coverage nor have the existing infiltration basins been surveyed to verify storage capacity.

North Carolina as amended, and other applicable Laws, Rules, and Regulations

Provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Energy, Mineral, and
Land Resources (Division) and considered a part of this permit.
This permit shall be effective from the date of issuance until April 16, 2022, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff fr impervious area. om 85,515 square feet of

4• All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project

project must be directed into the permitted stormwater control system.

8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built-upon area, details, etc.
b. Project name change.

d• Redesign or addition to the approved amount of built-upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Energy, Mineral, and
Land Resources, accompanied by a completed name/ownership change form,
documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and
may or may not be approved. The permittee is responsible for compliance with
all permit conditions until such time as the Division approves the transfer
request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.

management system will result in future compliance problems. The issuance of this permit does not resolve any

specified conditions and limitations:

1. This permit is effective only with respect to the nature and volume Of stormwater described in the application
and other supporting data.

�. The expanded stormwater management system shall be constructed in its entirety, vegetated and operational
for its intended use prior to the expansion of any built-upon.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months)
b• Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved plans and specifications
f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins,
piping and vegetated filter.
9. A clear access path to the bypass structure must be available at all times.
4 Records of maintenance activities must be kept and made available upon request to authorized personnel of
DWQ. The records will indicate the date, activity, name of person performing the work and what actions were
taken.
5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless
the facilities are constructed in accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
6. Upon completion of construction of the proposed expansion, prior to issuance of a Certificate of Occupancy,
and prior to operation of this expanded permitted facility, a certification must be received from an appropriate
designer for the system installed certifying that the permitted facility has been installed in accordance with this
permit, the approved plans and specifications, and other supporting documentation. Mail the Certification to
the Washington Regional Office, 943 Washington Square Mall, Washington, North Carolina, 27889, attention
Division of Water Quality. Any deviation from the approved plans and specifications must be noted on the
Certification.A permit modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior
to operation as a stormwater treatment device, and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate easements at all times.
9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications,
and calculations prior to construction, for any modification to the approved plans, including, but not limited to,
those listed below:
a. Any revision to to any item shown on the approved plans, including the stormwater management
measures, built-upon area,details,etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area or drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the
approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times.
12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director. In the event of a change of
ownership, or name change, the permittee must submit a formal permit transfer request to the Division of
Water Quality, accompanied by a completed nametownership change form, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved. The permittee is responsible for compliance with
all permit conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-
215.6A to 143-215.6C.

4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW7980429
for Ocean Commerce Park— '98 additions on July 8, 1998. This permit expires on July 8, 2008. Section
.1003(h) of 15 A NCAC 2H .1000 (the stormwaterrules) requires that applications for permit renewals
shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete and
submit the enclosed renewal application in a timely manner. If this project has not been constructed
and a permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed/s a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

The Washington Regional Office received the completed
Stormwater Application for the subject project on April 23 , 1998.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW7980429 dated July 8, 1998 to Ocean Commerce Park
Center. This permit replaces all previous stormwater
certifications for this project site.
This permit shall be effective from the date of issuance until
July 8 , 2008 and shall be subject to the conditions and limitations
as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit. Failure to
establish an adequate system for operation and maintenance of the
stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty ( 30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447 , Raleigh, NC 27611-7447.
Unless such demands are made this permit shall be final and
binding.

I. DESIGN STANDARDS
1 . This permit is effective only with respect to the nature and

4 . No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built-upon
area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6 . The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1 . The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built-upon surfaces
except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2 . The facilities must be properly maintained and operated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.
3 . The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:

a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4 . Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6 . Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional Office, 943 Washington Square Mall ,
Washington, North Carolina, 27889 , attention Division of Water
Quality.
7. A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2 . Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Water Quality, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c) .
3 . The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

4 . In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

1. Deed Restriction Language
The following statements must be recorded for all low density projects and for all projects that involve the
subdivision and selling of lots or outparcels:
1. No more than _ square feet of any lot, including that portion of the right-of-way between the
edge of pavement and the front lot line, shall be covered by impervious structures including
asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permit issued by the State of North Carolina. The covenant may not be changed or
deleted without the consent of the State.
2. No one may fill in, pipe, or alter any roadside swale except as necessary to provide a minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number, size and the allowable built-upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be

Routine inspections shall be performed by the operator at regular intervals of approximately one
month and at the time when heavy rainfall occurs.
2) The buffer and exposed side slopes of the basin shall be mowed at least twice a year to prevent
woody growth. More frequent mowing may be needed if the basin is to be used as a passive
recreation area or for landscaping. Remove all debris and litter during each mowing operation.
3) Elevations of the infiltration basin shall be maintained as shown on the approved plans of record at
the Town of Kill Devil Hills Planning and Development Department. Siltation or erosion which
alters those elevations shall be corrected by adding suitable soil or removing sediment as necessary.
The mean depth of the dry infiltration basin shall be maintained at 1.25 ft.(15"). Sediment shall be
removed when accumulation at the basin bottom reaches one foot in depth.
4) Any vegetation which inhibits proper performance of the pond shall also be removed and disposed of
properly.
5) The embankment of the basin,rip rap aprons,flumes,culvert and flow diversion box shall be
checked regularly to insure that they are structurally sound,are functioning as intended and have not
been damaged by erosion or vehicular traffic.

General

The project is within the Fresh Pond AEC and the nearest surface water is Buzzard Bay assigned a water
quality classification SC.
Stormwater Collection and Disposal
The basic stormwater management design concept established by Craig Morgan was to sheet flow runoff to a
primary dry infiltration drainage swale situated along the north property line adjacent to the parking lot and
thence(if condition warrants)overflow to a secondary dry infiltration area located in the north east part of the
site by the entrance driveway. The total above-ground storage capacity(i.e.not taking into consideration the
infiltration and storage capacity of the in-situ sandy soils)of the two existing infiltration areas(derived from
Craig Morgan's design plan details)equates to 1.0"of runoff over all built upon area. Excess runoff that is
not retained or infiltrated on site within the two designated stormwater collection areas is then directed into
the NCDOT drainage network within US 158 right of way. The system appears to be functioning as intended.
As stated above,proposed development will add 36,943 sq.ft. (15,960+20,983)of built upon area to the
site. Our approach to stormwater management planning in order to accommodate new construction is to
simply expand the existing working system in proportionate amount to increased built-upon area. Detailed
calculations and supporting documentation for the expanded system is enclosed.
The proposed expansion to the stormwater management system to serve the proposed Phase 3 development
will involve removing a large section of asphalt from the existing cul-de-sac and constructing a rectilinear
stormwater infiltration basin expansion to the primary infiltration basin in the available area. The infiltration
basin will have contours that will tie directly to the existing contours of the grassy swale containment system
serving Phases 1 &2. The bottom elevation for the stormwater management system expansion as well as the
existing system is approxinmately 9.0'MSL. The pond top elevation for both the expansion and the existing
system is approximately l 1.0'MSL. This stornnwater system expansion will handle runoff in the same
fashion as the previously approved system serving Phases 1 &2,that is to retain the first inch of runoff for
infiltration in the primary and secondary infiltration basins. This infiltration pond expansion will more than

adequately provide on site storage of the first inch of stormwater generated from all proposed impervious
areas. Calculations indicate that this basin expansion will retain 1.3"of stommvater runoff. Calculations
showing the proposed retention pond volume verses the runoff volume generated by the proposed
development have been included for inspection.
Soils
The soil type that is predominant on this project site is CoB, Corolla fine sand,B slope(see attached
photocopy of soil map). This soil type has a high permeability and is subject to rare flooding only during
strong wind tides or hurricanes. Additional information on this soil type can be found within the United
States Department of Agriculture,Soil Conservation Service, Soil Survey of Dare County,North Carolina.
The seasonal high water table for this soil is located 1.5 to 3.0 feet below the surface according to the above
mentioned soil survey manual. Soil borings perfornned by Dare County Health Department and witnessed by
our staff showed evidence of the seasonal high water table at 1.5 to 3.0 feet below the surface.

Conclusion
The stornnwatcr management system expansion to the existing system will adequately contain and infiltrate
the first 1.0 inch of stormwater runoff on site.

The applicants' site is a 4.33 acre tract located at 2004 South Croatan Hwy. in a section of the Town of
Kill Devil Hills which is zoned for light industrial uses. This site is near the Kill Devil Hills/Nags Head
municipal line directly south of Fresh Pond Drive and within designated Fresh Pond water supply
watershed AEC. This site is currently used for light industrial/commercial uses and includes a total of
85,515 sf. of impervious surface. These surfaces include a 36,000 sf. one-story office and small
warehousing building and approximately 49,515 sf. of asphalt/concrete parking area. The existing
office/warehouse is serviced with a 1,000 gpd septic tank/drainfield system which is greater than 500 ft.
from the designated freshwater pond. A 2,850 sf. swale area and retention pond exists on the site for
current stormwater retention. The site is an average elevation of about 11 ft. MSL.
The undeveloped portion of this tract is vegetated in predominantly Pinus taeda and Myrica cerifera as well
as Quercus virginiana ,other Quercus species and indigenous grasses and sedges.
This tract is within an A-II water body as classified by the Division of Environmental Management and is
designated by the Coastal Resources Commission (CRC) as a Public Water Supply AEC. This AEC
includes two broad categories including public water supply well fields and small surface water supply
watersheds. Four specific public water supply areas have been identified by the NC DEHNR. This
specific watershed has been designated by the CRC and includes a freshwater lake/pond that provides for
raw water intake for both the of the Towns of Nags Head and Kill Devil Hills. This water body is supplied
by precipitation and groundwater from the surrounding landmass. Use Standards for this AEC restrict
development within 1,200 feet from the edge of the pond. This restriction concerns the construction or
placement of effluent discharges or other influent pollution sources and limits the placement of these
discharges to a horizontal distance of 500 feet from the edge of the Fresh Pond.

The applicant proposes to expand the existing office/ warehouse complex. The proposed development
includes the addition of 15,960 sf, office building and 20,984 sf. asphalt parking area for a total
impervious surface area increase of 36,944 sf. The project will be serviced with the existing septic tank
and drainfield system. The project will include the expansion of the existing 2,850 sf. stormwater retention
system and includes the addition of a 2,000 sf. retention pond which is greater than 500 feet from the
Fresh Pond and will serve to collect all additional roof and parking area runoff and direct it away from the
freshwater pond, outside the 500 foot line.
Anticipated, Impget
The proposed development will result in a total land disturbance of 0.894 acres and if runoff is
unmanaged, it could impact the watershed with increased turbidity or other runoff associated influent
impacts, etc. If the proposed (and approved) runoff retention expansions are in operation prior to building
and parking lot construction, the stormwater retention system could minimize these impacts.
This project will increase the total onsite impervious surface area on this tract to 2.808 acres within the
watershed and Fresh Pond AEC. This increase brings the total impervious surface area for the entire tract
to 64.8 %.This percentage conforms with the maximum impervious surfaces allowable in the Town of Kill
Devil Hills Chapter 21 Zoning Ordinance.
