This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6,1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice this permit is not transferable. Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Environmental Management or permits required by the Division of land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Operate a wastewater treatment system for filter backwash consisting of two settling lagoons, a residuals basin, two residuals thickeners, two backwash water clarifiers, and a belt filter press from a facility located on Highway 16, north of Charlotte, North Carolina in Mecklenburg County, and , 2. Discharge from said treatment works at the location specified on the attached map into an unnamed tributary to Stewart Creek which is classified C waters in the Catawba River Basin. A. (). EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS FINAL Permit No. NC0084549 During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge from outfall(s) serial number 001. If the turbidity exceeds these levels due to natural background conditions, the discharge level cannot cause any increase in the receiving water. 3 Aluminum monitoring is required only if alum is used as part of the treatment process. 4 The pH shall not.be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored weekly by grab sample at the effluent. There shall be no discharge of floating solids or visible foam in other than trace amounts. All samples should be from a representative discharge. Part III E. Toxicity Reopener Permit No. NC0084549 This permit shall be modified, or revoked and reissued to incorporate toxicity limitations and monitoring requirements in the event toxicity testing or other studies conducted on the effluent or receiving stream indicate that detrimental effects may be expected in the receiving stream as a result of this discharge. Please provide a description of proposed wastewater treatment facilities: The proposed wastewater treatment will consist of an additional residuals sedimentation basin, an additional gravity thickener, and an additional backwash clarifier. g. Spray Irrigation: N/A Connection to Regional Sewer System: According to the environmental assessment report submitted to this office by Black and Veatch in 1994, it was concluded that discharge to the sanitary sewer would cost $4,108,000 compared to $236,000 for surface discharge. Other Special Items: N/A Page 3 1 0 PART IV - EVALUATION AND RECOMMENDATIONS The Charlotte Mecklenburg Utility Department, is applying for an NPDES Permit to discharge wastewater from backwash clarifiers located at the Franklin Water Treatment Plant in Mecklenburg County. The wastewater is generated from the daily backwashing of filters and cleaning of the residuals settling basin. It should be noted that the dechlorination contact tank has not been constructed as proposed by Black and Veatch in 1994. Therefore, the dechlorination contact tank should be deleted from the permit until a chlorine limit is prescribed. It is recommended the subject permit be issued.
