Division of Water Resources' Central and Regional staff have reviewed the application package
received on February 29, 2024. However, the Division requires additional information before completing
our review. Please address the items on the attached pages no later than the close of business on June 13,
2024.
Please be aware that the Applicant is responsible for meeting all requirements set forth in North
Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the
review of the subject application package. The Division may return the application as incomplete pursuant
to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in
Section A or the Applicant fails to provide the additional information on or before the above -requested date.
Please reference the subject application number when providing the requested information. The
Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and
submit an electronic response to my attention via the Non -Discharge online portal.

A. Setback Waivers:
Setback waivers submitted during the previous permitting cycle (Permit WQ0000543 issued
January 14, 2019) affecting Fields NC-CH-77-4 and NC-CH-77-18 contain the following language:
"This Agreement shall remain in effect for the length of the Division of Water Resources' (Division)
permit for the residuals land application program and shall be renewed each time this permit is
renewed. "
The renewal package received by the Division on February 29, 2024 does not contain updated
setback waivers recorded with the Chatham County Register of Deeds. Without these up-to-date
setback waivers, buffer zones for the properties will need to be redrawn pursuant to 15A NCAC
02T .1108(c). This will reduce the land application area for Fields NC-CH-77-4 and NC-CH-77-
18.
If the Permittee does not wish to pursue setback waivers, please submit updated application maps
and acreages for Fields NC-CH-77-4 and NC-CH-77-18. If the Permittee wishes to maintain the
fields as they were in the previous issuance, then please provide updated setback waivers. A new
version of the Non -Discharge Residuals Management Program Waiver for the Application of Class
B Residuals (Form: NDRMPW-LAS 11-18) is available and shall be used. Additionally, any
setback waivers shall be recorded with the Chatham County Register of Deeds. The newest version
of Form: NDRMPW will be included in the accompanying email for your convenience.
