Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
There have been the following significant changes from the draft permit:
➢ Effluent Limitations for the secondary discharge at your facility have been eliminated; this final permit
requires quarterly monitoring only. We cannot grant your request to delete the monitoring requirements
for this discharge. Division personnel have witnessed continuous flow during dry -weather periods,
indicating that this discharge is not exclusively stormwater. However, we also acknowledge that the
facility plans you consulted may explain at least one source of the discharge. Quarterly monitoring will
allow you (and the Division) to identify all the source(s) of this flow and take any corrective measures
deemed necessary.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be

I really can't remember the details of this permit, I remember talking to
Mike P about this issue. I am remembering that there was way too much flow
during a no rainfall period through this (rainfall collection system) for
it o e s ormwater only. Mike remembers the same scenario. I know they
are doing alot of construction on this site. Did he make any comments to
account for this infiltration. Maybe some cross connection or something. I
will review my notes and get back to you later today.

recommended the addition of outfall 002 to cover a discharge of "wet
well & reservoir water". You also noted that the facility would be
doing an evaluation of this discharge in the fall of 2001.
On 8/23/2001 I received a letter from John C. Huber of CMUD stating that
the discharge consisted of water from "footer drains, roof drains,
groundwater and surface water runoff". He asked that outfall 002 not be
added to the permit because the water discharged from the outfall "is
not part of a treatment process."
Strictly for the purposes of renewing this permit, I'm inclined to agree
with Mr. Huber. If the discharge isn't from one of his treatment
components it doesn't qualify as filter backwash.
However, I don't think we should ignore outfall 002. I'm not sure that
this NPDES permit is the proper mechanism to regulate it. I don't know
what requirements exist for stormwater monitoring at POTWs.(WWTPs or

I have reviewed the draft of significant changes that NCDENR wants to incorporate in our new
permit. I have attached the cover letter sent by you to this letter. Note that the county you have
listed is incorrect. Our facility is in Mecklenburg County.
We concur with the modifications made to the permit with the exception of the second bullet that
states that the effluent limitations and monitoring requirements for outfall 001 also apply to the
recently identified outfall 002.
The outfall 002 consists of tooter drains at our buildings, roof drains, groundwater and surface
water runoff. The drainage system was put in when the facility was built (1956). We do not feel
that the water flowing thru the outfall constituents a pollutant and it is not part of a treatment
process. Therefore, the outfall should not fall under a NPDES permit.
We request that you reconsider adding another monitored discharge point to our permit. Thank
you for consideration on modifying our permit.

PART IV - EVALUATION AND RECOMMENDATIONS
Charlotte Mecklenburg Utilities, is requesting renewal of its NPDES Permit. The wastewater is
generated from the daily backwashing of filters and cleaning of the residual settling basins.
It should be noted that the dechlorination contact tank has not been constructed at this time,
although it should be installed within the next 90 days.
Also, an additional discharge has been identified. Approximately 1,000,000 gallons of a
combination of wet well and reservoir water has been identified flowing to the storm sewer
discharge located approximately 200 feet upstream from the current discharge point. Contacts at
the Franklin Plant have indicated that this discharge is an estimate and that an evaluation of these
losses will be conducted this fall. This office recommends identifying this additional discharge
point as 002.
The Franklin staff has submitted a request for removal of the upstream and downstream sample
points 'his existing condition would be replaced with one that would trigger upstream and
dow',ifstream sampling. This does not sound like an unreasonable request from our field
perspective. Permits and Engineering should determine whether the request may be approved.

source to determine how it should be included in this permit.

Due to recent re-routing of storm water and other drainage at the Franklin Water Plant
facility there is not an upstream supply above the point where the effluent discharge
enters its streambed. Therefore, we would like to submit a change for our new permit

We are requesting that you consider our NPDES monitoring to consist of only the
effluent sampling and for us to cease taking upstream and downstream samples. This
proposal was discussed with Dee Browder during the onsite visit on June 8, 2001 in
review of our permit renewal.
Attached is two years worth of data showing our effluent turbidities. The turbidities are
consistently below 50 ntus. If we somehow exceed 50 ntus at our discharge we would
then monitor it at the upstream and downstream where the flow enters the tributary to
Stewart Creek.
This request is being made because of the treacherous conditions that exist at the point
the streams meet.

The City of Charlotte, Charlotte Mecklenburg Utility Department has a complete Sludge
Management Plan under permit #W.Q.0000057. This plan includes the residuals
handling for both the Wastewater Water Treatment Plants and Water Treatment Plants.
The Sludge Management at the Franklin Water Treatment Plant is as follows:
1. Solids generated from the clarification process and backwash water is
discharged to two surge holding lagoons.
2. Water and solids from lagoons are sent to two clarifiers; and solids are sent to a
residuals holding basin. The clarified water goes to the NPDES discharge point.
3. The solids from the residual holding basin are sent to two mechanical
thickeners. The solids are then belt pressed. The clarified water then goes
back to the surge lagoons to be treated.
4. The belt press solids are removed by a contractor to be land applied or taken to
approved landfill.
5. The contractor must follow the permit #W.Q.0000057 for solids disposal.
