Dear Mr. Brantley,
This letter is in response to the Notice of Deficiency received on June 17, 2024, for failure to
remove sludge from the lagoon. In 2020, 375,627 gallons of sludge solids were removed from the lagoon
incurring a cost of $90,288.00. The lagoon was treated with biologicals in 2022 and 2023 while the farm
was still in operation. At the end of year 2023, all the animals were removed from the farm and
production has ceased.
We are confident that the sludge survey taken on 4/18/2024 is accurate. We have on file a Sludge POA
that was completed 5/10/23, due to restructuring in our organization, this POA was never filed with
DEQ. An error for which we take full responsibility.
Land availability in this area is sparse and the land that is available is in a CAWMP, which is
needed to irrigate the lagoon. We will be removing sludge via land application at agronomic rates as
possible while maintaining proper freeboard. We are also considering other options for sludge removal
that do not require land application. We are currently beginning a pilot project of sludge removal at
another facility with EvoAgTec. Pending the results of this project, we would consider using EvoAgTec or
other options to remove sludge at this facility. As previously stated, there are no animals on the farm,
therefore no additional sludge accumulation.

Additional Comments:
An estimated 14.95 Ibs PAN/1000 gallons is used to estimate gallons/acres. Nitrogren
rate indicated is the half rate to allow for additional Nitrogen application to irrigate lagoon
later in the season. This also will reduce the chance of over application of nutrients.
Slurry sampling will be done prior to application and additional sampling will be done
through the course of sludge application.

I (we) understand and will follow and implement the specifications and the operation
and maintenance procedures established in the approved animal waste utilization plan
for the farm named above. I (we) know that any expansion to the existing design
capacity of the waste treatment and storage system or construction of new facilities will
require a new certification to be submitted to the Division of Environmental Quality
(DEQ) before the new animals are stocked. I (we) also understand that there must be
no discharge of animal waste from this system to surface waters of the state from a
storm event less severe than the 25-year, 24-Hour storm. The approved plan will be
filed on -site at the farm office and at the office of the local Soil and Water Conservation
District and will be available for review by DEM upon request.
