Hello Ms. Wooten, Environmental Resources Management, on behalf of Atlantic Coast Pipeline, LLC's (Atlantic) Atlantic Coast Pipeline Restoration Project (Project) is reaching out to provide notice of use of herbicides within 100 feet of wetlands and waterbodies and within 300 feet of karst features to effectively treat noxious weeds identified in the ACP Restoration Project workspace. Federal law (FIFRA) requires all pesticides (including herbicides) sold in the U.S. be registered and approved by the U.S. EPA and have a label that clearly includes information about the name of the product, name and address of the producer or registrant, net contents, registration number, producer's number, ingredients, warnings, directions for use, and use classification. Atlantic understands that herbicide labels are legally enforceable and that it is a violation of Federal law to use an herbicide in a manner inconsistent with its labeling. WVDA, VDACS, and NCDACS have confirmed that herbicide labels would indicate if they cannot be used within certain distances of specific sensitive features and that application by a licensed applicator following label instructions does not require agency approval. Atlantic confirms licensed applicators will follow label instructions when treating noxious weeds in the ACP Restoration Project workspace.
