In a letter dated March 1, 2021, the Division of Water Resources (DWR) provided Pilot Travel
Center, LLC (Pilot Travel Center) notice of DWR's intent to revoke the NPDES permit for Pilot
Travel Center #393 — Permit # NCO086053 (Permit). DWR received confirmation that Pilot
Travel Center received DWR's notice on March 5, 2021. DWR received Pilot Travel Center's
letter, dated April 30, 2021, objecting to revocation of the Permit. Due to Pilot Travel Center's
objection and in accordance with applicable law, DWR public noticed its intent to revoke the
Permit, deny Pilot Travel Center's pending renewal application, and deny a pending
ownership/name change request. The public notice was published in The Mountaineer on June
2, 2021 and the comment period on the notice ended on July 2, 2021. DWR reviewed the public
comments, including comments submitted by Pilot Travel Center and Junaluska Sanitary District
(JSD).
Revocation and Renewal Application Denial:
Pursuant to 15A NCAC 02H .0112(b)(3) and 15A NCAC 02H .0114(a), DWR has the authority
to revoke a NPDES permit for "a change in any condition that requires either a temporary or
permanent reduction or limitation of the permitted discharge." Pursuant to 15A NCAC
02H .0112, DWR has the authority to deny an application where necessary to effectuate the

purposes of Article 21 Chapter 143 of the General Statutes. Similarly, pursuant to 40 CFR
§122.64, DWR may terminate a permit or deny a permit renewal application for:
A change in any condition that requires either a temporary or permanent
reduction or elimination of any discharge or sludge use or disposal practice
controlled by the permit (for example, plant closure or termination of
discharge by connection to a POTW) (emphasis added).
Part II, Section B of the Permit reiterates those legal authorities.
Pilot Travel Center demolished its wastewater treatment plant and eliminated its discharge by
connecting to the Waynesville publicly owned treatment works (POTW) through JSD's
collection system. In December of 2020, DWR's Asheville Regional Office conducted an
inspection that verified that Pilot Travel Center's treatment system has been closed out and there
is no longer a point source discharge to surface waters. Accordingly, DWR hereby revokes the
Permit and denies Pilot Travel Center's renewal application.
Ownership/Name Change Request:
Pursuant to 40 CFR § 122.63(d), DWR may do a minor modification to a NPDES permit to:
[aJllow for a change in ownership or operational control of a facility where the
Director determines that no other change in the permit is necessary, provided that
a written agreement containing a specific date for transfer of permit
responsibility, coverage, and liability between the current and new permittees has
been submitted to the Director.
Despite the wastewater treatment plant being demolished and discharge eliminated, Pilot Travel
Center submitted a ownership/name change request in October 2020.1 With this letter, DWR is
revoking the Permit and denying Pilot Travel Center's renewal application, so the Permit cannot
be transferred to JSD.
Additionally, ownership or control of the facility that is the subject of the Permit has not changed
per 40 CFR § 122.63(d). The sales agreement even states that there was no transfer of "any
physical assets, such as piping, buildings, tanks, pumps, wwtp appurtnaces [sic]." Instead, the
sales agreement purports to transfer ownership of the Permit itself. However, State and federal
law as well as the NPDES permit itself make clear that transferring an NPDES permit is a
regulatory process requiring DWR action.
Moreover, the ownership/name change request submitted essentially asks DWR to transfer a
NPDES permit where the discharge was eliminated and treatment facilities razed to authorize a
potential new discharge of unknown wastewater quality and quantity from a potential new
WWTP of unknown specification and location. NPDES permits must be issued with conditions

that account for the characteristics of the waste stream in a manner that protects the waters
receiving the final discharge. Here, DWR has no information about the waste stream for
treatment, the proposed treatment system, or the specific location of the potential new discharge.
Accordingly, DWR hereby denies the ownership/name change request for the Permit.
DWR's actions can be contested as provided in Chapter 150B of the North Carolina General
Statutes by filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office
of Administrative Hearings (OAH) within sixty (60) calendar days. Requirements for filing and
serving a Petition are set forth in Chapter 150B of the North Carolina General Statutes and Title
26 of the North Carolina Administrative Code. Additional information regarding requirements for

In its May 27, 2021 letter, the Division of Water Resources (DWR) provided an update regarding
the request for an ownership/name change via a minor modification for the NPDES permit for
Pilot Travel Center # 393, NCO086053 (Permit). That letter also provided Junaluska Sanitary
District (JSD) with a copy of a public notice that the DWR intended to publish giving notice of
the potential actions that DWR may take, including revocation of the Permit, denial of the Pilot
Travel Center's pending renewal application, and denial of a pending request for an
ownership/name change. The public notice was published in The Mountaineer on June 2, 2021
and the comment period ended on July 2, 2021.
DWR reviewed the public comments, including comments submitted by JSD. If JSD is
interested in an NPDES wastewater discharge permit for a new discharge from a new wastewater
treatment plant, then it should submit an application for a new permit through the DWR Central
Office. You can also find information about the NPDES permitting process on our website at:

submitted on July 24, 2020 and DWR did not "approve" the renewal on September 20, 2020 as

Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
This final permit includes no majorchanges from the draft permit sent to you on
November 10, 2010.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this
decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local

Please find enclosed the following documents per your agency's request:
One original and two copies of NPDES Application for Permit Renewal —Form A.
Written documentation showing delegated authority for Dynamis, Inc. (an authorized
representative of Pilot) to prepare the renewal package.
One signed original and two copies of a narrative description of the sludge management
plan for the facility.
In addition, on July 22-23, 2010, the following repair and routine maintenance items were
performed on the WWTP, in order to increase aeration treatment and improve the levels of
ammonia in the treated effluent:
1. Installed new belts on the blowers.
2. Changed out oil in the blowers.
3. Greased the motors and blowers.
4. Repaired the 2" line at the Equalization tank where the water is pumped up to the first flow
splitter box.
5. Improved aeration at each of the aeration tanks by increasing diffuser drops to two per tank.
Upon completion of the repairs, the WWTP was turned back on and was operating normally.

Narrative Description of the Sludge Management Plan for:
Pilot Travel Center # 393-WWTP

It is my understanding that the sludge from this waste water treatment plant (WTPP) is wasted
from the clarifier as process control dictates necessity. Sludge is collected in a dedicated tank for
thickening. Mike Smith, a North Carolina licensed waste hauler, hauls the thickened sludge to
the local WWTP for disposal.
See attached system specification sheet for information on the wastewater treatment plant
(WWTP).

The NPDES Unit received your request for a permit modification. Based on adverse comments from EPA, the
Division was required to implement daily maximum NH3 as N (ammonia) limits for non -municipal facilities, as required by the
Code of Federal Regulations. This implementation policy was adopted October 15, 2002. The daily maximum value is five
times the monthly average value (this multiplier was established based on a review of treatment capability at various non -
municipal plants). However, daily maximum values are capped at 35.0 mg/L, regardless of the monthly average value. This
permit includes both monthly average and daily maximum limits for ammonia nitrogen.

issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,
1994 (or as subsequently amended). The following changes have been incorporated into this final
permit:
➢ Your expiration date for this permit has been changed to January 31, 2011.
➢ Daily maximum limits for ammonia nitrogen have been placed in your permit as a result
of U.S. Environmental Protection Agency Requirements to develop daily maximum
restrictions for every permit that has a monthly average limit.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits

SLUDGE MANAGEMENT PLAN
The sludge management plan for the Pilot Travel Center located in Haywood County, North
Carolina and denoted by NPDES Permit NCO086053 is as follows:
Regular settleometer testing of the mixed liquor is performed at the treatment facility to assist
with process control. As results deem necessary sludge is wasted from the clarifier to the
digester for thickening. Supernatant is pumped from the digester to nearby aeration chambers.
When the digester reaches is 80% full with a sludge of reasonable consistency Carver Waste is
notified to haul the sludge to Lake Junaluska Sanitary Station.

forwarding herewith the subject state - NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following redeipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh,
North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. Part II, EA. addresses the requirements to be
followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or

Supplement to NPDES Permit Application
(Pursuant to Administrative Code Section: 15A NCAC 211.0100-Wastewater Discharges to Surface Waters)
1. Subpart 0105 ( c )(1) Description of the origin,type and flow of waste which is
proposed to be discharged.
Domestic wastewater will be received from the Pilot Travel Center and Midway
Motel. The Pilot Travel Center is an auto/truck stop with a 134 seat restaurant, 4
showers with water saving shower heads, 4 standard commodes, 4 low flow
commodes and 3 urinals in the men's restroom and 3 low flow commodes in the
women's restroom. The Midway Motel has 20 rooms and one (1) bedroom apartment
with water saving shower heads. All water saving shower heads have a maximum
capacity of 1.5 GPM. The Pilot Travel Center currently discharges an average of
5,100 GPD and the Midway Motel discharges an average of 1,900 GPD for a total of
7,000 GPD. The wastewater treatment and disposal facilities need to be constructed
to prevent the closing of the motel and travel center which would result in the direct
loss of employment for approximately 61 persons. The proposed treatment and
disposal facilities are needed because of failure of the existing on -site subsurface
treatment and disposal system (septic tank and drainfield).
As required by Administrative Code Section: 15A NCAC 2H .0100-Wastewater
Discharges to Surface Waters, Subpart .0105 ( c )(1), "flow shall be determined in
accordance with 15A NCAC 2H .0219(1)". Design flow rates are as follows:
• Midway Motel
20 rooms x 120 gal/room = 2,400 GPD
(1) One bedroom apartment x 120 gal/bedroom = 240 GPD*
*Minimum volume per day per dwelling unit
• Pilot Travel Center
134 restaurant seats x 50 GPD/seat for 24 hr restaurant = 6,700 GPD
14 water closets and urinals x 250 GPD/ w.c. or urinal = 3,500 GPD
4 showers x 10 gal/person x max. 48 persons/day/shower = 1,920 GPD
Total wastewater flow rate 14,760 GPD
SAY 15,000 GPD
Note: Wastewater treatment facility aeration reactor volume required for 15,000 GPD
flow and expected average CBOD5 and TSS concentrations of 320 mg/l is 19,962
gallons (say 20,000). The wastewater treatment facility design will also include
reserve capacity of 10,000 GPD of standard domestic sewage with average
concentrations of 200 mg/1 CBOD5 and TSS. Total wastewater treatment facility
aeration reactor volume is 30,000 gallons with a permitted capacity of 25,000 GPD.
2. Subpart 0105 ( c )(2) A summary of waste treatment and disposal options that were
considered and why the proposed system and point of discharge were selected.
The existing on -site subsurface treatment and disposal system which was utilized for
a number of years has failed. Soil conditions are apparently not too conducive to
percolation. A Public Owned Treatment Works Wastewater Facility is not located
within several miles of the travel center and motel. From a design standpoint it would
not be practical to pump raw sewage the great distances necessary and it would also

not be economically feasible to do so. Soil conditions are apparently not conducive to
subsurface disposal or land application. The most feasible solution to the existing
failure of the on -site subsurface treatment and disposal system is to construct an on -
sit w ctewater treatment facility with disposal of the treated effluent into the
Crawford Branch or to its discharge into the Pigeon River. Wastewater residuals
owed from the liquid phase of the treatment process and further reduced
'.t by aerobic stabilization prior to disposal at a permitted facility capable of receiving,
treating and disposing of residuals.
3. Subpart .0105 ( c )(3) A narrative description of the proposed treatment works.
The proposed treatment works will consist of the following key components:
• A 0.030 MGD wastewater treatment plant which operates in the Extended
Aeration mode of the Activated Sludge Process. The proposed plant will be a
precast modular plant with the following major components:
(1) 5,000 Gallon Equalization Basin
(6) 5,000 Gallon Aeration Basin
(2) 5,200 Gallon Settling Basin with Scum Removal and Effluent Weir
(1) 5,000 Gallon Aerobic Digester
(2) 1,250 Gallon Chlorine Contact Basin
(1) 500 Gallon Post Aeration Basin
(2) Rotary Positive Displacement Blowers with 5 HP Moto�l
An effluent outfall for surface water discharge into the Crawford.Branch
Residuals Disposal: Removal of solids residuals will be monitored by the
facility operator. When necessary, residuals will be removed from the digester
and sent to another permitted treatment facility (to be determined) for further
processing.
4. Subpart 0105 ( c )(4) A general location map showing orientation of the facility with
reference to at least two geographic references (numbered roads named streams/rivers, etc.).

previous compliance with federal and state laws regulations and rules for the protection of
the environment as required by G.S. 143-215. 1 (b)(4)(b).
A statement attesting to these qualifications is attached.
8. Subpart 0105 ( i) Applicants for permits for new nonmunicipal domestic wastewater
discharges shall file a notarized statement indicating whether or not each city or
counly government having, jurisdiction over any part of the lands on which the
proposed facility is to be located has a zoning or subdivision ordinance in effect, and,

the ordinance.

GENERAL COMMENTS: This application was originally received in e/ylate November of 1996. I
reviewed tha application and accompanying Engineering Alternatives Analysis and forwarded a memo to Dave
Goodrich su zing my comments on December 2, 1996. Although the alternatives analysis was not considered
acceptable, KiHaynes indicated that there was no other alternative. The application was subsequently accepted on
January 31, 1997 by Dave Goodrich. At that time, a staff report and wasteload was requested. The wasteload was
received on March 3, 1997 with the permit drafted March 5, 1997.
The permit was drafted in accordance with thw wasteload allocation. All monitoring frequencies have been set in
accordance with the 2B .0500 regulations for a a class II facility.

I reviewed this package for an adequate Engineering Alternatives Analysis on December 2,
1996. Dave Goodrich subsequently held on to this package until January 24, 1997 while
deciding whether or not to return it. After discussions with Dave Goodrich and Forrest
Westall of the ARO, it was decided to accept the package as is - there seems to be no other
feasible alternative (that from both I*th Haynes and Forrest Westall). Also, this facility is
incurring significant expense to continue to pump and hall.
To this end, this package is being placed in the Processing Assiiant's box this day for
preliminary processing and assignment.
Two checks were originally submitted with the package - one for the permit fee and one for
the ATC fee. The ATC check will be returned with the acknowledgement letter with an
indication that this fee should be sent to the Division at such time as plans and
specifications are ready for review.

The Division recently received a discharge application for a new facility located in
Waynesville. The facility is a truck stop with a restaurant and hotel. The proposed
discharge is 25,000 GPD. The facility currently discharges to a subsurface disposal facility
which is failing.
This is a new discharge and thus requires an alternatives to discharge analysis. There was
no such analysis provided. The applicant did mention that "Soil conditions are apparently
not too conducive to percolation" and that a POTW "is not located within several miles of
the travel center and motel." These vague descriptions should not be considered
acceptable. There is no discussion of costs, distance to POTW or sewer line extension,
soil type or boring information. There is also no information verifying the failure of the
current non -discharge option.
I spoke with Kieth Haynes of the Asheville Regional Office. Hk :ndicated to me that the
facility had indeed contacted him. He said that there is likely plenty of flow in the receiving
stream although I could not verify the flow from our flow data. Kieth also indicated that, if
necessary, the facility could run a discharge line to the Pigeon River.
In terms of alternatives, Kieth indicated that there are none. There are apparently no sewer
extensions nearby and the opporturnity for on -site subsurface disposal is non-existent due
to available land and soil conditions.
The facility also included a $150.00 ATC fee with their submittal. I told Kieth that if we
did indeed accept this application (at this point there seems to little reason not to), the ATC
check would be returned to them with the acknowledgement letter, indicating that an ATC
request should be made upon receipt of the NPDES permit.

Since there are no alternatives to a discharging system, it is
recommended that the Permit be issued. The facility is currently
having to pump -and -haul approximately 6000 gallons of wastewater a
