Sullins, Director Division of Water Quality December 21, 2007 DWQ Project~# 2007-2030 Mecklenburg County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Charlotte Mecklenburg Utilities Attn: Mr. Brian Pate 5100 Brookshire Blvd Charlotte, NC 28216 Subject Property: Griffith Street Pump Station Modifications, Davidson, NC Lake Norman [030832, 11-(75), WSIV, B, Ca] REQUEST FOR MORE INFORMATION Dear Mr. Pate: On December 4, 2007, the Division of Water Quality (DWQ) received your application dated November 16, 2007 to impact 509 square feet (ft2) of Zone 1 of the protected riparian buffers to construct the proposed emergency detention structure and associated utility lines at the subject property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0243(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Justification (Avoidance and Minimization) This Office believes that impacts to Zone 1 of the protected riparian buffer can be avoided or minimized for the emergency detention structure. Please reconfigure your plans to reflect this change. 2. Buffer Impacts Please quantify the square footage of impacts for the emergency detention structure in Zone 2 of the protected riparian buffer. 3. Variance The proposed emergency detention structure will require a variance from the Catawba Buffer Rules (15A NCAC 2B.0243). Geotechnical Report You must submit a signed and sealed (by a Professional Engineer or Professional Geologist) geotechnical investigation of subsurface soils, demonstrating whether or not you encounter bedrock at the lowest depth of the proposed emergency detention structure. Please respond within three weeks of the date of this letter by sending this information to me in writing and Alan Johnson of the DWQ Mooresville Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
