FYI and Follow -Up for Outer Banks Ventures / Corolla / Currituck County
Officials from the US Army Corps of Engineers and the NC Division of Coastal Management met onsite today with
representatives for Outer Banks Ventures. The purpose of the onsite meeting was to determine compliance with
previously issued Department of the Army Permits, and to investigate various reports from concerned parties regarding
the ongoing development activities on the site. The authorized work includes the development of a road across the
man-made pond, repair of an existing pond berm, and the installation of a water control structure. A new borrow pond
has been excavated within freshwater wetlands on the property but did not require authorization from the Corps and
resulted in a determination of No Permit Required. The Major CAMA Permit Application for a marina and related
amenities was previously placed on Hold at the applicant's request.
The onsite inspection revealed that there has been some resultant woody debris discharged into freshwater wetlands
and some tracking disturbance in an area along the coastal wetland boundary. The impact area involving the
displacement of woody debris consisted of wood chips and ground stump remnants being pushed into an approximate
5,080 square foot area. The total area for the mulching and stump grinding involves approximately 3-4 additional acres
but there were no other areas located that resulted in a fill activity that would have required a permit from the Corps.
The area of tracking disturbance along the coastal wetland boundary consisted of equipment tracks and rutting that
resulted in some changes in elevation along the track of the machine responsible for the disturbance. The owner agreed
to completely restore any and all impacts to any aquatic resources on the site and install a silt curtain within the open
waters of the man-made pond to prevent any potential for offsite sedimentation into the pond or adjacent waters.
The were remnants of silt fences located at various locations throughout the project site but none of them were
currently serviceable at this time. The contractor stated that they had elected to utilize earthen berms and had left a
small setback between the berm and the wetland areas. There were only some minor areas where sediment had leaked
over but they are very close to potential failures and the owner was advised that if they erode into any adjacent wetland
areas it would likely result in further remedial actions. In addition, the owner is aware that the State has visited the site
and anticipates the opportunity to work with them on compliance with their issued Erosion & Sedimentation Control
Plan.
At this time, considering the factors that the work is currently ongoing and in progress; the permits that have been
issued for work on the site and the extensive coordination between the Corps and the Consulting Engineering Firm; the
cooperative attitude of the owner to perform all of the requested remedial actions; and the relatively small size and
extent of the impacts to the aquatic resources; the Corps has determined that there will not be a Cease & Desist issued
for the site. However, advise has been provided that all future work involving the completion of the permitted activities,
needs to be performed in strict compliance with all applicable laws and regulations. The Division of Coastal Management
will determine their course of action based on their assessment of the work to date, and there was extensive discussion
regarding taking the marina application off Hold and reinitiating the agency review process.
