We issue this permit pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. Renewal Changes. The Division understands that you have made no significant changes to your water treatment plant (WTP) processes since last renewal. Therefore we have only updated your permit, site map, and also for your convenience, added parameter codes to your effluent table [see permit section A. (l.)]. Finally, please note your need to implement electronic DMR reporting. Implementing Electronic Discharge Monitoring Reports Whffis). Please be advised that the Division has implemented an electronic Discharge Monitoring Report (eDMR) program, in accord with requirements promulgated by the Environmental Protection Agency (EPA). We include in this permit the details to implement the eDMR program [see Section A. (3.)]. Federal regulations require electronic submittal of all DMRs by December 21, 2016, and specify that, if North Carolina does not receive such submittals, Permittees must then submit eDMRs directly to EPA. Therefore, the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions described herein. ACUTE TOXICITY (QUARTERLY) - MONITOR ONLY [15A NCAC 02B .0200 et seq.] The Permittee shall conduct acute toxicity tests on a uarterl basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology for Determining Acute Toxicity in a Single Effluent Concentration" (Revised -December 2010 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). The tests will be performed during the months of February, May, August, and November. These months signify the first month of each three month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. The parameter code for Pimephales promelas is TGE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Additionally, DWR Form AT-2 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1623 Mail Service Center Raleigh, North Carolina 27699-1623 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 3 0 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during any month, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Page 4 of 7 NPDES Permit NCO085511 A. (3.) ELECTRONIC REPORTING - DISCHARGE MONITORING REPORTS [G. S. 143-215.1(b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports and specify that, if a state does not establish a system to receive such submittals, then permittees must submit monitoring data and reports electronically to the Environmental Protection Agency (EPA). The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. NOTE: This special condition supplements or supersedes the following sections within Part H of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) • Section D. (2.) • Section D. (6.) • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting Requirements [Supersedes Section D (2) and Section E. (5) (a)] Effective December 21, 2016, the permittee shall report discharge monitoring data electronically using the NCDWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NCDEQ / Division of Water Resources / Water Quality Permitting Section ATTENTION: Central Files 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. See "How to Request a Waiver from Electronic Reporting" section below. Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. Page 5 of 7 NPDES Permit NCO085511 Starting on December 21, 2020, the permittee must electronically report the following compliance monitoring data and reports, when applicable: • Sewer Overflow/Bypass Event Reports; • Pretreatment Program Annual Reports; and • Clean Water Act (CWA) Section 316(b) Annual Reports. The permittee may seek an electronic reporting waiver from the Divisions (see "How to Request a Waiver from Electronic Reporting" section -below). 2. How to Request a Waiver from Electronic Reporting The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective. Signatory Requirements [Supplements Section B (11) M and Supersedes Section B (11) (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part 11, Section B. (I 1.)(a) or by a duly authorized representative of that person as described in Part H, Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. BACKGROUND The City of Asheville operates this water treatment plant [WTP] producing up to 7.5 MGD of potable water extracted from the Mills River. In 1996 the Division issued an Authorization to Construct (ATC) permit to the previous regional water authority for settling lagoons, but in 2006 ownership was transferred to the City of Asheville and formally named the Mills River Water Treatment Facility. Treated filter backwash (about 0.050 MGD) is discharged to the main stem of the French Broad River (see Site Map) resulting a negligible instream waste concentration (IWC = < 0.1%). The receiving -stream segment is currently classified WS-IV, B, CA. Wastewater Treatment. This WTP facility utilizes conventional wastewater -treatment technology [coagulation, flocculation, sedimentation, and disinfection]. The Permittee adds alum and other additives prior to mixing [see permit Supplement to Cover Sheet]. Conventional treatment is finalized by filtration through three (3) multimedia gravity filters. The Permittee backwashes the filters at minimum once every 96 hours; more often as needed, based on filter -head pressure. Flow-meter/recorders monitor the backwash events and provide data for the DMR. The Permittee backwashes the filters with finished drinking water treated with chlorine derivatives (disinfectant), zinc orthophosphate (anti-scallant), and fluoride. Ammonia is not used. Upon initiating each backwash, the operator doses the effluent with the appropriate amount of dechlorination chemical. The discharge is diverted to one of two (2) each 750,000-gallon settling lagoons where the treated wastewater decant is allowed to flow to the outfall. As needed each lagoon can be isolated to allow further solids dewatering and sludge removal. A Sludge Management Plan is in place, and states that annually a contractor pumps the accumulated sludge from the lagoons, and disposes into an approved manhole of The Metropolitan Sewer District. BIMS shows two TRC limit exceedences but at levels below the state compliance [50 µg/L]. The record also lists a single monitoring -frequency violation for turbidity (Oct2015). PERMITTING STRATEGY For renewal, the Division referenced the Water Treatment Plant Guidance (2009) for conventional WTP facilities. Because there was no Total Iron database for last renewal, iron monitoring could not be evaluated. For this renewal the Total Iron database suggests no RP [max predicted 0.5 mg/L], therefore iron monitoring was discontinued [See DMR Summary below] — no other changes recommended. Describe the treatment process(es) for the raw water: Water is drawn from the Mills River and pumped to an untreated water storage reservoir where suspended materials are settled out. The settled water is pumped to the pre- ozonation system to begin disinfection where ozone gas is used to eliminate pathogens and other bacterial contamination. The water then flows to the rapid mix and flocculation basins where aluminum sulfate and sodium hydroxide are added to produce suspended particles. Sedimentation follows where suspended particles settle to the bottom of the sedimentation basin. The water then proceeds to another ozonation chamber for further disinfection as well as taste, color, and odor control. Next, the water flows through filters containing granular activated carbon where the media traps suspended solids and adsorbs other organic material in the water. Following filtration, a small amount of sodium hypochlorite is added for disinfection and to prevent the reintroduction of pathogens into the drinking water. Enough is added to maintain a minimum residual concentration throughout the distribution system. Fluoride is added to prevent tooth decay, sodium bicarbonate and zinc orthophosphate are added for corrosion control and sodium hydroxide to control pH. The inclusion of sodium bicarbonate also increases the buffering capacity of water thereby helping to prevent pH swings in the distribution system. S. Treated/filtered water is used to back flush the filters. The contaminants that are removed plus the water used for backwashing, drains to one of two lagoons located on the premises. Once in the lagoon, the suspended solids are allowed to settle to the bottom and the supernatant flows to the French Broad River. In addition to backwashes, the contamination flushed out during wash ups and spill clean ups, filter excursions that initiate the filter to waste sequence, leaks and the daily discharge of sludge that accumulates in the sedimentation basins also contribute to sludge/waste generation. Once a year a commercial firm is contracted to dredge, dewater and remove the sludge from the lagoon. The liquid/solid waste that is removed is delivered to the local sewerage treatment plant for processing/disposal. The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The Mills River WTP facility discharges intermittent treated conventional chlorinated backwash water to the French Broad River, a class WS-IV, B, CA water in the French Broad River Basin. The Authorization to Construct approval for the settling lagoons was issued in 1996. Initially, the stream segment classification had been WS-IV but was re -classed as C. The classification was then changed to B as reflected in the current permit. The correct full designated classification for this segment of the French Broad River is WS-IV, B, CA. In 2006, the ownership was transferred from the regional authority to the City of Asheville. The conventional treatment process consist of mixing, flocculation, settlement followed by filtration through three multimedia gravity filters. Alum and other additives are added prior to mixing. The filters are required to be backwash a minimum of once every 96 hours, or more often if needed based on filter head pressure. Flow meter/recorders monitor the backwash events and provide the data for the DMR. The finished drinking water is used to backwash the filters. The finished drinking water has been treated with chlorine derivatives (disinfectant), zinc orthophosphate (antiscallant), and fluoride. Ammonia is not used. Fact Sheet NPDES NC0085511 Page 1 of 3 Upon the initiation of each backwash the operator doses the filter backwash discharge water with the appropriate amount of dechlorination chemical. The discharge is diverted to one of two 750,000 gallon settling lagoons where the decanted wastewater is allowed to flow to the outfall. As needed each lagoon can be isolated to allow further solids dewatering and sludge removal. A Sludge Management Plan is in place, and states that annually a contractor pumps the accumulated sludge from the lagoons into an approved manhole of The Metropolitan Sewer District. The Permittee petitioned the Division as part of this renewal to consider removal of iron monitoring. HISTORY The facility has an excellent compliance history and no issues. PERMITTING STRATEGY The Division's Water Treatment Plant Strategy for conventional facility was applied: - Settleable solids monitoring was removed. Not required. - Effluent monitoring for Turbidity 2/month was added. No limit required since the receiving stream is not impaired for turbidity. Remove instream turbidity monitoring, not required. - Effluent monitoring for Total Copper, Fluoride, Manganese, Total Zinc, Total Phosphorus, and Total Nitrogen monitoring was added. Wastewater contains zinc -based antiscalant and fluoride. Nutrient monitoring required for discharge = > 50,000 gpd. For further clarity, a minimum detection of 10.0 µg/1 will be required for Total Copper, Manganese, and Total Zinc analysis. - Effluent monitoring for Acute Toxicity Test, freshwater, 90% concentration, was added. The IWC is < 0.25% and dictates Acute Toxicity applies. Toxicity samples to be collected at same time as all other effluent monitored parameters samples. - Existing effluent Aluminum and Total Iron monitoring were reduced to quarterly. - A pH 2/month monitoring with a limit range of 6.0 S.U. to 9.0 S.U. was added. - Existing effluent TRC footnote narrative was updated to define compliance conditions and measurement protocol. Since it was necessary to apply the strategy iron could not be removed. But the removal will be considered as part of the next renewal. All monitored requirements must be conducted at the same time as the sampling for the Acute Toxicity Test. The IWC calculation was re -calculated based on best estimated stream data and confirmed the TRC limit was correct, and used to determine which toxicity test to apply. As required, a copy of the draft permit with an approval form will be sent to the Mooresville DEH Engineer for review. The signed returned approval form return will document DEH approval and/or position. About 50% of the time the downstream turbidity did increase but only 1 out of the 107 samples events every indicated that 50 NTU was exceeded. It was noted the downstream sample point include the addition stream volume from two major creeks that converge into the French Broad River after this discharge. SUMMARY OF PROPOSED CHANGES In keeping with Division policies the following will be incorporated into the permit: • Setteable solids and instream turbidity monitoring was removed. • Aluminum and total iron monitoring reduced to quarterly. • Total copper, fluoride, manganese, total zinc, TN, TP quarterly monitoring was added. • Acute toxicity quarterly monitoring was added. (Special condition narrative for freshwater acute toxicity testing at 90% concentration) • pH 2/month monitoring with a limit range was added. • TRC footnote narrative was amended. • Flow narrative was amended. • Minimum detection narrative for total copper, manganese, and total zinc was added. In 1996 a local engineering firm was retained to conduct a sludge management and disposal study for existing facilities at North Fork and Bee Tree as well as for the Mills River Facility. The information contained in the report has been and will continue to be useful in our sludge management program. The Mills River Water Treatment Facility has been designed and is operated in a manner, which should not generate a large quantity of sludge. We drain and concentrate the sludge from the lagoons annually or more often if needed. We use a commercial firm to perform mobile dredging and dewatering. In 1996 a local engineering firm was retained to conduct a sludge management and disposal study for existing facilities at North Fork and Bee Tree as well as for the Mills River Facility. The information contained in the report has been and will continue to be useful in our sludge management program. The Mills River Regional Water Treatment Facility has been designed and will be operated in a manner, which should not generate a large quantity of sludge. We plan to drain and concentrate the sludge from the lagoons annually or more often if needed. Existing City personnel and equipment can be utilized to remove the concentrated sludge from the lagoons for ultimate disposal. If necessary, we will use a commercial firm to perform mobile dredging and dewatering. The Metropolitan Sewerage District has expressed a willingness to accept our sludge. A process of bringing about Intimate contact between air or high purity oxygen In a liquid by spraying, aghallon or d tiuslon;(3a) Extended Aeration. An activated sludge process utilizing a minimum hydraulic detention time of 18 hours. (4) Agriculturally managed she. A separate stage of wastewater treatment designed for lite specific purpose of converting ammonia nitrogen to nitrate nitrogen; (26) Phosphate Removal, Biological. The removal of phosphorus front wastewater by an oxiciattoxic process designed to enhance luxury uptake of phosphorus by the microorganisms; (27) Poilshing Pond. A holding pond following secondary treatment with sufficient detention time to allow settling of linely suspended solids; (28) Post Aeration, Aeration following conventional secondary treatment units to Increase effluent D.O. or for any other purpose; (29) Post Aeration. (Cascade) A polishing method by which dissolved oxygen Is added to to effluent by a nonmechanical, gravity means of flowing down a "dos of steps or weirs; The Ilow occurring across Ilia stops or woks moves In a fairly thin layer and the operation of the cascade requires no operator adjustment; thus, zero points are assigned even tough this Is an essential stop to meeting the limits of the discharge permit; (30) Powdered to Granular Acilvaled Carbon Feed. A biophysical carbon process Thal utilizes biological activity and organic absorption by using powdered or granular activated carbon; Virgin or regenerated carbon is food controlled into the system; (31) Preaerallor, A lank constructed to provide aeration prior to primary treatment: (32) Preliminary Units. Unit operations In the treatment process, such as screening and comminution, that prepare the liquor for subsequent major operations; (33) Industrial Pretreatment. (a) Pre-treatment Unit, Industrial. A lank utilized for small wastewater treatment plants not containing a digester In which sludge may be kept fresh, and supematant withdrawn prior to a drying method (i.e. sludge drying beds); This may be done by adding a small amount of air simply to keep the sludge fresh, but not necessarily an amount that would be required to achieve stabilization of organic matter. If the turbidity exceeds these levels due to natural background conditions, the discharge level cannot cause any increase in the turbidity in the receiving water. All samples collected should be of a representative discharge. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be tonitored weekly at the effluent by grab sample.
