Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached final NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October
15, 2007 (or as subsequently amended).
The final permit includes the following significant changes from the existing permit:
➢ The monitoring requirement for iron has been removed as there is currently no water quality
standard for iron.
➢ Monitoring requirements for total hardness have been added according to policy on hardness
dependent metals.
➢ The effluent concentration for whole effluent toxicity testing has been updated from 1.4% to
4.5% to reflect updated instream waste concentration (IWC) calculations.
➢ Section A. (3) has been added to require electronic submission of effluent data. Federal
regulations require electronic submittal of all discharge monitoring reports (DMRs).
➢ Regulatory citations have been added to the permit.
➢ An updated outfall map has been included.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this permit shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain any other Federal, State, or Local governmental permit that may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number
is no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included
herein.
The City of Lincolnton
is hereby authorized to:
1. Continue to operate a conventional water treatment plant with discharge of filter
backwash wastewater. This facility has a design flow of 12.0 MGD and a
maximum, monthly average flow of 0.395 MGD.
The facility is located at the Lincolnton WTP (1338 Reepsville Road, Lincolnton) in
Lincoln County.
2. Discharge from said treatment works via Outfall 001, at the location specified on
the attached map into the South Fork of the Catawba River [stream ID: 11-129-
(2.5)] currently classified WS-IV waters in subbasin 03-08-35 [HUC: 03050102041
of the Catawba River Basin.

Beginning with the effective date of this permit and lasting until expiration, the Permittee is
authorized to discharge treated wastewater from Outfall 001. Such discharges shall be
limited and monitored' by the Permittee as specified below:

DWR's eDMR application system [see A. (3)].
2. The duration of the discharge flow must be reported.
3. The Division shall consider all effluent TRC values reported below 50 µg/I to be in compliance with
the permit. However, the Permittee shall continue to record and submit all values reported by a
North Carolina certified laboratory (including field certified), even if these values fall below 50 µg/l.

A. (2) CHRONIC TOXICITY MONITORING (QUARTERLY)
[15A NCAC 02B.0500 et seq.]
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December
2010, or subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 4.5%.
The testing shall be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be
performed during the months of March, June, September, and December. These months
signify the first month of each three month toxicity testing quarter assigned to the facility.
Effluent sampling for this testing must be obtained during representative effluent discharge
and shall be performed at the NPDES permitted final effluent discharge below all treatment
processes.
All toxicity testing results required as part of this permit condition will be entered on the
Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using
the parameter code TGP3B. Additionally, DWR Form AT-1 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response
data. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number,
county, and the month/year of the report with the notation of "No Flow" in the comment
area of the form. The report shall be submitted to the Water Sciences Section at the address
cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
then monthly monitoring will begin immediately. Upon submission of a valid test, this
monthly test requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North
Carolina Division of Water Resources indicate potential impacts to the receiving stream, this
permit may be re -opened and modified to include alternate monitoring requirements or
limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as
minimum control organism survival, minimum control organism reproduction, and
appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

A. (3) ELECTRONIC REPORTING OF MONITORING REPORTS
[NCGS 143-215.1 (b)]
Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted
and became effective on December 21, 2015.
NOTE: This special condition supplements or supersedes the following sections within
Part II of this permit (Standard Conditions for NPDES Permits):
• Section B. (11.) Signatory Requirements
• Section D. (2.) Reporting
• Section D. (6.) Records Retention
• Section E. (5.) Monitoring Reports
1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (al]
The permittee shall report discharge monitoring data electronically using the NC DWR's
Electronic Discharge Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each
month and submitted electronically using eDMR. The eDMR system allows permitted
facilities to enter monitoring data and submit DMRs electronically using the internet.
Until such time that the state's eDMR application is compliant with EPA's Cross -Media
Electronic Reporting Regulation (CROMERR), permittees will be required to submit all
discharge monitoring data to the state electronically using eDMR and will be required to
complete the eDMR submission by printing, signing, and submitting one signed original
and a copy of the computer printed eDMR to the following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due
to the facility being physically located in an area where less than 10 percent of the
households have broadband access, then a temporary waiver from the NPDES electronic
reporting requirements may be granted and discharge monitoring data may be
submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the
Director. Duplicate signed copies shall be submitted to the mailing address above. See
"How to Request a Waiver from Electronic Reporting" section below.
Regardless of the submission method, the first DMR is due on the last day of the month
following the issuance of the permit or in the case of a new facility, on the last day of the
month following the commencement of discharge.
Starting on December 21, 2020, the permittee must electronically report the following
compliance monitoring data and reports, when applicable:

Sewer Overflow/Bypass Event Reports;
Pretreatment Program Annual Reports; and
Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to
Request a Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient
at the time of each electronic submission. The permittee should use the EPA's website
resources to identify the initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means
the entity (EPA or the state authorized by EPA to implement the NPDES program) that is
the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic
reporting tool for each type of electronic submission and for each state. Instructions on
how to access and use the appropriate electronic reporting tool will be available as well.

Electronic submissions must start by the dates listed in the "Reporting Requirements"
section above.
3. How to Request a Waiver from Electronic Reportin¢
The permittee may seek a temporary electronic reporting waiver from the Division. To
obtain an electronic reporting waiver, a permittee must first submit an electronic
reporting waiver request to the Division. Requests for temporary electronic reporting
waivers must be submitted in writing to the Division for written approval at least sixty
(60) days prior to the date the facility would be required under this permit to begin
submitting monitoring data and reports. The duration of a temporary waiver shall not
exceed 5 years and shall thereupon expire. At such time, monitoring data and reports
shall be submitted electronically to the Division unless the permittee re -applies for and
is granted a new temporary electronic reporting waiver by the Division. Approved
electronic reporting waivers are not transferrable. Only permittees with an approved
reporting waiver request may submit monitoring data and reports on paper to the
Division for the period that the approved reporting waiver request is effective.

4. Signatory Requirements [Supplements Section B. (11.1 (b) and Supersedes
Section B. (11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person
described in Part II, Section B. (11.)(a) or by a duly authorized representative of that

person as described in Part II, Section B. (11.)(b). A person, and not a position, must be
delegated signatory authority for eDMR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an
eDMR user account and login credentials to access the eDMR system. For more
information on North Carolina's eDMR system, registering for eDMR and obtaining an
eDMR user account, please visit the following web page:

Certification. Any person submitting an electronic DMR using the state's eDMR system
shall make the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF
CERTIFICATION WILL BE ACCEPTED:

my direction or supervision in accordance with a system designed to assure that qualified
personnel properly gather and evaluate the information submitted. Based on my inquiry of
the person or persons who manage the system, or those persons directly responsible for
gathering the information, the information submitted is, to the best of my knowledge and
belief, true, accurate, and complete. I am aware that there are significant penalties for
submitting false information, including the possibility of fines and imprisonment for knowing
violations. "
5. Records Retention (Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years
from the date of the report. This period may be extended by request of the Director at
any time [40 CFR 122.41].

Stream — Discharge from WTP for Outfall 001 is into the South Fork of the Catawba River [Stream
Segment 11-129-(2.5)]. This segment is not currently listed as impaired in the 2016 North Carolina
303(d) List.
RPA:
The need for toxicant limits is based upon a demonstration of reasonable potential to exceed water quality
standards, a statistical evaluation that is conducted during every permit renewal utilizing the most recent
effluent data for each outfall. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC
RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero
background; 3) use of % detection limit for "less than" values; and 4) streamflows used for dilution
consideration based on 15A NCAC 2B.0206. Effective April 6, 2016, NC began implementation of
dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of
Instream Dissolved Metals Standards, dated June 10, 2016.
A reasonable potential analysis was conducted on effluent toxicant data collected between May 2012 and
October 2016. Pollutants of concern included toxicants with positive detections and associated water quality
standards/criteria. Based on this analysis, the following permitting actions are proposed for this permit:
• Effluent Limit with Monitoring. The following parameters will receive a water quality -based
effluent limit (WQBEL) since they demonstrated a reasonable potential to exceed applicable water
quality standards/criteria: N/A
• Monitoring Only. The following parameters will receive a monitor -only requirement since they are
action level parameters but did not demonstrate reasonable potential to exceed applicable water
quality standards/criteria: Fluoride, Copper, Zinc
• No Limit or Monitoring: The following parameters will not receive a limit or monitoring, since they
did not demonstrate reasonable potential to exceed applicable water quality standards/criteria and
the maximum predicted concentration was <50% of the allowable concentration: N/A

The Division of Water Quality (Division) personnel have reviewed and approved your application for renewal of the
subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. It is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
There is one change to this final permit from the draft permit sent to you on March 23, 2012. The limit for Total
Aluminum has been removed in keeping with recently revised permitting strategy for Water Treatment Plants.
The following changes have been made from the current permit:
• In accordance with our permitting strategy for Conventional Water Treatment facilities, and an
EPA required statistical review of the DMR reports, monitoring has been removed from the
permit for Settleable Solids and Iron.
• Turbidity monitoring has been changed to Monthly from Weekly. The limit has been removed.
• Quarterly monitoring has been added for Total Copper, Manganese, Fluoride, and
Total Zinc.
• A quarterly Whole Effluent Toxicity Test at 1.4% has been added.
• Instantaneous Flow measurement is retained, but the duration of flow must be recorded.
+ The TRC footnote has been updated in accordance with our permitting strategy.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
The City of Lincolnton is hereby authorized to:
1. Continue to operate a conventional water treatment plant with a discharge of filter -backwash
wastewater using the following processes:
Sludge is generated by pretreatment and sedimentation processes. The sludge is automatically
collected and discharged to a single sludge holding lagoon. Filter backwash is also discharged to the
sludge holding lagoon. The combined streams are gravity thickened. The thickened sludge is pumped
to a dewatering centrifuge. Overflow from the dewatering process is returned to the lagoon. The
lagoon is decanted utilizing a floating decanter. Overflow from the decanter is dechlorinated using
sodium bisulfite and discharged to the South. Fork Catawba River.
This water treatment plant has a design potable flowrate of 9.0 MGD and a monthly .average
wastewater discharge of 0.12 MGD. The facility is located at the Lincolnton WTP (1338 Reepsville
Road, Lincolnton) in Lincoln County.
2. Discharge from said treatment works at the location specified on the attached map into the South
Fork of the Catawba River, classified WS-IV, CA waters in the Catawba River Basin.

All samples must be collected from a typical discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2.) CHRONIC TOXICITY MONITORING (QUARTERLY)
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 1.4 %. The permit holder
shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The
tests will be performed during the months of March, June, September and December. Effluent sampling for
this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP313.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name, permit number, pipe number, county, and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences
Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to
quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day
of the month following the month of the initial monitoring.

SUMMARY
The City of Lincolnton uses a Conventional Water Treatment Plant to treat water drawn from the South
Fork Catawba River. The facility is designed to provide 9.0 Million Gallons per Day of treated water.
The backwash wastewater is estimated to be 0.12 Million Gallons per Day. The facility discharges the
backwash wastewater to South Fork Catawba River.
The receiving stream (South Fork Catawba River) is classified WS-IV, CA waters in the Catawba River
Basin. This reach is not listed on the 2012 Draft 303(d) list. All North Carolina streams are listed as
Impaired for Mercury based on fish consumption advisories.
Permitting Strategy:
Permitting Strategy for Conventional Water Treatment Plants is followed for this facility.
Discharge Data Review and RPA
DMR data for 2009, 2010, and 2011 was reviewed. Flow averaged 0.359 MGD, with a maximum of 1.44
MGD; there is no flow limit. RPA was performed for iron and aluminum. Iron does not show RP,
monitoring will be removed from the permit. Aluminum does show RP based on Aquatic Life, Quarterly
monitoring will be changed to Quarterly from Weekly.

Proposed Changes to the Permit
• Instantaneous flow measurement will remain, the frequency will change to 2/ Month from
Weekly, and the duration of flow must be reported.
• Monitoring for pH is added with limits of greater than 6.0 SU and less than 9.0 SU, monitoring 2/
Month.
• Monitoring for Setttleable Solids and limits are removed.
• Monitoring for Iron will be removed. See Discharge Data Review and RPA section.
• Monitoring for turbidity has been changed to Monthly from Weekly. The Turbidity limit has
been removed.
• The facility does add chlorine to the water, so the TRC footnote will be revised per the
Permitting Strategy. Monitoring is changed to 2/ Month from Weekly per the permitting
strategy.
• The facility does discharge Fluoride and Zinc Orthophosphate, so monitoring will be added for
Fluoride and Total Zinc. Monitoring is Quarterly.

C. Describe receiving stream features and pertinent downstream uses: The river is = 40
feet wide and 3-10 feet deep at the discharge point. The area immediately
downstream of the discharge is mostly urban for a distance of = 2 miles. From this
point onward the receiving stream passes through a mostly rural, agriculturally
dominant area. 7Q10 flow has been estimated at 13 cfs by the USGS.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

centrifuge, and effluent dechlorination (sodium bi-sulfite).

this time.
g. Possible toxic impacts to surface waters: Chlorine is added to the filter backwash
waste stream.
PART III - OTHER PERTINENT INFORMATION
Special monitoring or limitations (including toxicity) requests: None have been requested by
the permittee in this renewal nor are any requested by the RO.
PART IV - EVALUATION AND RECOMMENDATIONS
The City of Lincolnton has requested renewal of the subject permit for the discharge of filter
backwash supernatant and sludge centrifuge overflow from pretreatment and and sedimentation
from a single settling lagoon located at the Lincolnton WTP. Supernatent from the lagoon is
discharged to the receiving stream and the remaining residuals are centrifuged prior to being taken
to the Lincoln County landfill for disposal. There have been no changes to the WTP and/or the
NPDES permit since it was last reissued.
Pending receipt and approval of the draft permit from the NPDES Unit, it is recommended
that the permit be renewed as requested.

Description of Sludge Management Plan
The water treatment plant utilizes the following principal treatment process:
■ Raw water presetlting basin
• Actiflow raw water pretreatment (ballasted flocculation)
■ Conventional Flocculation
■ Conventional Sedimentation
■ Conventional Filtration
Sludge is generated by the pretreatment and sedimentation processes. The sludge for the
pretreatment and sedimentation processes is automatically collected and discharged to a sludge
holding lagoon.
The filter backwash is also discharged to the sludge holding lagoon. The combined sludge and
backwash flows are gravity thickened. The thickened sludge is pumped to a sludge dewatering
process. The dewatering process utilizes a centrifuge to dewater the sludge. The centrifuge
capabilities are as follows:
■ Input 40 to 50 gpm
■ Feed Concentration 2% TS
■ Bowl Speed 4,000 RPM
■ Drive Size 40 HP
The dewatered sludge is conveyed to a truck and is hauled to the Lincoln County landfill for disposal.
The overflow from the centrifuge is returned to the lagoon. The lagoon is decanted utilizing a floating
decanter. The overflow from the decanter is discharged to the South Fork Catawba River in
accordance with the effluent limitations, monitoring requirements and other conditions of the NPDES
permit.

A fast track application for Authorization to Construct dechlorination facilities was
received on January 23, 2007, by the Division. Authorization is hereby granted for the
construction of modifications to the existing Lincolnton WTP, with discharge of filter backwash
water into the Catawba River in the Catawba River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a dechlorination system utilizing sodium bisulfite pursuant to the
fast track application received on January 23, 2007, and in conformity with the
Minimum Design Criteria for Dechlorination Facilities.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NCO085588 issued November 14, 2005, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0085588.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Mooresville Regional Office, telephone number (704) 663-1699 shall be notified at
least forty-eight (48);hours in advance of operation of the installed facilities so that an on site

inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Pursuant to 15A NCAC 2H .0140, upon completion of construction and prior to operation
of these permitted facilities, the completed Engineering Certification form attached to this permit
shall be submitted to the address provided on the form.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at least
equivalent to or greater than the classification assigned to the wastewater treatment facilities by
the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class Il, I1I and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Prior to entering into any contract(s) for construction, the recipient must have obtained all
applicable permits from the State.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by

requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on September 14,
2005. This permit includes a TRC limit that will take effect on June 1, 2007. If you wish to install
dechlorination equipment, the Division has promulgated a simplified approval process for such projects.

If any parts, measurement frequencies or sampling requirements contained in this permit are

filter backwash supernatant from a single settling lagoon located at the Lincolnton WTP. There
have been no changes to the WTP and/or the NPDES permit since it was last reissued. Proposed
changes may include the addition of a TRC limit for which additional WWT facilities will be
required.
Pending receipt and approval of the draft permit from the NPDES Unit, it is
recommended that the permit be renewed as requested.

Description of Sludge Management Plan
The water treatment plant utilizes the following principal treatment process:
■ Raw water presetting basin
■ Actiflow raw water pretreatment (ballasted flocculation)
■ Conventional Flocculation
■ Conventional Sedimentation
■ Conventional Filtration
Sludge in generated by the pretreatment and sedimentation processes. The sludge for the
pretreatment and sedimentation processes is automatically collected and discharged to a sludge
holding lagoon.
The filter backwash is also discharged to the sludge holding lagoon. The combined sludge and
backwash flows are gravity thickened. The thickened sludge is pumped to a sludge dewatering
process. The dewatering process utilizes a centrifuge to dewater the sludge. The centrifuge
capabilities are as follows:
■ Input 40 to 50 gpm
■ Feed Concentration 2% TS
■ Bowl Speed 4,000 RPM
■ Drive Size 40 HP
The dewatered sludge is conveyed to a truck and is hauled to the Lincoln County landfill for disposal.
The overflow from the centrifuge is returned to the lagoon. The lagoon is decanted utilizing a floating
decanter. The overflow from the decanter is discharged to the South Fork Catawba River in
accordance with the effluent limitations, monitoring requirements and other conditions of the NPDES
permit.

The City of Lincolnton hereby requests renewal of the subject Permit. The Application - Short Form
C, Sludge Management Plan, Flow Schematic, and Location Map for this renewal are enclosed. A
letter of authorization for Pease Associates to act as the Authorized Agent for the City of Lincolnton is
also enclosed.
The City of Lincolnton is currently in the process of constructing an expansion of the Water Treatment
Plant. The peak, potable -water -production capability will be increased from 6.2 MGD to 9.0 MGD.
The expansion should be on line by July 2000.
We do not anticipate an immediate increase in the average and peak production. Production will
increase gradually as population increases and industries expand. The Application does not include
provisions to address this situation.
On the Application, we have indicated the current production and discharge volumes. We do not
anticipate that increased production will result in discharges that will exceed volumes during the
Permit period. We anticipate that it will be 10 years before production approaches an average of 9.2
MGD.

The sludge produced by this facility is generated from coagulation, flocculation, sedimentation, and
filtration processes, which remove the turbidity from the raw water. Raw water is obtained from the
South Fork Catawba River.
Alum and polymers are used to promote the removal process. Sludges removed from the processes
are transported to a decanting lagoon. Through a settling process, the solids are separated from the
water. Clarified effluent is decanted off the surface of the basin and discharged to the South Fork
Catawba River. The settled sludge solids are pumped from the bottom of the basin to a centrifuge
facility for further processing.
The centrifuge separates the solids from the liquid, recovering about 90 percent of the solids. The
output from the centrifuge is a sludge cake with approximately 20 percent solids by weight. Filtrate
from the centrifuge is returned to the decanting lagoon.
The dried sludge cake is transported to a sanitary landfill for disposal.

This letter provides information requested in your letter to Melba McGee of September
1 1, 1997 (attached). I previously responded to these comments in a letter I sent to Faith'
Abbott on October 23, 1997 (attached).
In our telephone conversation today, you indicated that my response to your first group
of questions pertaining to the NPDES permit and toxicity concerns was satisfactory as
provided.
My response to your second set of questions required some additional clarification. I
have provided (attached) the wastewater system improvements section of the City's Master
Plan alluded to in my October 23 letter.
I have previously advised the engineers, J.N. Pease Associates, of minimum criteria
triggering the requirement for an EA, and the necessity for issuance of a FONSI before
construction permits can be issued. They and the City are aware that new WWTPs or
expansions of 0.5 MGD orthat exceed 1/3 of the receiving stream's 7Q10 flow orthat would
cause loss of an existing use would trigger the requirement for an EA. They know that the
Lincolnton WWTP expansion will require an EA.
I hope this information is sufficient that you can communicate to Faith Abbott that your
concerns for information have been met. If gaps remain, please contact me or the engineer and
one of us will provide any additional information required. Thanks for your patience.

I am responding to your letters of 24 and 26 September 97 in which you provided
comments from review agencies that needed to be addressed before the revised EA could be
submitted to the State Clearinghouse for statewide review.
1 . The Division of Environmental Health (Herndon) had no objections to the project and
did not require additional information.
2. The Division of Water Resources (Yonts) had no objections now or previously in
1993.
3. The Wildlife Resources Commission (Mickey) agreed with the EA and had no
objection to the project.
4. The Division of Water Quality (Suverkrubbe) commented (a) that they wanted
clarification of a statement indicating how the conclusion was made that the filter backwash
effluent contained materials in non -toxic quantities, and asked whether a toxicity test was
performed. DWQ also asked (b) about specific questions about present or proposed
wastewater treatment facilities in the service area.
The assumption of non -toxic quantities was based on compliance with the NPDES
permit, a copy of which is attached. It does not contain a requirement for toxicity testing, and
therefore the statement that the filter backwash is normally non -toxic is unsupported. Instead,
the document should have stated that the discharge currently is and should remain within
NPDES permit limits.

The wastewater treatment plant capabilities questions have been addressed in the City
of Lincolnton's Water and Sewer Master Plan (October 1993)_ The plant is not under an SOC.
The section addressing the WWTP upgrade is attached for your review. Plans call for
improvements in three phases, culminating in a capacity change from 6.0 to 9.0 MGD.
Changes include phosphorus removal, denitrification, effluent polishing, dewate ring, and
production of compost from sludge. Other questions should be addressed to the engineer, Mr.
Don Garbrick, P.E. of J.N. Pease Associates (1-704-735-9001).
6. DWQ (Zoufaly) suggested that Lincoln County withdraw its request to reduce the
size of WS-IV protected areas for the South Fork Catawba River. Lincoln County has zoning
adopted for county -wide land use, including zoning within the protected area. This water
treatment plant expansion project is a City of Lincolnton project. The City is a separate entity
and is not participating in the County's request. On a separate question, the new intake will
replace the existing intake.
7. DWQ (Nowell) recommended inclusion of a section addressing water quality,
believed omitted. Water quality was addressed in the sections on impacts to surface water
resources (4.8), groundwater resources (4.7), introduction of toxic substances (4.9),
jurisdictional wetlands and waters (4.10), and fish and aquatic habitats (4.11).
8. DWQ (Cox) had no objections from a 404/401 standpoint, but cautioned that 401
certification was dependent on minimizing impacts to waters and wetlands to the extent
practicable. He further urged bioengineering of repaired streambanks with natural vegetation
as preferable to rip -rap. This information has been provided to the project engineer, J.N. Pease
Associates, and RJG&A is prepared to assist them with the principles and background of this
method if requested.
If these answers meet all concerns, should we provide you with a revised document
changing the sentence on toxicity, or will this letter and attachments be sufficient?

SECTION 6 - WASTEWATER SYSTEM IMPROVEMENTS
6.1 Wastewater Treatment Plant
To meet pending mandatory effluent limits which are significantly more
stringent than the existing limits, immediate steps must be taken to provide an upgrade
in the present treatment processes. These steps have been identified as a first phase of
required improvements needed over the next twenty years. Two other phases of
improvements are recommended for implementation within this time frame.
The first phase improvements include modifications which will significantly
upgrade the degree of treatment from a present secondary process to a more advanced
tertiary process. The advanced processes to be added will include biological
phosphorus removal (BPR), nitrification and denitrification, filtration, chlorination and
dechlorination, and final effluent aeration. if design of this first phase is started shortly
and allowing 12 months for design and approval followed by 24 months of construction,
then the new facilities would come on-line in mid 1996.
A second phase has been identified for further upgrade of the treatment. This
phase would involve improving the current sludge handling and disposal methods. At
present, sludge is dried in drying beds and the dry sludge, or at times liquid sludge, is
hauled off for disposal by land application. Land application, however, is becoming
progressively less viable since available land in close proximity to the treatment works
is becoming more scarcer and more expensive. Also land application involves
spreading sewage sludge on agricultural land, which eventually becomes part of the
food chain. This practice has subsequently an inherent liability related to public health
with all the liability being on the City. Other less liable methods are available which will
render the sludge safer or more readily disposable. These methods include composting,
lime stabilization, or incineration. In Lincolnton's case, the compost option is likely to
be the most advantageous and cost effective. Phase II, consequently, includes the
construction of a centrifuge dewatering system, followed by in -vessel composting. This
system is recommended for incorporation within the Lincolnton wastewater treatment
works with approximately five years.
The final phase, or Phase I11, would be to expand the WWTP capacity from 6.0
to 9.0 MGD in approximately 10 years' time.
Details of the components required for each phase are as follows:
6.1.1 Phase I - WWTP Improvements
• The Main Lift Station
Correct all current deficiencies, refurbish equipment as needed, and provide
a new hoist system.

• Preliminary Equipment
Correct all current deficiencies, refurbish equipment as needed, provide
new comminutor, new influent sampler, new submersible sump pump, and
new safety grating.
• Primary Clarifiers
Refurbish existing equipment and provide new effluent wiers.
• Roughing Filters
Take all three existing roughing filters out of service.
• Aeration System
Convert the existing aeration system to one suitable for Biological
Phosphorus Removal and for Nitrification and Denitrification. This
requires the construction of a new separate tank for the first step anaerobic
zone followed by conversion of existing Aeration Tanks Nos. 1 through 4
for use as the anoxic/oxic stage of the nutrient removal process. New
baffles and diffuser piping will be installed in this later zone. Existing
blowers will be refurbished as required.
• Secondary Clarifiers
Existing Secondary Clarifiers Nos. 1 and 2 will be taken out of service and
converted to Dissolved Air Flotation (DAF) thickeners. Existing Secondary
Clarifiers Nos. 3 and 4 will be deepened with side -water depths increased
from 9 to 14 feet, and the scrapper mechanisms replaced in both. A third
secondary clarifier (No. 5) will be added with a 94-foot-diameter tank with a
14-foot side -water depth.
• Chemical Treatment
For pH adjustment and phosphorus removal, trimming bulk tanks and
chemical feed pumps will be added for the addition of alum, caustic,
and/or ascetic acid.
• Digester Improvements
Convert one of the existing uncovered digesters to a gas storage holding
facility for improved operations. Also include a solids contact reactor for
treatment of supernatant for phosphorus removal prior to recycling.
• Tertiary Filters
Provide WWTP filters for effluent polishing. Filters will be equipped with
air/water backwash facilities.

• Clil(),-ination /Dechlorination
Tile existing chlorine contact chamber and chlorine feed building will be
modified to include a sulphur dioxide food system to remove chlorine after
it has met disinfection needs and prior to discharge to the stream.
• Post Aeration
A static aerator system will be installed to increase oxygen levels within the
effluent.
• Laboratory and Administration
In order to house increasing staff requirements for operation of the
upgraded WWTP and to conduct required testing procedures, new
laboratory and administrative facilities will be required.
• Controls and Instrumentation
For economic and effective operation, automat the BPR and filtration
processes with the use of a central control processor (mini -computer).
Monitor remaining process units on the same computerized controller.
6.1.2 Phase II - WWTP Improvements
• Mechanical Dewaterine
Provide new building to house a new high solids centrifuge to dewater
sludge in lieu of existing drying beds. The centifuge will produce a solids
with over 30 percent solids content which will provide a cost-effective mix
for utilization with a compost system.
• Compost Svstem
Provide an in -vessel compost system to provide the maximum, beneficial
use of the sludge. The sludges can be used as an effective soil conditioner
and sold to landscapers and nurseries. It may be sold in bulk or single -bag
form. The system would be used in lieu of the present land application
practices.
6.1.3 Phase III - WWTP Improvements
• Main Lift Station
Modify and increase the capacity of the existing pumps and wet well.
Consider the use of variable speed pumps.
• Preliminary Treatment
Increase the capacity of the existing grit removal system, including the
addition of one new detritor.

Quality (DWQ) has reviewed the above EA_ In addition to the attached comments from
other Units within the Water Quality Section, the Regional/ Program Management
Coordination Branch has the following comments on the proposal:
The document (page 9) states, "The filter backwash effluent may contain suspended
solids, aluminum, iron, and free or combined chlorine, normally in non -toxic
quantities." Please clarify how this conclusion was determined. Was a toxicity test
performed on the effluent to make this conclusion? if so, please provide details of the
test. Also, please provide the NPDES number for this facility and discuss the
facility's compliance history with any conditions of the NPDES permit.
b. The document does not address the existing or proposed wastewater treatment
capabilities in the service area for the project. What wastewater treatment plant(s)
(WWTP's) would be affected the project? What is the current operational status of the
facilities (i.e. are any under a Special Order of Consent, etc.) and what type of
process do they use (e.g. discharge or non -discharge)? What are the current average
daily flows and maximum capacities of each WWTP and what are their permit limits?
How much excess capacity does each facility have? At full production of 9 mgd,
how much water from the Lincolnton plant will be delivered to each WWTP as
wastewater? Do the WWTP's in the service area have sufficient excess capacity to
treat and dispose of this additional wastewater? Will expansions to any WWTP's be
required, and if so, have the facility owners begun to study this need? Could any of
these indirect effects of the water treatment plant project cause significant long-term
water quality impacts?

The Instream Assessment Unit has reviewed the subject document regarding the
expansion of the Lincolnton Water Treatment Plant. Our primary concern would be the
effect of the proposed withdrawal of an additional 2.8 MGD of water from the South
Fork Catawba River on downstream dischargers and other water withdrawals. Our
records indicate that the City of Lincolnton's WWTP, with a design capacity of 6.0
MGD, is located approximately 5 miles downstream of the WTP. In addition, the High
Shoals Water Supply is located approximately 6 miles downstream of the Lincolnton
WWTP. A preliminary review of the expansion indicates that the wastewater treatment
plant at its existing capacity will probably not be affected by the increased withdrawal.
However, a more thorough review would be needed to insure this.
On page eight (8) of the EA, it is indicated that DWQ will be contacted to
determine potential modifications to the wastewater treatment plant's effluent limits.
The Division of Water Resources will also have to be contacted to calculate the revised
7Q10 flow downstream of the expanded water treatment plant. The letter received from
DWR in 1993 addressed an expansion of the WTP to 12 MGD not to 9 MGD.
Other areas where the EA could have been more specific were the inclusion of a
section addressing Water Quality. Surface Water Resources was addressed in the EA but
the effects on Water Quality was omitted. Also, there could be more justification for the
expansion of the water withdrawal from 6.2 MGD to 9 MGD.

habitat, DWR and WRC have no objection to the expansion to a 9.00 MGD maximum
instantaneous rate of withdrawal. Our 1993 comments are attached.
(2) The City of Lincolnton should contact the Division of Water Quality (DWQ) and
Division of Environmental Health (DEH) about the expansion of the WTP and plans
to increase their withdrawal of water from South Fork Catawba River.

The Division of Water Resources (DWR) has completed the
instream flow study of the South Fork Catawba River to evaluate
the effect of expanding Lincolnton's existing withdrawal of 6.2
million gallons per day (mgd) to 12 mgd - the projected 20 year
demand. The purpose of this letter is to provide the results of
the study so that the City's Water and Sewer Master Plan can be
completed.
Backaround•
The DWR determined that the drainage area at Lincolnton's
existing water intake is about 262 square miles with a 7Q10 low
flow of approximately 52 cubic feet per second (cfs).
Lincolnton's existing water treatment plant has a capacity of
6.2 mgd, or 9.6 cfs. That capacity is 18.5 percent of the 7Q10
flow. Our review criterion for water supply intakes is that new
or expanded withdrawals which exceed 20 percent of the 7Q10
should be evaluated for the effects of reduced flows on water
quality, aquatic habitat, and any other instream flow needs
relevant to the site. The size of the proposed expansion would
increase the withdrawal to 36 percent of the 7Q10 and therefore
additional study of instream flow needs was necessary.
The N.C. Wildlife Resources Commission (WRC) was contacted to
request a rating of habitat quality in the 4.3 miles of the South
Fork Catawba between Lincolnton's water treatment plant intake
and wastewater treatment plant discharge. Based on 1990 data for
both plants, approximately 640 of the withdrawn water is returned
as treated wastewater. When weather and flows permitted, WRC
staff examined this reach by canoe and concluded that the aquatic
habitat quality is fair to poor.

Given this habitat quality rating, DWR and WRC decided that a
site specific study of aquatic habitat versus stream flow was not
warranted. Instead, data from similar sections of the First
Broad River near Shelby were used to determine if 36 percent of
the 7Q10 could be withdrawn from that location without causing
significant habitat losses. These reaches of the First Broad and
South Fork Catawba Rivers are similar in channel morphology,
habitat quality, and hydrology.
Instr=am Flow Studv:
The methodology selected to evaluate instream flows and
aquatic habitat is the Instream Flow Incremental Methodology
(IFIM). This approach contrasts aquatic habitat conditions
(depth, velocity, and substrate/cover) with species' responses to
these variables. The result is a habitat versus flow
relationship for each life stage of each species studied. This
in turn can be used to compare the habitat under natural stream
flows to that available under different "with -project" scenarios.
IFIM uses field data collected at a minimum of three
different flows to simulate habitat conditions over a range of
flows. Data is collected at stream cross -sections, or transects,
which are selected to represent the different habitat types
available in the stream reach being studied. The bottom profiles
of these transects are surveyed, and current velocity, cover, and
substrate data are recorded for numerous points (cells) on each
transect. The water surface elevation is also surveyed at each
transect to allow the model to calculate depth at each cell.
IFIM uses the measured velocities, water surface elevations, and
the calculated total stream discharges as input for various
hydraulic models which simulate velocities and water elevations
at specified flows.
The habitat model developed to represent the South Fork
Catawba River in the vicinity of Lincolnton's water intake is
composed of six transects from the First Broad River IFIM study -
both transects from the lower site near Shelby and the four
non -riffle transects from the middle site near Double Shoals.
These are all moderate to deep runs with primarily sand substrate
and cover consisting of wood debris and roots. Based on
consultation with the WRC, four life stages of redbreast sunfish
- adult, juvenile, fry, and spawning - were selected as the
species to be evaluated.
The habitat versus flow relationships developed for each of
the four life stages of redbreast sunfish were used to convert
records of stream flow into records of habitat available under
different conditions. The stream flow records used are from the
U.S. Geological Survey (USGS) gaging station on the First Broad

River near Lawndale (station #02152500) for the period beginning
in March 1940 and ending in September 1971. The existing and
proposed withdrawal scenarios for the South Fork Catawba were
generated by deducting 10 and 19.3 cfs from the daily flow
records for the First Broad River. These amounts are equivalent
to 18.5 and 36 percent of the 7Q10, the same percentages cf the
existing and proposed withdrawals for the South Fork Catawba.
Recommendations:
Based on a comparison of habitat durations under natural,
existing withdrawal, and expanded withdrawal flow scenarios, a
withdrawal of 12.0 mgd should not have a significant effect on
aquatic habitat in this portion of the South Fork Catawba River.
We are assuming that 12.0 mgd is the maximum instantaneous rate
of withdrawal, and that the pumping schedule will not employ
higher rates for shorter periods of time. From the standpoint of
instream flows for aquatic habitat, we therefore have no
objections to the expansion to a 12.0 mgd withdrawal.
In addition to evaluating effects on aquatic habitat, another
important consideration will be the effect cf reducing the 7Q10
flow in the river on the effluent limits for Lincolnton's
wastewater treatment plant. There is no recording stream gage in
the vicinity of the intake, so it is not possible to perform the
statistical calculations to precisely determine the reduced
7Q10. However, it would be lowered by at least the amount -of the
withdrawal, and probably a little bit more. The 7Q10 of 77 cfs
used in determining limits for the existing discharge permit is a
"natural" low flow that does not reflect upstream withdrawals.
The 7Q10's which reflect the existing 6.2 mgd withdrawal and the
potential 12 mgd withdrawal are approximately 67 and 58 cfs, or
slightly less, respectively..
The City of Lincolnton should consult the Water
Quality Section of the Division of Environmental Management (DEM)
to determine if water quality standards will still be maintained
and if more stringent discharge limits will be required. That
analysis, along with the 12.0 mgd withdrawal which is acceptable
for aquatic habitat, should provide the information you need to
complete Lincolnton's Water and Sewer Master Plan.
Water supply expansions of 1.0 mgd or more require submission
of an Environmental Assessment (EA) through this Department's
Division of Environmental Health. Other appropriate agencies,
including the WRC, should be consulted for their recommendations.
Areas of concern would likely include prevention of impacts
during construction and intake screening to prevent fish
entrainment. The U.S. Army Corps of Engineers should also be
contacted to determine if a Section 404 permit is required for
any intake modifications.

Robert J. Goldstein & Associates, Inc. (RJG&A) has been contracted by the City of
Lincolnton to prepare a SEPA Environmental Assessment for a proposed Water Treatment
Plant (WTP) expansion from 6.29 MGD to 9.00 MGD. The raw water for the Lincolnton WTP
is drawn from the South Fork Catawba River. A map is attached showing the project location
on a portion of the Lincolnton West USGS quadrangle.
Construction for the expansion will take place at the existing WTP and will include 3
new sedimentation basins and filters and a 2.0 MG clearwell and may include a new raw
water intake adjacent to the existing intake, a raw water main and a new pump station.
These upgrades will not disturb any undeveloped land within the treatment plant site. The
precise design for the expansion has not been determined.

PART IV - EVALUATION AND RECOMMENDATIONS
The City of Lincolnton has applied for an NPDES Permit to discharge filter backwash water
to the South Fork of the Catawba River. The City is pursuing this means of disposal as a result of
Public Water Supply's request that the filter backwash supernatant no longer be recycled into the
water intake lagoon due to concerns about Giardia.
The water to be discharged has been chlorinated and settled. The water at this facility is
treated with alum, caustic, carbon filtration and chlorination. The City is also considering installing
a centrifuge and belt press to de -water the sludge in the future. The City does not appear to have
investigated any means of land applying the backwash water. However, considering the nature of

the wastewater, land application may not be the most practical means of disposal.
This Office has no objections to the proposed discharge; therefore, it is recommended that
the permit be issued.

SUBJECT: Response to Environmental Assessment of Lincolnton Water Treatment
Plant Expansion
Lincoln County
The Instream Assessment Unit has reviewed the subject document regarding the
expansion of the Lincolnton Water Treatment Plant. Our primary concern would be the
effect of the proposed withdrawal of an additional 2.8 MGD of water from the South
Fork Catawba River on downstream dischargers and other water withdrawals. Our
records indicate that the City of Lincolnton's WWTP, with a design capacity of 6.0
MGD, is located approximately 5 miles downstream of the WTP. In addition, the High
Shoals Water Supply is located approximately 6 miles downstream of the Lincolnton
WWTP. A preliminary review of the expansion indicates that the wastewater treatment
plant at its existing capacity will probably not be affected by the increased withdrawal.
However, a more thorough review would be needed to insure this.
On page eight (8) of the EA, it is indicated that DWQ will be contacted to
determine potential modifications to the wastewater treatment plant's effluent limits.
The Division of Water Resources will also have to be contacted to calculate the revised
7Q10 flow downstream of the expanded water treatment plant. The letter received from
DWR in 1993 addressed an expansion of the WTP to 12 MGD not to 9 MGD.
Other areas where the EA could have been more specific were the inclusion of a
section addressing Water Quality. Surface Water Resources was addressed in the EA but
the effects on Water Quality was omitted. Also, there could be more justification for the
expansion of the water withdrawal from 6.2 MGD to 9 MGD.
