The condition in question reads as follows: 6. Written Stormwater Management Plan (Final Plan Needed) A final, written stormwater management plan (including a signed and notarized Operation and Maintenance Agreement) shall be submitted to the 401 Oversight and Express Permitting Unit (2321 Crabtree Blvd., Suite 250, Raleigh, NC, 27604) within 60 days of the issuance of the 401 Water Quality Certification. The stormwater management plans shall be approved in writing by this Office before the impacts specified in your application may be performed. The stormwater management plan must include plans, specifications, and worksheets for stormwater management facilities that are appropriate for the surface water classification (ORW, Trout) and designed to remove at least 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also, before 'any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. You must seek this through the Asheville Regional Office. As the condition states that you cannot perform any of the approved wetland or stream impacts until such a time as your having an approved stormwater plan with signed operation agreements, extending the deadline for the submission of the stormwater plan submission date only delays your ability to perform whole site grading activities. This office needs a clearer understanding as to how the 24 month extension will benefit the project and allow for the project to meet it's Water Quality Certification conditions. Additionally, it is also the understanding of this office that the only real changes that need to be made to the Stormwater Management Plan are elevations. If this is the case, this office is more concerned that water moves through the treatment system and that the treatment is adequate to meet both the Surface Water Quality Standards and the issued 401 Water Quality Certification. Should elevation adjustments be necessary, you may submit your plan with the caveat that as-built drawings will be submitted showing the final elevations of all treatment units and any other minor necessary changes made during construction.
