawdown time.
Since this is only one page of the Supplement-EZ form, and is not a sheet that requires a signature,an electronic
copy of the revised page can be uploaded to the repository and emailed to me, and I can print it to add to the
physical copy we will send in.
Electronic copies should be uploaded at the following location:

Since these are minor issues, once we receive the updated form and the documents are uploaded to Laserfiche
(provided everything is in order),we should be able to issue the permit in a timely manner,subject to reviewer

Mainly wanted to verify the impervious and drainage area/project area figures to go in the app and EZ supplement,
and talk through the size of the basin which is not only setup for the Phase II storm requirements, but also sized to
meet County requirements and how we go about listed the numbers you need in the form to reflect that as it is
currently designed to meet both from a volume and surface area standpoint.

All,
Since we received the initial submission for this project prior to the new fee structure taking effect, the
permitting fee for this review(the renewal of SW6130203 since it expired in 2021)will be$505 (the old
fee). Please note that the previously provided check(dated 5/15/23) has expired and a new review fee
($505)will need to be provided before we begin review of the renewal application. We will void and
return the expired check. Aside from the review check, the renewal application is administratively
complete.
To modify the permit(after it has been renewed), the new fee will be required since it is a separate
permitting action. You can submit the modification for review concurrently with the renewal, but we will
not be able to process the modification until the renewal has been approved.The following items will
need to be provided to complete the modification application that we have received:
1. 1x application fee check in the correct amount (this item is required per Session Law 2023-134,
Section 12.14(e)(2)):
1. Please be aware that, effective October 3, 2023, our permit application fee structure is
as follows:
1. New Permit or Major Modification for a project with one (1) or fewer SCMs=
$1,000
2. New Permit or Major Modification for a project with two (2) SCMs=$1,250
3. New Permit or Major Modification for a project with three (3) SCMs=$1,750
4. New Permit or Major Modification for a project with four(4) or more SCMs=
$2,250
5. Minor Modification =$250
6. Renewal =$750
7. Transfer=$750
8. Renewal &Transfer Combination =$1,500
9. General Permit=$700
2. 2x signed &sealed hard copies of a plan sheet showing the following corrected additions:
1. Wetland delineation or a note on the plans stating that there are no wetlands located
on-site.This item is required per 15A NCAC 02H .1042(2)(g)(iii) &Section VI, 8m of the
Application. Please also list the name of the individual that made this determination in a
note on the plans. NOTE:This is only required for the new area that will be added to the
permit.

2. Project boundary delineation labeled with accurate bearings and distances (Required
per Section VI, 8i of the Application and 15A NCAC 02H .1042(2)(g)(ii)). NOTE: It is noted
that the project area is shown, however the bearings and distances are not included.
If these items are received within the stipulated timeframe, we can accept the project and begin the
review process. Once accepted, reviews under the standard permitting process can take up to 90
calendar days per statute.

It was good talking to you today. Per our conversation, I understand you are o.k.with moving
forward with the Stormwater permit No. SW6130203 with the understanding that you would be
responsible for all upstream stormwater runoff once lots are sold. No transfer application would
be needed with this option even though the property in the original permit has been transferred to
someone else and the proposed O'Reillys property would be transferred also in the future.

Also, Mike is going to check on it for us, but there is a possibility that part of the submittal may fall
under new permit fee schedule. If that is the case,we'll get Mike a check for any additional fees
and pass them through once we hear back.
